HomeMy WebLinkAboutReso 173-1982 RESOLUTION NO. 173-87 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION LEVYING FEES AND SERVICE CHARGES AND PROVIDING FOR A MASTER FEE SCHEDULE FOR THE CITY OF SOUTH SAN FRANCISCO WHEREAS, the City Council wishes to set certain fees and service charges for certain services provided to the' public; and WHEREAS, Government Code Sections 54990, 54991, 54992 and 54993 provide a procedure for levying of certain fees and service charges by local agencies; and WHEREAS, it is in the public interest to have this City's various fees and service charges properly indexed and published in a single document available to employees and the public; and WHEREAS, the City Council did on December 1, 1982 conduct a properly noticed public hearing at which an opportunity was given to the members of the public to make written or oral presentations on the subject of said fees and services charges; and WHEREAS, at least 10 days prior to said public hearing, this City made available to the public data indicating the amount of cost, or estimated cost, required to provide the service for which the fee or service charge is levied and the revenue sources anticipated to provide the services including general fund revenues; and WHEREAS, the City Council has considered the costs to provide said ser- vices, including estimated costs, and the revenue sources anticipated to provide said services, including general fund revenues; and WHEREAS, the City Council has also considered the public response to said proposed fees and services charges. r: fill [I III NOW THEREFORE, BE IT RESOLVED THAT: 1. Fees and Service Charqes Levied. Effective on the effective date of Ordinance No. 912-82 , there are hereby levied for various services provided to the public by the City of South San Francisco the fees and service charges contained in Exhibit "A" attached hereto and by this reference incorporated herein as though set forth verbatim. 2. Master Fee Schedule Established. Effective on the effective date of Ordinance No. 91~-ge , there is hereby adopted a Master Fee Schedule of the City of South San Francisco which shall consist of the following: (a) Chapter I - Fees and Services Charges set by Resolution of the City Council (Exhibit "A" hereto). (b) Chapter 2 - Fees set by Resolution of the Library Board of Trustees of the City of South San Francisco. (c) Chapter 3 - Fees set by Resolution of the Parking Place Commission of the City of South San Francisco. (d) Chapter 4 - Fees set by Resolution of the Parks and Recreation Commission of the City of South San Francisco. (e) Chapter 5 - An informational listing of certain fees set by Ordinance of the City of South San Francisco. (f) Such other Chapters as may be deemed appropriate by this City Council or the City Manager or his designated representative. Fees and services charges for services provided to the public whether established by Resolution of the City Council or by resolution of the aforementioned Boards and Commission of the City shall be published in the Master Fee Schedule. 3. Repeal of Prior Resolutions. All prior resolutions referring to fees Which are inconsistent with the Master Fee Schedule adopted herein, are hereby repealed, together with any and all amendments to said prior resolutions. 4. Severability. If any sentence, clause, phrase or other portion of this Resolution or of the Master Fee Schedule established hereby is for any reason held to be unconstitutional or invalid, such deCision shall not affect the validity of the remaining portions of this Resolution or of the Master Fee Schedule. The City Council hereby declares that it would have adopted this Resolution and established the Master Fee Scheule and each sentence, clause, phrase or portion thereof, irrespective of the fact that one or more sentences, clauses, phrases or portions thereof be declared unconstitutional or invalid.
