HomeMy WebLinkAboutReso 70-1982RESOLUTION NO. 70-82 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION 'ORDERING AND CALLING'A SPECIAL MUNI- CIPAL ELECTION TO BE HELD ON NOVEMBER 2, 1982 FOR THE PURPOSE OF SUBMITTING TO THE VOTERS A CITY MEASURE TAXING.THE BUSINESS OF OPERATING A COMMER- CIAL PARKING FACILITY AND REQUESTING A CONSOLIDATION 'WITH 'THE 'GENERAL ' ELECTION ~TO' BE 'HELD ON 'THE 'SAME 'DATE BE IT RESOLVED by the City CounCil of the City of South San Francisco, San Mateo County, California, that: 1. Pursuant to the provisions of Elections Code Section 23302 and other applicable sections'Of said code, a special municipal election is hereby called and ordered in the City of South San Francisco on Tuesday, the 2nd day of November, 1982, for the purpose of submitting to the qualified voters of said City the following measure, to wit: CITY MEASURE: "Shall the Ordinance adding Section 6.16.047 entitled "Commercial Parking Facility" to the soUth San Francisco Municipal Code, which section will impose a'business license tax on commercial parking facil- ities in the amount of eight percent (8%) of the gross receipts without deduction therefrom, be adopted? 2. The Board of Supervisors of the County of San Mateo, State of Cali- fornia is hereby requested, pursuant to Sections 23300 et. seq., of the Elections Code of the State of California and other applicable ~sections 'of said code, to order the consolidation of the special municipal election to be held on November 2, 1982, with the statewide general election' to be held on the same date. 3. The consolidated election shall be held and conducted, election officers appointed, voting precincts designated, ballots printed, polls opened and closed, ballots counted and returned, returns canvassed, results declared, certificates issued, and other proceedings incidental to and connected wi th the election shall be regulated and done in accordance with the provisions of the law regulating the Statewide election. 4. Precincts used at the consolidated election shall be those used for the statewide general election. 5. The elections hereby consolidated shall~be held in all respects as if there were only one election. 6. All persons qualified to vote at municipal elections in said City upon the date of the election herein provided for shall be qualified to vote on the proposition submitted at said special municipal election, so consolidated. 7. Ballots for said election shall be provided on the form and in the number provided by law. On said ballots, in addition to any other printed matter which may be required by law, two voting spaces shall be set off to the right of the proposition submitted at the eleCtion, in the' manner' provided by law, one having the word."YES" printed before it and the other having the word "NO" printed before it. 8. EaCh voter to vote for'the proposition hereby submitted shall mark in the prescribed manner the voting space provided opposite the word "YES" on the ballot to the right of the proposition, and to vote against the proposition shall mark in the prescribed manner the voting space provided opposite the word "NO" on the'ballot to the right of the proposition. 9. The Board of Supervisors of the County of San Mateo is hereby requested to permit the County ' Clerk of said County to render the applicable services set forth in Exhibit "'A" attached hereto, relating to the conduct of the special election so consolidated to be held on Tuesday, November 2, 1982, and said City shall and doeS hereby accept and agree to comply with the terms and conditions of the performance of said election services and payments there- for. The County Clerk is further authorized and _.delegated to perform the applicable duties specified in Exhibit "A" for the purpose of said election. 10. Notwithstanding any other provisions of this resolution, the Board o EXHIBIT "A" TO RESOLUTION NO. 70-82 ADOPTED THE 7th DAY OF July , 19 82 Hereinafter set forth below are the services that may be rendered by the County Clerk incident to preparation for and conduct of Municipal Elections: A. SERVICES FURi~ISHED BY COUI;TY CLERK: l) Consoliclate Precincts: Provide list of consolidated precincts for designation and setting by City Council. 2) Precinct Indexes: Prepare and furnish precinct indexes, by con- solidated precinct, to the Affidavits of Registration of eligible voters. 3) Polling Places: To furnish a list of polling places for selection and designation by the City. To handle clerical detail of agree- ments for same. City shall be the party entering into the Agreement for the Polling Place and shall be responsible for any liability that arises therefrom. 4) Election Officers':. To furnish a list of Election Officers for select- ion and appointment by the City Council. To handle clerical detail in connection wi th the appointment of election officers and substitute election.officers on behalf of the City Clerk. 5) Checking of signatures'on Nomination Papers. 6) Sample Ballot Addressinq and Mailing: a) Addressing for mailing (including stock where applicable). b) Inserting: Affixing:of labels where applicable. c) Delivery to Post Office for mailing. 7). Ballot Preparation and Printing: a) Assist City Clerk in formatting and set up of Official Absentee Bal 1 ots. b) Prepare copy bf Official Voting Machine Ballot Labels from certi- fied copy supplied by City Clerk. Submit to printer, check proof. City Clerk to provide certification as to correctness before re- submission to printer for actual print run. c) Prepare ballot copy for Voting Machine Sample Ballots from certified data supplied by City Clerk. Submit to printer, check proof. City Clerk to provide certification as to correctness before resubmission to printer for actual print run. 8). To order from supplier designated b~v City Clerk: a) Polling Place Notice Stock, where applicable. b) Sample Ballot Envelopes, where applicable. 9) Voting Hachines: a) Delivery and Use: City Clerk to arrange for carrier to deliver voting machines to polling places and return to storage along with any supplemental election equipment (tables, chairs, etc) required. City to be responsible for insurance or liability arising in connection with the use of voting machines, including repair or equipment or machine damage not covered by insurance. Costs for drayage to be paid directly to carrier upon presentation of proper invoice. 11/21/77 iqunicipal Services Agreement - 1 - EXHIBIT "A" b) Services required to ready voting machines for use at the i~unicipal Election, including Voting Machine Technician services on Election Day. C) Voting l~achine Instruction Classes' To conduct classes for Election Officers concerned with the voting machine. Schedule of classes to be furnished City Clerk for mailing to officers. d) Voting Machine Supplies' To order, provide and prepare key envelopes, manuals, instructions, spoiled ballot certificates, I.D. tags and such other supplies needed in the use of voting machines. 10) Precinct Supplies' a) Optional Items Provided: Sacks. Flags, Polling Place Signs, Supply b) Preparation of Special Forms' Instructions to Inspector, Inspector Check List, Telephone Slips, any other special .information materials required. c) Result of Votes Cast Sheet' Preparation or arrangements for printin, g. d) Prepare and pack precinct supplies. e) Delivery of precinct supplies. ll) Warehouse Canvass: Services required to unseal the Voting Machines, to take off and record Record of Votes Cast and reseal Voting Machines prior to Official Canvass by City. City Clerk will be furnist~ed a Certificate by County Clerk for use in the Official Canvass procedure. SPECIFIED ELECTIOI~ ACTIONS TO BE PERFORMED BY CITY CLERK AND EXCLUDED FROM SCHEDULE OF COUNTY CLERK SERVICES' l) Nomination Papers- Issuance of Nomination Papers, Candidate Filings, Oath of Office and Candidates' Statements pursuant to Election Code Section 10012. 2) Official designation of Consolidated Precincts, Polling Places and Appointment of Election Officers by City Council. All Election Officer and Polling Place Fees to be paid by the City. (This would include any custodian fees which might be charged in connection with schools. ) 3) Legal Publications' Responsibility of City Clerk and payment to be made by City. 4) Absentee Voting' Processing of absent voter applications, mailing of absent voter ballots and voting in Clerk's Office to be handled by City Clerk. 5) Printer(s.) of all election materials to be.designated by-City Clerk and all printing costs to be paid by City Clerk. 6) Canvass' a) Absentee and Semi-Official Canvass responsibility of and to be ~ade by City Clerk. b) Official Canvass to be made by City Council. 7) City will be responsible for compliance with statutory requirements as set forti~ as the responsibility of the City Clerk in the Political Re- form Act of 1974. -2- EXHIBIT "A" 8) The conduct of the election remains the responsibility of the City Clerk. Performance of services hereinabove specified in Section A are at all times considered to be under direction of the City Clerk and the County shall assume no special authority or respon- sibility in tile conduct of the election designated to the City under provisions of the Elections Code, the Federal Voting Rights Act or such other law governing the conduct of the election. TERMS AND CONSIDERATION: Terms: Ttlis schedule shall be in effect for the performance of specified services incident to the preparation and holding of the ~.lunicipal Election of November 2, 1982. In the event the County is unable to perform services required under this Agreement as a result of employer/employee relation conditions, vendor conditions or other conditions beyond the control of the County Clerk,the County will be relieved of all obligations under this Agreement. Consideration: In consideration of the performance of tile aforementioned services and supplies provided by the County Clerk, the City shall pay to tile County Clerk, a sum equal to the actual cost of such services and supplies. - 3- EXHIBIT "B" NOTICE AND PROCLAMATION OF SPECIAL MUNICIPAL ELECTION CITY OF SOUTH SAN FRANCISCO NOTICE AND PROCLAMATION ARE HEREBY GIVEN AND MADE by the City Council of the City of South San Francisco, San Mateo County, California, that a special municipal election has been called and will be held on Tuesday, the 2nd day of November, 1982, for the purpose of submitting to the qualified voters of said City the following measure: CITY MEASURE: "Shall the Ordinance adding Section 6.16.047 entitled "Commercial Parking Facility" to the South San Francisco Municipal Code, which section will impose a business' license tax on commercial parking facilities in the amount of eight percent (8%) of the gross receipts without deduction therefr.om, be adopted? NOTICE IS FURTHER.GIVEN THAT: 1. THE POLLS shall be opened at 7:00 a.m. and shall be kept open until 8:00 p.m. of said day when the polls shall be closed, except as otherwise pro- vided in Section 14301 of the Elections Code. 2. ARGUMENTS in support of or against the measure shall be filed with the City Clerk on or before August 20, 1982 and REBUTTAL ARGUMENTS shall be filed with the City Clerk on or before August 30, 1982. 3. THIS SPECIAL ELECTION Cs consolidated with the statewide general election to be held on November 2, 1982. Dated: City Clerk City of South San Francisco · CITY ~MEASURE Shall the Ordinance adding Section 6.16.047 entitled "Commercial Parking Facility" to the South San Francisco Municipal Code, which section will impose a business license tax on commercial parking facilities in the amount of eight percent (8%) of the gross receipts without deduction therefrom, be adopted? of Supervisors of the County of San Mateo is hereby authorized to canvass the returns of the municipal election so consolidated or to order such canvass to be made by the County Clerk pursuant to law'. 11. The City Clerk is hereby authorized to procure all supplies and · make all arrangements necessary for the proper conduct of said election, in- cluding but not limited to, the services set forth in Exhibit "A" attached hereto. 12. Notice of Election, in the form attached hereto as Exhibit "B" and made a part hereof, shall be published once in Spanish and English in the Enterprise Journal, a newspaper of general circulation published and circulated within the City. Said publication should be made no later than the lOth day of August, 1982'. 13. Arguments in support of the measure shall be filed with the City Clerk on or before August 20, 1982 and the City Clerk shall submit same to the County Clerk on or before August 23, 1982 and rebuttal arguments shall be filed with the City Clerk on or before August 30, 1982 and the City Clerk shall submit same to the County Clerk on or before September 2, 1982.
