HomeMy WebLinkAboutReso 115-1983 RESOLUTION NO. 115-83 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ORDERING THE VACATION OF A STREET RIGHT-OF-WAY LOCATED SOUTHWEST OF HILLSIDE/CHESTNUT INTERSECTION (LANDS OF MANTEGANI) BE IT RESOLVED by the City Council of the City of South San Francisco as fol 1 ows: 1. The City Council on the 27th day of July . 19 83 . adopted Resolution No. 99-83 , entitled "A Resolution of Intention to Vacate a Street Right-of-Way Located Southwest of Hillside/Chestnut Intersection (Lands of Mantegani), which Resolution recited that the proceedings were undertaken pursuant to the Street Vacation Act of 1951 (commencing with Section 8300 of the Streets and Highways Code) and which Resolution of Intention was duly published as required by law, and notices of hearing were duly posted in the time, manner and form' provided by law, all as appears from the affidavit of publication and the affi- davit of posting on file in the office of the City Clerk of said'City. 2. Wednesda~v , the 17th day of Auqust , 1983 at the.hour of 7:30 p.m. in the Community Room of the Municipal Services Building, 33 Arroyo Drive, South San Francisco, California, was fixed in said Resolution of Intention as the time and place when and where any and all persons interested in, or having any objections to, said proposed vacation, were to appear before said Council and be heard. 3. No objections of any kind or character have been or were made or filed against vacation. 4. The City Council finds that the street right-of-way which is described in said Resolution of Intention and which is more particularly described in Exhibit "A" attached hereto and by this reference incorporated herein as though set forth verbatim, is unnecessary for present or prospective public use except for the reservation of a Public Services Easement as defined in Section 8306 of the Streets and Highways Code including, but not limited to, an easement for storm drains, telephone conduits and overhead power lines located throughout the entire area of the street right-of-way to be vacated. 5. The street right-of-way is hereby ordered vacated except for the reservation of a Public Services Easement as defined in Section 8306 of the Streets and Highways Code including, but not limited to, an easement for storm drains, telephone conduits and overhead power lines throughout the entire area of the street right-of-way as described in Exhibit "A." 6. The City Clerk shall cause a certified copy of this Resolution and order, attested under the seal, of the City, to be recorded in the office of the Recorder of the County of San Mateo. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at aregular meeting held on the 17thday of August , 1983, by the following vote: AYES: Councilmembers Ronald G. Acosta, Mark N. Addiego; and Gus Nicolopulos NOES: None ABSENT: Councilmembers Emanuele N. Damonte and Roberta Cerri Teglia EXHIBIT "A" TO RESOLUTION NO. 115-83 PARCEL I Beginning at a point on the southwesterly line of Hillside Boulevard, said point being the most northerly corner of that' certain 5.277 acre tract of land described in the Deed to Giovanni Mantegani and Caroline' Mantegani, his wife, recorded February 20, 1948, in Volume 1452 of Official Records, at Page 227, Records of San Mateo County; thence from said point of beginning, and along the northeasterly line of said tract, south 55o 37'50" east 394.90 feet to a granite monument designated as "L-5" on the "Map of Survey Made for P.E. Iler," recorded March lO, 1891, in Volume E of Maps at Page 79, Records of San Mateo County, said monument being the most easterly corner of said tract; thence along the southeasterly line of said tract, south 37o 38'40" west 10.02 feet to a 2" iron pipe monument located on the most northerly corner of Lot 28 as said l'ot is shown on the Map of "Hillside Estates," recorded April 8, 1981, in Volume 105 of Subdivision Maps at Pages 4 and 5, Records of San Mateo County; thence leaving the last mentioned line, north 55o 37'50" west 394.90 feet to the northwesterly line of said 5.277 acre tract; thence along said northwesterly line, north 37o 38'40" east 10.02 feet to the Point of Beginning. Containing 0.091 acres, more or less. Iler," recorded March 10, 1891, in Volume E of Maps at Page 79, Records~of San Mateo County; thence south 84° 28'40" east 75.83 feet to a point on the northwesterly line of Lot 29, as shown on the map of "Hillside Estates," thence south 40o 06'18" west 10.55 feet to a 2 inch iron pipe monument, as shown on said map, located at an angle point of Lot 29; thence south 85o 06'18" west 30.00 feet to another 2 inch iron pipe monument as shown on said map, located at an angle point of Lot 29; thence north 77° 27'18" west 46.01 feet to the Point of Beginning.
