A RESOLUTION AUTHORIZING EXECUTION OF
AN AGREEMENT BETWEEN THE COUNTY OF SAN
MATEO AND THE CITY OF SOUTH SAN FRANCISCO
(PARAMEDIC AGREEMENT)
BE IT RESOLVED by the City Council of the City of South San Francisco
that:
1. Execution.
Execution of an Agreement between the County of San Mateo and the City
of South San Francisco to provide for a Program utilizing mobile intensive care
paramedics pursuant to Senate Bill 125 (California State Senate, Statutes of
1980) is hereby authorized, and a copy of said Agreement is attached hereto as
Exhibit "A".
2. Signatures.
The Mayor is authorized to execute said Agreement on behalf of the
City and the City Clerk attest his signature thereto.
I hereby certify that the foregoing Resolution was regularly introduced and
adopted by the City Council of the City of South San Francisco at a regular
meeting held on the 19th day of October , 1983, by the following vote:

FOR THE PROVISION OF A PROGRAM UTILIZING
MOBILE INTENSIVE CARE PARAMEDICS PURSUANT TO
SB125 (STATUTES OF 1980)

THIS AGREEMENT, made and entered into as of this ~-0~
day of ~&~ ~1983, by and between the COUNTY OF SAN MATEO,
a political sub-division of the State of California, hereinafter
called "County"; and the CITY OF SOUTH SAN FRANCISCO, a municipal
corporation, hereinafter called "Contractor".
W I T N E S S E T H:
WHEREAS, Statutes of the State of California provides that
any county may conduct a program which provides services utiliz-
ing Mobile Intensive Care Paramedics for the delivery of emer-
gency medical care to the sick and injured at the scene of an
emergency, during transport to a general acute care hospital
until care responsibility is assumed by the regular staff of the
general acute care hospital, and during training within the
facilities of a participating general acute care hospital which
has the approval of the County Health Officer or his designee to
participate in the program and
WHEREAS, County desires that Contractor participate in such
paramedic program; and
NOW, THEREFORE, AND IN CONSIDERATION OF THE FOREGOIN~
PREMISES' AND THE MUTUAL COVENANTS HEREIN CONTAINED, IT IS AGREED
AS FOLLOWS:

1. DEFINITIONS
. A. Advanced Life ~uPDort (ALS): Medical care provided to
critical care patients by Paramedics.
B. Alternate General Acute Care Hospital: "Alternate
General Acute Care Hospital" means an accredited general acute
care hospital.
C. Basic Life SuPDor.t (BLS): Basic medical care and

elementary care.
D. County Health Officer: "County Health Officer" means
the duly appointed and acting Health Officer of the County of San
Mateo or his designee.
E. Emerqenc¥ Department: "Emergency Department" means
any department or separate area within a general acute care
hospital which is staffed and equipped to provide emergency
medical care to the sick or injured on a continuous 24-hour
basis.
F. Base HosDital: "Base Hospital" means the designated
Hospital for paramedic/MICN communication.
G. Mobile Intensive Care Paramedic: "Mobile Intensive
Care Paramedic" (hereinafter designated as "Paramedic") means a
person who has been certified as a Mobile Intensive Care Para-
medic by the County Health Officer of the County of San Mateo.
H. Mobile Intensive Care Unit: "Mobile Intensive Care
Unit" (hereinafter designated as "Unit") means the emergency
vehicle staffed by two certified Mobile Intensive Care Paramedics
and all necessary equipment to provide basic and advanced life
support care to the sick or injured at the scene of medical

emergencies or.during transport to a general acute care hospital
subject to guidance, instruction and communication from the Base
Hospital within the language and intent of the Paramedic Act and
the terms of the Agreement.
I. Paramedic Act: "Paramedic Act" means Emergency
Medical Services System and the pre-hospital Emergency Medical
Care Personnel Act, Division 2.5 of the ~ealth and Safety Code,
Section 1797 et seq.
J. Medical Supplies: "Medical Supplies" means those
drugs, solutions, equipment, and adjuncts used for patient treat-
ment upon direct order of a physician or Mobile Intensive Care
Nurses enumerated in SB125 (Statutes of 1980).
K. "Transportation Areas": The geographical area of the
City and County of San Francisco that includes hospitals which
are designated as receiving hospitals, and that area of San Mateo
County, bounded by the County limits to the east, west, and
north, and Chope Hospital to the south, with Chope Hospital being
included within the transportation area.
2. PROGRAM: SCOPE: UNIT PERSONNEL AND OPERATIONS: UNIT
EMERGENCY SERVICES TRANSPORTATION: HOSPITAL EMERGENCY SERVICE:
A. General Operation: Contractor agrees to conduct a
paramedic program in accordance with the practices and procedures
established by the County Health Officer or his designee, and
will adhere to said practices and procedures in performance of
the responsibilities assumed pursuant to this contract. Con-
tractor shall provide paramedics who will, within the unit
service areas, specified in paragraph 3B below: (1) Deliver

emergency medical care to the sick and injured at the scene of an
r- _ · emergency; (2) Deliver emergency medical care to the sick and
injured during transport to the hospital or alternate general
acute care hospital when delivery of said care during transport
is required by the condition of the sick or injured person; (3)
Follow communication standards as jointly agreed to by County and
Contractor; (4) Deliver emergency medical care to the sick or
injured while in the emergency'department of hospital or alter-
nate general acute care hospital until care responsibility is
assumed by the regular staff of the hospital or alternate general
acute care hospital; (5) Deliver emergency medical care to the
sick and injured during training within the facility of the spon-
soring hospital or alternate general acute care hOspital.
3. SERVICES
A. Transportation: With respect to all patients re-
quiring either advanced life support services (ALS) or basic life
support (BLS) services, Contractor shall provide medical treat-
ment at the scene, as well as transportation to the appropriate
hospital as determined by the Base Hospital. Transportation will
not be provided if (a) it is determined by the paramedics that
such transportation is not necessary; (b) the patient refuses
such transportation or (c) transportation is requested to a
hospital located outside the transportation area. In the event
that the patient requests transportation to a hospital outside
the transportation area, Contractor will transfer said patient to
a County unit. If after receiving medical care at the scene of

an emergency, a patient refuses transport, the patient shall be

requested to execute a form indicating that he or she refuses

further treatment. In the event patient refuses to execute said
waiver, the patient's refusal to sign shall be witnessed and
documented by two (2) ambulance personnel. For any patient not
transported by Contractor, transportation of such patient to the
appropriate hospital will be provided by County, who will respond
to calls within fifteen (15) minutes in eighty percent (80%) of
all calls. With respect to both BLS and ALS cases, County shall
provide all required services if the Contractor's unit is una-
vailable (hereinafter called Backup Services). To initiate such
services by the County, Contractor shall call County
Communications.
B. Unit Service Areas: The service area for delivery of
both BLS and ALS emergency medical care to the sick and injured
at the scene of an emergency shall be the City of South San
Francisco, specifically Census Tract 6017-6026, except that pro-
visions of services to patients from freeways in the Census Tract
6017-6026 will be limited to the following areas: Southbound 101
from Linden Avenue at Airport Boulevard to San Bruno Avenue
including the San Bruno Avenue off ramp and westbound 380 to the
E1 Camino, Southbound 280 from Westborough Boulevard to San Bruno
Avenue and northbound 280 from Westborough Boulevard to Hickey
Boulevard.
In addition, Contractor shall provide services in
Census Tract 6001, Brisbane, except that services in Census Tract
6001 will be limited to those occasions when County Units 11, 12
and 13 are out of service, which shall be determined by County

Communications. Contractor shall not respond to any emergency
call outside of its area(s) of responsibility under this Agree-
ment unless specifically requested by County Communications or
unless specifically set forth in mutual aid agreements.
C. Fees for Service: In all cases where Contractor is
called upon to provide backup Paramedic services, or in cases of
response to County areas, the rates which Contractor charges
shall be at the County's prevailing Paramedic ambulance rates.
When back-up is provided to the City of South San
Francisco by another County contractor, charges for paramedic
service shall be at the same rate as South San Francisco Fire
Department rates.
D. Communication: When County receives a call for
emergency medical service within the service area of this
Agreement from other than Contractor itself, it shall notify
Contractor by calling South San Francisco Fire Communication.
Contractor shall provide such services in accordance with this
Agreement.
Contractor shall be responsible for the provision of
emergency medical services within the service area in all cases,
unless and until County has been notified by Contractor to pro-
vide backup services.
E. Equipment: Throughout the life of this Agreement,
Contractor shall provide and maintain in good order the types and
quantities of equipment specified in this section. It is further
understood that any and all equipment, and permits for this use,
will be provided by Contractor at its expense. Contractor shall:

1. Furnish and equip ambulances as required by San
Mateo County and California Highway Patrol.
2. Equip all ambulances with such other equipment and
supplies as may be prescribed by County's Director of ~ealth
Services or his authorized agents, who may require other items in
addition to the foregoing or in lieu thereof, subject to the
appropriation of funds within a reasonable time.
3.. Operate and maintain all ambulances and equipment
in a manner which will not endanger lives or' property and in
accordance with all state, federal, and local laws and ordi-
nances; and policies, regulations, and resolutions consistent
with the Agreement.
F. Personnel: Throughout the life of this Agreement,
Contractor shall employ Paramedics who meet or exceed the re-
quirements specified in this section. Contractor shall:
1. Staff each ambulance with at least one (1) driver
and one (1) attendant, both of whom shall be at least eighteen
(18) years old, neat, well-groomed and clean, of good moral
character, and physically and mentally capable of performing the
duties required of them.
2. Staff each ambulance with personnel who meet or
exceed the following requirements:
a. All ambulance personnel shall have success-
fully completed a course of instruction in closed-chest cardio-
pulmonary resuscitation adhering to the standards Of the American
Heart Association, local chapter thereof, or the American Red

Cross, local chapter thereof. Further, all ambulance personnel
shall carry on their person a current certificate of completion
of such training.
b. All ambulance drivers and attendants shall be
currently certified by the San Mateo County Health Officer as
Paramedics and shall carry on their person current proof of such
certification.
3. Ensure that all ambulance personnel successfully
complete not less than the minimum hours of refresher training
required by the policies set by the Director of Health Services,
or his designee. All such training shall be approved in advance
by County's Director of Realth Services or his designee.
4. Contractor shall designate an individual to be
responsible for compliance with this Agreement and for
communications with the County.
4. PRACTICES AND PROCEDURES:
County shall:
(a) Establish practices and procedures for use in the
Paramedic Program to assure liaison with Base Hospital staff,
Paramedics, training institutions, and alternate general acute
care hospitals.
(b) Establish practices and procedures for the pre-
hospital emergency care to assure uniform county-wide standards
for emergency medical care.
(c) Review the function and results of the Paramedic
Units including, but not limited to, quality of medical care
provided.

(d) Establish practices and procedures to assure the
quality of Paramedic continuing education.
(e) Review the medical supplies used by the Paramedic
Units and make recommendations for additions, deletions or
modifications.
(f) If transportation is desired beyond transportation
area, the patient will be transferred to another County Paramedic
Contractor.
5. COUNTY ANNUAL REPORT:
Contractor shall cooperate with the County by providing
reasonably necessary reports, data and information, and permit-
ting surveys of Paramedic facilities necessary to assist County
in compiling and making such annual reports to the Legislature
and to the State Department of Health as required by Health and
Safety Code, Section 1797.0 et seq.
6. RESPONSIBILITY OF THE PARTIES:
A. It is understood and agreed that neither County nor
any officer, agent or employeelthereof, shall be responsible for
any damage or liability incurred by reason of anything done or
omitted to be done by any officer, agent, or employee of Con-
tractor in connection with performance of this Agreement.
B. It is understood and agreed that neither Contractor
nor any officer, agent or employee thereof, shall be responsible
for any damage or liability incurred by reason of anything done
or omitted to be done by County and its officers, agents and
employees, in connection with performance of this Agreement.

C. In the event of concurrent negligence of Contractor,
its officers and/or employees, and County, its officers and/or
employees then the liability for any and all claims for injuries
or damages to persons and/or property which arise out of the
terms and conditions of this Agreement, shall be apportioned
under the California theory of comparative negligence'as
established presently, or as may be hereafter modified.
7. SERVICES TO COMPLY WITH APPLICABLE LAWS:
All services provided pursuant to this Agreement shall be
in strict compliance with existing State, Federal, and local
laws, ordinances, and regulations, and with all resolutions,
practices and procedures approved by the County Health Officer,
applicable to such services.
8. CONTRACTOR EMPLOYER OF PARAMEDIC:
It is agreed and understood by County and Contractor that
the Paramedics are the employees of Contractor and not the
employees of County and, as such, Paramedics are not entitled to
any compensation or employee benefits afforded to employees of
County.
9. NOTICES:
All notices, demands or other writings to be given, made
or sent under this Agreement, or which may be so given or made or
sent to any party hereto to the other, shall be deemed to have
been duly given or made or sent when made in writing and
deposited in the United States Mail, registered and postage
prepaid, and addressed to the respective parties as follows:

The address to which any notice, demand or other writing
may be given or made or sent to any party may be changed upon
written notice given by such party as above provided.
10. TERM OF AGREEMENT:
The term of this Agreement shall be from the first day of
March 1983 through the thirtieth day of June, 1985. Either party
may terminate this Agreement by giving thirty (30) days' written
- notice to the other party.
IN WITNESS WHEREOF, the parties hereto, first being duly
authorized, have executed this Agreement as of the date and year
first above written.

RESOLVED, by the Board of Supervisors of the County of San
Mateo, 'State of California, that
WHEREAS, ther& has been presented to this Board of Super-
visors for its consideration and acceptance an agreement, refer-
ence to which is .hereby made for further particulars, whereby the
City of South San Francisco Fire Department agrees to provide
Advanced Life Support Services within the City of South San
Francisco; and
WHEREAS, this Board has been presented with a form of such
Agreement and said Board has examined and approved same as to
both form and content and desires to enter into same:
NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the
Chairman of this Board of Supervisors be, and he is hereby
authorized and directed to execute said Agreement for and on
behalf of the ~ounty of San Mateo, and the Clerk of this Board
shall attest his signature thereto.
