HomeMy WebLinkAboutReso 138-1982RESOLUTION NO. 138-82 A RESOLUTION AUTHORIZING LITIGATION TO COMPEL THE CITY CLERK TO FILE AND RECORD BOUNDARY MAP GATEWAY ASSESSMENT DISTRICT 'NO. ST'82-2 WHEREAS, the City Council on October 6, 1982, adopted Resolution No. 119-82 entitled, "A Resolution preliminarily Approving Engineer's Report, Appointing Time and Place of Hearing Protests and Directing Notice Thereof, and Describing Proposed Boundaries of Assessment District and Directing Filing of Boundary Map - Gateway Assessment District No. ST-82-2"; and WHEREAS, the City Clerk, although being in favor of the City Council's proceeding with the assessments referred to in said Resolution has respectfully refused to file and record the Boundary Map on the grounds that it is, or may be, invalid; RESOLVED, by the City Council of the City of South San Francisco, COunty of San Mateo, California, that: 1. Robert K. Rogers, City Attorney, in conjunction with Herman Fitzgerald special legal counsel to the Redevelopment Agency of the City of South San Francisco, are herebY authorized and directed to institute and carry to conclusion an appropriate legal action to compel the City Clerk to file and record the Boundary Map referred to herein. 2. This Resolution shall take effect from and after the date of its passage and adoption. I hereby certify that the foregoing resolution was regulary introduced and adopted by the City Council of the City of South San Francisco at a special meeting held on the 8th day of November , 1982, by the following vote: AYES: Councilmembers Ronald G. Acosta, Mark N. Addiego, Emanuele N. Damonte, Gus Nicolopulos; and Roberta Cerri Teglia NOES: None ABSENT: None
