HomeMy WebLinkAboutReso 99-1983 RESOLUTION NO. 99-83 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION OF INTENTION TO VACATE A STREET RIGHT-OF-WAY LOCATED SOUTHWEST OF HILLSIDE/CHESTNUT INTERSECTION (LANDS OF MANTEGANI) BE IT RESOLVED by the City Council of the City of South San Fracisco as follows: 1. Notice is hereby given that Wednesday , the 17th day of August 1983, at 7:30 pm., which time is not less than fifteen (15) days from the date of passage of this Resolution, in the Community Room of the Municipal Services Building, 33 Arroyo Drive, South San Francisco, California, is hereby fixed as the time and place when and where all persons interested in, or having objections to, the proposed vacation of a street right-of-way located southwest of the Hillside/Chestnut intersection as hereinafter described, may appear before said Council and be heard. 2. A copy of this Resolution shall be published for at least two (2) successive weeks prior to the hearing date in the Enterprise-Journal, a news- paper of general circulation printed and published in said City in the manner prescribed by law for publishing ordinances in said City. 3. Notices of the vacation, statin§ the passage of the Resolution of Intention and the time and place of hearing shall be posted conspicuously along the line of the street, or part t~ereof, proposed to be vacated at least two (2) weeks before the date set for the hearing and not less than three (3) notices shall be posted. 4. The public interest and convenience require, and it is the intention of this Council to vacate a street right-of-way located southwest of the Hillside/Chestnut intersection as shown on the map entitled "Surplus City Property - Southwest of Hillside/ Chestnut Intersection" which is on file in the office of the City Clerk, and which is more particularly described in Exhibit "A" attached hereto and by this reference incorporated herein as though set forth verbatim. 5. The public interest, convenience and necessity require the reserva- tion of a Public Services Easement including, but not limited to, storm drains, telephone conduits and overhead power lines throughout the entire area to be vacated which is more particularly described in Exhibit "A" previously incorp- orated herein, and the vacation proceedings are taken subject to such reservation. The City Council does hereby reserve and except from such prceedings said Public Services Easement throughout the entire area described in Exhibit "A." 6. This vacation proceeding is conducted pursuant to Chapter 3 of the Public Streets, Highways and Service Easements Vacation Law (commencing with Section 8300 of the Streets and Highways Code. ) I certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at an adj. regular meeting held on the27th day of July , 19 83 , by the following vote' AYES' NOES' ABSENT' Councilmembers Ronald G. Damonte and Gus Nicolopulos ATTEST' City Clerk RESOLUTION NO. 99-83 EXHIBIT "A" PARCEL I Beginning at a point on the southwesterly line of Hillside Boulevard, said point being the most northerly corner of that certain 5.277 acre tract of land described in the Deed to Giovanni Mantegani and Caroline Mantegani, his wife, recorded February 20, 1948, in Volume 1452 of Official Records, at Page 227, Records of San Mateo County; thence from said point of beginning, and along the northeasterly line of said tract, south 55o 37'50" east 394.90 feet to a granite monument designated as "L-5" on the "Map of Survey Made for P.E. Iler," recorded March 10, 1891, in Volume E of Maps at Page 79, Records of San Mateo County, said monument being the most easterly corner of said tract; thence along the southeasterly line of said tract, south 370 38'40" west 10.02 feet to a 2" iron pipe monument located on the most northerly corner of Lot 28 as said l'ot is shown on the Map of "Hillside Estates," recorded April 8, 1981, in Volume 105 of Subdivision Maps at Pages 4 and 5, Records of San Mateo County; thence leaving the last mentioned line, north 55o 37'50" west 394.90 feet to the northwe~sterly line of said 5.277 acre tract; thence along said northwesterly line, north 37o 38'40" east 10.02 feet to the Point of Beginning. Containing 0.091 acres, more or less. Iler," recorded March 10, 1891, in Volume E of Maps at Page 79, Records of San Mateo County; thence south 84o 28'40" east 75.83 feet to a point on the northwesterly line of Lot 29, as shown on the map of "Hillside Estates," thence south 40o 06'18" west 10.55 feet to a 2 inch iron pipe monument, as shown on said map, located at an angle point of Lot 29; thence south 85o 06'18" west 30.00 feet to another 2 inch iron pipe monument as shown on said map, located at an angle point of Lot 29; thence north 77o 27'18" west 46.01 feet to the Point of Beginning.
