HomeMy WebLinkAboutReso 171-1982RESQLUTION NO. 171-82 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ORDERING FORMATION OF A MAINTENANCE ASSESSMENT DISTRICT BRENTWOOD OFF-STREET PARKING MAIN- 'TENANCE' ASSESSMENT' D I STRICT RESOLVED, by the City Council of the City of South San Francisco, County of San Mateo, California, that; WHEREAS, on November 17, 1982., by its Resolution No. 147-82, a Resolution of Intention to Form Maintenance Assessment District and Levy Assessments, this Council declared its intention to order the formation of a maintenance assessment district bearing the descriptive designation of "Brentwood Off-Street Parking Main- tenance Assessment District" (herein "the District") and to levy assessments for the maintenance and operation of the improvements described in said resolution; WHEREAS, Wednesday, December 15, 1982, at the hour of 7:30 o'clock p.m., in the regular meeting place of this Council, Municipal Services Building, Community Room, 33 Arroyo Drive, South San Francisco, California, was duly appointed as the time and place for hearing, on the question of the formation of the District, notice of which hearing was duly and regularly published, posted and mailed; and WHEREAS, at said time and place said hearing was duly and regularly heard and all persons interested desiring to be heard were given an opportunity to be considered by this Council and all written and oral protests or communications were duly heard, considered and Overruled, and this Council thereby acquired jurisdiction to order formation of said District; NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED, as follows: 1. Property owners owning more than fifty percent {50%) of the area of assessable lands within the proposed maintenance assessment district {had) Chad-~J, at the time fixed in the Resolution of Intention for the hearing of objections filed written protests .against the said proposed formation, as a whole or as to any part thereof, or .against the said proposed district to be assessed or to the extent thereof or the costs and expenses of said formation as a whole, or as to any part thereof, or .against the maps.and description, in whole or in part. 2. The public interest, convenience and necessity require that said formation be made. 3. The I~oundaries of the District, as more particularly described in said Resolution of Intention, are hereby approved. 4. The off-street parki.ng facilities and improvemen.ts to be maintained and operated pursuant to said District are generally described as the real property bounded by E1 Camino Real, Hazelwood Drive, Kenwood Way and Brentwood Drive and the off-street parking improvements located thereon, commonly known as the Brentwood Parking Lot, located within the boundaries of the City of South San Francisco, San Mateo County, California. 5. Said District is hereby ordered formed pursuant to the provisions of Chapter 26, commencing with Section 5820, Part 3, Division 7 of the Streets and Highways Code of the State of California. 6. On or before January 1, 1983, the City Clerk of the City of South San Francisco shall file with the County Assessor of the County of San Mateo and the State Board of Equalization of the State of California in Sacramento, California, a statement of creation of the District ordered formed herein, which statement shall contain the following' a. A certified copy of this resolution ordering formation of the District; b. A legal description of the boundaries of said District; c. A map or plat indicati.ng the boundaries of said District; and d. A statement whether or not the affected property will be taxed from any existing bonded indebtedness or contractual obligations. 2. ' 7. Said Clerk shall obtain from said Assessor and Board of Equalization, a certified copy of each of said statements evidencing said filings. 8. This City Council shall, in each year, prior to the time of the fixing of the County tax rate for the County of San Mateo, estimate the cost of main- taining and operating said improvements to be maintained and operated within the District duri.ng the ensuing year. This Council shall decide whether or not the cost of maintaining and operating said improvements shall be borne wholly or partially by the District and shall, in .'addition to all other assessments, fix a special asSessment-rate for the real property within the District, sufficient to raise an amount of money to cover the expense of maintaining and operating said improvements duri.ng the ensuing'year, or such portion of said amount as this City Council shall determine shall be borne by the District and this City Council shall direct the levy of a special assessment tax each year upon the real property in the District sufficient to pay such expense, or a portion thereof, which shall be paid by the District.
