CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION OF AWARD OF CONTRACT
FOR THE SALE OF THE "BURI BURI"
FIRE STATION NO. 3
WHEREAS, pursuant to previous authorization and published notice, bids
were publicly opened, examined and declared on the 21st day of March 1981, for
the sale of the "Buri Buri" Fire Station No. 3.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South
San Francisco that:
1. The City Council does hereby reject all of said proposals or bids
except that hereinafter mentioned', and hereby awards the contract to the highest
responsible bidder, Joe E. Eberle and Adeline Eberle of South San Francisco for
the bid price of One Hundred Thirty Nine Thousand Dollars ($139,000.00).
2. The Mayor of said City is hereby authorized to execute the "Option
to Purchase Agreement" attached hereto as Exhibit "A" and, when the conditions of
the Bid Proposal and the Option to Purchase Agreement have been met, to execute a
Contract of Sale and any deeds or other documents necessary for the sale and convey-
ance of said real property, and the City Clerk of said City is hereby directed to
attest the Mayor's signature and affix thereto the corporate seal of the City.
I hereby certify that the foregoing Resolution was regularly introduced
and adopted by the City Council of the City of South San Francisco at a regular
meeting held on the 6th day of April , 1983, by the following vote:
AYES: Councilmembers Ronald G. Acosta, Mark N. Addie.qo, Emanuele N. Damonte,
Gus Nicolopulos; and Roberta Cerri Teglia

OPTION TO PURCHASE AGREEMENT
· BURI-BURI FIRE STATION
THIS OPTION AGREEMENT, made and entered into this ~2! day of
19 ~_, by and between the City of South San Francisco, hereinafter referred to
as "Optionor" and

hereinafter referred to as "Optionee"
~HEREAS, Optionee has submitted a proposal and bid for option to purchase
real property located at 1165 E1 Camino Real, South San Francisco,California,
in the C-1 Neighborhood Commerical Zone District, and more particularly described
as follows'
"Lots numbered one (1) and two (2) in block numbered-one (1)
as shown upon that certain map entitled' "Rancho Buri-Buri,
South San Francisco," which map was filed in the office of
the county recorder for the county of San Mateo, State of
California, Marcy 22, o946, and recorded in Book 25 of Maps
28, 29 and 30."
(hereinafter referred to as "Buri-Buri Fire Station")
WHEREAS, Otpionor has accepted the .bid of Optionee for purchase of said option
and is willing to enter into this Option Agreement to purchase Buri-Buri Fire
Station.
NOW, THEREFORE'
1. Optioner hereby grants Optionee an option to purchase Burl-Burl Fire
Station.
2. The term of this option shall be 120 days and shall commence on the first
day of the calendar month following the date of execution of this agreement
by Optionor, and terminate on the last day of thel8Odays after execution of
this agreement by Optionor.

3, Ti~is option may not be exercised tlntil the following terms and conditions
have been met'
A. The purchase price of this option is a minimum of $6,000.00
~.~hich sh~ll be paid to Optionor in full upon submittal of the
bid' for this option to purchase.
B.Use permit must be obtained by optionee before.option is
exercised to purchase the Buri-Buri Fire Station.

C. This option is non-assignable and any attempted assignment
hereof by Optionee is void and shall cause this agreement
automatically to terminate without notice.
D. In event this option is not exercised within the time herein
specified and use permit not obtained, one half the option
price shall be for'feited by the Optionee and shall be retained
by Optionor as legal damages for the granting of this option.
4. All notices and communications required under this option shall be in
writing and all notic.es and payments shall be made as follows-

5. Upon satisfactory performance by Optionee of the requirements of this
agreement and upon exercise by Optionee of this option in the manner herein
pro¥ided, Optionor shall forthwith execute escrow agreement i:or purchase
of Buri-Buri Fire Station for the sum'of $

Failure of Optionee to meet the terms and conditions of this agreement,
fully and satisfactorily, within the time limits stated, shall absolutely
and conclusively terminate Optionee's rights hereunder.
The Optionee understands that sale of the "Buri Buri" Fire Station
is "as is" condition and no warranty is herein given, expressed, or
implied as to the condition of the building or structure, or the
mechanical equipment or appliances therein, or the Services thereto.
