HomeMy WebLinkAboutReso 147-1982JHHW:KIJ:jn 06/14/82 1753C RESOLUTION NO. 147-82 A RESOLUTION OF INTENTION TO FORM MAINTENANCE ASSESSMENT DISTRICTAND LEVY ASSESSMENTS " BRENTWOOD OFF-STREET PARKING MAINTENANCE ASSESSMENT DISTRICT RESOLVED, by the City Council of the City of South San Francisco, California, as follows: 1. That the City Council intends to order that the expenses of maintaining and operating any or all of the off-street parking facilities and improvements herein described, including the cost of necessary repairs, replacements, fuel, power, electrical current, care, supervision, and any and all other items necessary for the proper maintenance and operation thereof, shall be assessed, either partly or wholly, upon the real property lying within the district to be benefited by the maintenance and operation of the improvements proposed to be maintained; the amounts so assessed to be levied and collected in the same manner and by the same officers as taxes for county purposes are levied and collected. 2. That the off-street parking facilities and improvements to be so maintained and operated are generally described ~s the real property bounded by E1 Camino Real, Hazelwood Drive, Kenwood Way and Brentwood and the off-street parking improvements located thereon, commonly known as the Brentwood Parking Lot. 3. That the boundaries of the district to be assessed for the maintenance and operation of the improvements to be maintained are described in Exhibit hereto attached and incorporated herein by reference. 4. That the proposed maintenance district is hereby designated by the name "Brentwood Off-Street Parking Maintenance Assessment District". Such district shall hereafter be referred to in all subsequent proceedings, including proceedings for the levy and collection of assessments, by such name. 5. That said district is proposed to be formed and assessments levied pursuant to Chapter 26, commencing with Section 5820, Part 3, Division 7 of the Streets and Highways Code of the State of California. 6. That the City Council declares that all public streets, highways, lanes and alleys within said maintenance assessment district in use in the performance of a public function, and all lands owned by any public entity, including the United States and and State of California, or any departments thereof, shall be omitted from the assessment hereafter to be made to cover the costs and expenses of said maintenance and operation. 7. Robert S. M. Yee, Director of Public Works of the City of South San Francisco, is hereby designated as the person to answer inquiries regarding any protest proceedings to be had herein, and may be contacted during regular office hours at the City Hall, 400 Grand Avenue, South San Francisco, California 94080, or by calling (415) 877-8500. 8. NOTICE IS HEREBY GIVEN that Wednesday, the 15th day of December , 1982, at the hour of 7:30 o'clock_~.m. (Pacific Standard Time) in the Municipal Services Building, Community Room, 33 Arroyo Drive, South San Francisco, California, are hereby fixed as the time and place when and where this Council will consider and finally act upon the question of the formation of said District. At any time not later than the time herein fixed for the hearing of objections, any person permitted by the provisions of the Improvement Act of 1911 to make written protest against the proposed work or against the extent of the district to be assessed therefor, or both, may make like protest and in like manner against the ordering of the formation of the maintenance district or against the extent of the maintenance district, or both. 9. The City Clerk shall cause notice of said hearing to be given by publication of a copy of this Resolution twice in the Enterprise Journal, a newspaper published and circulated in the City of South San Francisco, and by conspicuously posting along all the open streets within said assessment district at not more than three hundred feet apart, and not less than three in all. The first publication shall be made and said posting shall be completed at least ten days before the date herein set for said hearing. Said notices shall be headed "Notice of Proposed Formation of' Brentwood Off-Street Parking Maintenance Assessment District" (in letters of not less than one inch in height on the posted notice) and shall, in legible characters, state and contain: the fact and date of the passage of this Resolution of Intention, the date, hour and place set for and the purpose of the hearing on said resolution and of protests; that any person interested may file a protest in writing as provided in the Improvement Act of 1911; and reference to said resolution for further particulars. 10. Said Clerk shall also cause notice of said hearing to be mailed, postage prepaid, at least ten days before the date herein set for said hearing, as fo 11 ows: a) To all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for city taxes, including the utility roll, at said addresses; b) In cases of transfers of land, or part thereof, subsequent to the date on which the last assessor's roll was prepared, to such transferee, at his name and address, as the same appear on the records in the assessor's office which the assessor will use to prepare the next ensuring assessor's roll; c) To each person, including the owner or person having an interest in property assessed by the state under Section 19 of Article XIII of the California constitution, who has filed with the county assessor for the current fiscal year, a statement of his name, address, and a description of the property owned by him, requesting that a notice of all proposals affecting such property shall be mailed to him (Gov. Code 58905), at said address; and d) To such person at his address or as otherwise known to the Clerk. In case of doubt as to the name and address of any owner, the City Clerk shall cause said notice to be conspicuously posted on the property of such person in the assessment district, at or near the entrance thereto, so that it will be visible to persons on entering, leaving or passing said property. Said notices may consist of copies of this Resolution. I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on this 17th day of November , 1982, by the following vote' AYES' Councilmembers Ronald G.
