HomeMy WebLinkAboutReso 173-1983RESOLUTION NO. 173-83 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING EXECUTION OF A FREEWAY AGREEMENT WITH STATE DEPART- MENT OF TRANSPORTATION that: BE IT RESOLVED by the City Council of the City of South San Francisco 1. E__xecution of Agreement. Execution of an Agreement entitled "Freeway Agreement" by and between the State of California, acting by and through the Department of Transportation, and the City of South San Francisco is hereby authorized, and a copy of said Agreement is attached hereto as Exhibit "A." 2. Signatures. The Mayor is authorized to execute said Agreement on behalf of the City, and the City Clerk attest his signature thereto. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at an adj. regular meeting held on the 14th day of December , 19 83 , by the following vote: AYES' Councilmembers Mark N. Co. railroad separation. FREEWAY AGREEMENT , THE AGREEMENT, made and entered into on this /~/~ day of Z~Cgz~/~ , 19_~_, by and between the STATE OF CALIFORNIA, acting by and through the Department of Transportation (herein referred to as "STATE"), and the City of South San Francisco (herein referred to as "CITY"), WI TNESSETH: WHEREAS, the highway described above has been declared to be a freeway by Hesolutions of the California Highway Commission on July. 25, 1941, and January 17, 1946; and WHEi{EAS,-STATE and CITY have entered into a Freeway Agreement _dated April 15, 1946, relating to that portion of State Highway Route 101 from the north city limits to the south city limits; and WHEREAS, a revised plan map for such freeway has been prepared showing the proposed plan of the STATE as it afffects streets of the CITY; and WHEREAS, it is the mutual desire of the parties hereto to enter into a new Freeway Agreement in accordance with the revised plan of said freeway; -2- NOW, THER~ORE, IT IS AGREED: 1. This Agreement supersedes that portion of said Freeway ~ Agr.eement dated April 15, 1946, from South San Francisco Belt Railroad' to the north city limits. · 2. CITY agrees and consents to the closing of City streets, relocatiOn of City streets, construction of frontage roads and other local roads, and other construction affecting City streets, all as shown on said plan map attached hereto marked Exhibit A and made a part hereof by this reference. 3. STATE shall, in construction of the freeway and at STATE's expense, make such changes affecting City streets in accordance with Exhibit A, except that at the East Grand Avenue Interchange, the modification of the pedestrian overcrossing located appro×imately .1,000 i~eet northerly of East Grand Avenue, and the southbound auxiliary lane between the Linden Avenue on-ramp and the Miller Avenue off-ramp, the construction cost shall be borne by the CITY. The segment of the northbound off-ramp to Marina Boulevard located within CITY which ramp does not affect any of CITY's streets nor involves any cost to CITY has been shown on Exhibit A for information purposes only. 4. STATE agrees to acquire all necessary right-of-way as may be required for construction, reconstruction, or alteration of City streets, Z'rontage roads, and other local roads, and CITY hereby authorizes STATE to acquire in its behalf all such necessary right-of-way, except that the cost of right-of-way required to construct East Grand Avenue interchange shall be borne by the CITY. -3- 5. It is understood between tt~e parties that the right-of-way may be acquired in sections or units, and that both as to the *acquisition of right-of-way and the construction of the freeway projects, the obligations of STATE hereunder shall be carried out at such time and for such unit or units or the project as funds are budgeted and made lawfully available for such expenditures. 6. CITY will accept control and maintenance over each of the relocated or reconstructed City 'streets, and the frontage roads, and other STATE constructed local roads on receipt of written notice to CITY from STATE that the work thereon has been completed except foi' any portion which is adopted by STATE as a part of the freeway proper. ....... CITY will also accept title to the portions of such roads lying outside the freeway limits, upon relinquishment by STATE. 7. This Agreement may be modified at any time by the mutual consent o£ the parties hereto, as may become necessary for the best accomplishment, through STATE and CITY cooperation, of the whole freeway project for the benefit of the people of the STATE and of the CITY.
