HomeMy WebLinkAboutReso 18-1984RESOLUTION N©. ]8-84 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING UNIT DETERMINATIONS. AND MODIFICATION AS MADE BY THE CITY MANAGER PURSUANT TO MUNICIPAL CODE CHAPTER 3.08 AND CONTINUING RECOGNITION OF. AFFECTED EMPLOYEE ORGANIZATION REPRESENTING THE MAJORITY OF AFFECTED EMPLOYEES BE IT RESOLVED by the City Council of the City of South San Francisco that: WHEREAS, the Municipal Employee Relations Officer received twelve (12) requests from employees in classifications included in Field and Office Employees Unit #3 on December 16, 1983 to have their classifications included in a more appropriate unit; and WHEREAS, the representative of the Municipal Employee Relations Officer reviewed the requests with official of the employee organiza- tion which had been declared in City Council Resolution 135-79 on December 5, 1979 as the majority representative employee organization for employees included in Unit #3 subsequent to a representation election wherein ninety-seven percent (97%) of the employees in Unit #3 Field and Office voted in favor of American Federation of State, County and Municipal Employees, Local 1569, AFL-CIO as the majority representative organization; and WHEREAS, the representative of the Municipal Employee Relations Officer has reviewed the composition of the Field and Office Employees Unit #3 and the history of the establishment of the Unit; and WHEREAS, the representative of the Municipal Employee Relations Officer has found that the existing Unit consists of two separate groups of employees with a community of interest within each group but no community of interest between the two groups: Crafts and Maintenance employees being one group and Professional, Technical and -1- O~fice employees being another group; and WHEREAS, the representative of the Municipal Employee Relations Officer has also found that the history of the existing Unit #3 is such that each of the two separate groups were included in separate representation units prior to 1979; and WHEREAS, the representative of the Municipal Employee Relations Officer finds that the efficient operations of the City and sound employee relations is accomplished by modifying Unit #3 to exclude professional, technical and office employees and to include only crafts and maintenance.employees; and WHEREAS, the similarity of skills, working conditions, job duties and educational requirements for professional, technical and office employees are such that a more appropriate representation unit, Professional, Technical and Office Unit #9, shall be established; and WHEREAS, the representative of the Municipal Employee Relations Officer, by notice entitled "Notice of Unit DeterminationS-and Modification for ConSultation with Employee Organizations and Transmittal to the City Council in Accordance with South San Francisco Municipal Code Chapter 3.08 Section 3.08.100" dated February 3, 1984 notified the affected employee organization, American Federation of State, County and Municipal Employees, Local 1569, AFL-CIO and all employee organiza- tions recognized as representing a majority of employees in a represen- tation unit of City employees of the Municipal Employee Relations Officer's representative's determination of employee representation unit designations and composition of said units; and WHEREAS, the representative of the Municipal Employee Relations Officer did further invite conferences and consulted with employee organizations the period of time commencing with receipt of said -2- . notice, to and including February 15, 1984, and did further advise the employee organizations that the Municipal Employee Relations Officer's representative would transmit findings, ~recommendations and unit determinations to the City Council for Council's approDriate action on February 15, 1984, a copy of which notice is on file in the offices of the City Manager and the City Clerk; and WHEREAS, the representative of the Municipal Employee Relations Officer caused notices to be poSted at all work locations of employees affected by the unit determinations of the representative fori~'the period February 9, 1984 through February 15, 1984; and WHERAS, the proper notices have been made to all affected employees and employee organizations and the representative of the Employee Relations Officer has transmitted findings, recommendations and the units determined to be appropriate to the City Council, which have been duly considered by the City Council; NOW THEREFORE, IT IS ORDERED THAT: 1. The City Council does hereby designate the units determined by the representative of the Municipal Employee Relations Officer, which are attached hereto as "Exhibit "A" and incorporated herein by this reference as if set forth verbatim, as appropriate units for the purposes of.representation as~modified and as established; and 2. The City Council d°es hereby continue to recognize the American Federation of State, County and Municipal Employees, Local 1569, AFL-CIO as the majority representative, employee organization for Crafts and Maintenance Unit ~3 and as the majority representative employee organization for employees in classifications included in Professional, Technical and Office Unit #9, as originally declared for the same employees on December 5, 1979 in City Council Resolution 135-79. --3-- I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at an adjourned re§u]ar meeting held on the ]5th day of February , 19. 84 , by the following vote: AYES: Councilmembers Mark N.
