HomeMy WebLinkAboutReso 113-1983RESOLUTION N0.113-83 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION INITIATING PROCEEDINGS FOR THE ANNEXATION OF A PORTION OF SAN BRUNO MOUNTAIN (SOUTH SLOPE AREA) (203.23_+ ACRES) PURSUANT TO THE MUNICIPAL ORGANIZATION ACT OF 1977 (COMMENCING WITH SECTION 35000 OF THE GOVERN- MENT CODE) WHEREAS, the Local Agency Formation Commission of the County of San Mateo (LAFCO) adopted its Resolution No. 681 on August 17, 1983, making determinations and approving the proposed annexation to the City of South San Francisco of the territory described in Exhibits "A" and "B" attached hereto and by this reference incorporated herein (the Property); and WHEREAS, preliminary proceedings regarding said annexation were commenced upon the written request of Sherman Eubanks, William Dean and Robert Eppler (Chief Petitioners); and WHEREAS, the Petition requesting annexation of the Property was signed by the owners of 100% of the Property to be annexed; and WHEREAS, the distinctive short form designation assigned by LAFCO to the territory to be annexed is "83-1 -- Annexation to the City of South San Francisco of a portion of San Bruno Mountain designated as the South Slope Area and a portion of Hillside Boulevard to be developed as the Terrabay Project;" and WHEREAS, the area to be annexed consists of 203.23~ acres; and WHEREAS, LAFCO has determined that the territory proposed to be annexed is uninhabited; and WHEREAS, annexation by the City of SoUth San Francisco may be undertaken without an election. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that: 1. NOTICE IS HEREBY GIVEN that Wednesday, the 21st day of September, 1983 at 7:30 p.m., which time is not less than thirty (30) nor more than forty-five (45) days from the date of adoption of this Resolution, in the Community Room of the Municipal Services Building, 33 Arroyo Drive, South San Francisco, Calif- ornia, is fixed as the time and place at which the City Council will conduct a Public Hearing wherein all persons interested in, or having objections to the proposed annexation designated as "83-1 -- Annexation to the City of South San Franicsco of a portion of San Bruno Mountain designated as the South Slope and a portion of Hillside Boulevard to be developed as the Terrabay Project," as further described in Exhibits "A" and "B" hereto, previously incorporated herein by reference, may appear before said Council and be heard. 2. A copy of this Resolution shall be published once at least fifteen (15) days prior to the hearing date in the Enterprise-Journal, a newspaper of general circulation printed and published in said City in the manner prescribed by law for publishing Ordinances in said City. 3. A copy of this Resolution shall be mailed at least fifteen (15) days prior to the hearing to: (a) Any person who has filed his name and address with the City Clerk and has requested such mailed notice; and (b) The Chief Petitioners as indicated in the Petition initiating proceedings to annex the Property; and (c) The Clerks of the County of San Mateo, South San Francisco Unified School District, San Mateo Junior College District, Bay Area Air Pollution Control District, Colma Creek Flood Control District, San Mateo County Harbor District, Brisbane Elementary School District and Jefferson Union High School District, respectively; and (d) To the Executive Officer of the Local Agency Formation Commission of the County of San Ma teo. 4. A copy of this Resolution shall be posted at least fifteen (15) days prior to the hearing date, on or near the doors Of the meeting ~oo~m'~o'f the City Council and upon any official bulletin board located in City~buildings customarily used for the purpose of posting Public Notices by or pertaining to the City Council. 5. AnY owner of land within the boundary of the Property as set forth in Exhibits "A" and "B" hereto may file a written protest against the annexation v~i~i~ the City Clerk at any time prior to the conclusion of the City's hearing on the proposed annextion. 6. This annexation proceeding is conducted pursuant to the Municipal Organization Act of 1977 (commencing with Section 35000 of the Government Code).
