RESOLUTION NO. ]37-82
A RESOLUTION GRANTING CONSENT OF THE CITY COUNCIL OF
THE CITY OF SOUTH SAN FRANCISCO TO THE EXERCISE OF
EXTRATERRITORIAL JURISDICTION TO UNDERTAKE PROCEEDINGS
FOR THE FORMATION OF AN ASSESSMENT DISTRICT AND THE LEVY
AND COLLECTION OF ASSESSMENTS PURSUANT TO THE LANDSCAPING
AND LIGHTING ACT OF 1972
SIERRA POINT LANDSCAPING AND LIGHTING DISTRICT
RESOLVED, by the City Council of the City of South San
Francisco, California, that
WHEREAS, it is the intention of the City Council of the City
of Brisbane to undertake proceedings for the formation of an
assessment district pursuant to the provisions of the Landscaping
and Lighting Act of 1972, Part 2, Division 15, of the Streets and
Highways Code of the State of California, for the construction or
installation of improvements, including maintenance or servicing, or
both, thereof, more particularly described in Exhibit "A" attached
hereto and by reference incorporated herein;
WHEREAS, the costs and expenses of making said improvements,
including the maintenance or servicing, or both, thereof, are to be
made chargeable upon an assessment district to be designated as
"Sierra Point Landscaping and Lighting District', the exterior
boundaries of which district are the composite and consolidated area
as more particularly shown on a map thereof on file in the office of
the Clerk of the City of Brisbane to which reference is hereby made
for further particulars. Said map indicates by a boundary line the
extent of the territory included in the proposed district and any
zone thereof;
WHEREAS, a portion of said improvements to be made are within
the incorporated territory of the City of South San Francisco and a
portion of the lands t° be assessed to pay the costs and expenses
thereof is incorporated territory within said City;
WItEREAS, this Council has investigated and has been fully
informed as to the nature of said facilities and of the property
which Will be benefited by said improvements, and is fully advised
of the premises;
WHEREAS, there has been filed with this Council a proposed
form of Resolution of Intention to be used in said proceedings; and·
WHEREAS, the public interest, convenience and necessity will
be served by the making of said improvements and the levying of said
.assessments;
NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED, and ORDERED,
as follows:
1. That the improvements proposed to be made in said
proceedings are of such a character that they will directly and
peculiarly affect property not only within the boundaries of the.
City of Brisbane but also incorporated territory within the City of
South San Francisco, and the purpose sought to be accomplished can
best be accomplished by a single comprehensive scheme of work; and
it is necessary and manifestly desirable that said improvements be
accomplished under the jurisdiction of the City of Brisbane in order
to accomplish said single comprehensive scheme, and to the making of
such changes and modifications as may be proper or advisable in the
manner provided by law.
2. That consent be, and the same is hereby, granted to the
City of Brisbane for the formation of the assessment district and
the ordering of said improvements and the assumption of jurisdiction
thereover for the purposes aforesaid, and to levy said assessments
upon the property benefited t~ereby, including property within the
incorporated territory of this Cit~.

3. That the form of the Resolution of Intention to be
adopted by the City Council of the City of Brisbane, a copy of which
was heretofore presented to this Council, be, and the same is
hereby, approved.
4. That the Clerk of this City be, and is hereby, directed
to forward to the City of Brisbane a certified copy of this
Resolution.
I hereby certify that the foregoing is a full, true and
correct copy of a resolution which was passed and adopted by the
City Council of the City of South San Francisco, California, at a re§u]ar
meeting thereof held on the 3rd day of November , 19 82 ,
