IUNICIPAL EMPLOYEES, LOCAL 1569, AFL-CIO FOR THE PERIOD JANUARY 1, 1984 THROUGH JUNE 30, 1985 WHEREAS, the City of South San Francisco City Council has recognized the American Federation of State, County and Municipal Employees, Local 1569, AFL-CIO as the majority representative employee organization of those employees working in classifications in ..representation Units #3 and #9; and' ~HEREAS, the representative of the City and the representatives of AFSCME Local 1569 have personally met and conferred and freelY exchanged information, opinions and proposals; and WHEREAS, the representative of the City and the representatives of AFSCME Local 1569 have reached agreement on those wages, hours and conditions of employment which are to be in effect during the period through January 1, 1984 through June 30, 1985 for employees in representation Units #3 and #9;..and WHEREAS, the representative of the City and the representatives of AFSCME Local 1569 have jointly prepared a Memorandum of Understanding; and WHEREAS, the Memorandum of Understanding has been accepted by the member- ship of AFSCME Local 1569; and WHEREAS, the City's representative recommends that the Memorandum of Understanding be accepted and approved by the City Council; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco hereby accepts and approves the Memorandum of Understanding which is attached hereto as Exhibit "A" and incorporated herein by this reference as if set forth verbatim between the City of South San Francisco and the American Federation of State, County and Municipal Employees, Local 1569, AFL-CIO, which sets forth those wages, hours and conditions of employment to be in effect during the period January 1, 1984 through June 30, 1985 for employees working in classifications in representation Units #3 and #9 and which Memorandum of Understanding shall be binding upon the City, upon AFSCME and upon the employees covered therein. Employee Failure to. City, Upon receipt of notice from the Union, the City shall provide written not~e to the employee of the requirements of subsection 2 and shall provide the employee wi~Jh' ten (10) calendar days within which the employee shall either comply-or be~ter~)nated from his or her position in his or her classification. I£ an employee subsequen~ co_n~plies w}th the provisions of subsection 2 above, the effective date of appropriate ~uctions shall commence on the first full payperiod immediately following the date t~m~ Union notified the City of. the .employee's failure to comply. In the. event.the ~_pl~e refuses to comply with the provisions of. subsection 2 during the ten (10) calen~ days provided' by the City, the employee shall have the right to meet with the City I~nager or the City Manager's designee regarding such refusal prior to termination [mmom his or her position in his or her classification. 4. Suspension of Dues, Fees and In-Lieu p_a. yments Durin~j ~eave of Absence- An employee'on unhaid leave of absence withou-t- pay for a perio~d of tl~i~;ty (30) ~alendar days or more shall not be required to pay Union dues, agency fees or remake Charitable~ contributions during the period of the employee's leave. -2- · 5o Payroll Deduction Procedures' The. eff'ectiv~ date of ~ithholdings,. time of ~emitbing withholdingS'to the Union, and all procedural ~t%ers shall be as mutual.ly acceptable to 'the Union and the City, provided that the City's ~yrol! system a~d its operations are not ..thereby disrupted. 6. Notification of New Employees: The .City shal. l notify the tlnion (~f the name, classification and date of hire of each t~e~J employee appeinted to a position covered by this Memorandum. Notice shall be prok'ided to the ~taion ~ithin oF, e~ calendar month from the date of hire. .. · . 7. AcceSs- An a~thor~'zed.representative'.of the Union 'shall..h.a.~:e the.right to contact an individual employee'-representeO by. the Union in a City' facility during. the employee's work hours on imatters con6.erning wages, hours a~md other conditions of employment. The'authorized 'representative shall provide re~$-onable notice to the employee's immediate Supervisor prior to entering the work location, of. the'. employee. The employee's immediate 'supervisor shall have the right t° ~ke-arrangements ·for contact location and/or, contact time which is the least disrup[ive to the employee's. work assignments and depaPtmenta.1 operations.. B. Stewards- The Union shall be allowe¢; to designate; ~ .~as°n~t, le' number' of employees- as Stew~ardso Stewards .shall be granted reasonable release time off without loss of time or pay form the purpose of investigating' and han~lSmg emplo.¥ee9r~:~va~-"~' ~-~ces Steward release time.shall be scheduled by mu. tual agreement'be~een the.emplo~yee; the employee's immediate-supervisor, · . C. Employee Representation'RightS: An employee w~)o is m~ired"to meet a supervisor or management official and who has reason to exp~. that the meeting involve questioning leading to potential discipli')mary action, ~all have .the: ~ight. to have a Steward'or an authorized Union represe))tative pre~ent at the-meeting. In the event that an employee requests the ~f'esence of a representati~,' the representative shall be contacted to arrange a mutually acceptable time and place, for a meeting.. Once .scheduled, the supervisor or-.management official shall not be ~-equired to reschedule the meeting for the conv6nienc, e of the representative.~ D. Access to Personnel File: An employee or, upon presemibation.of an original sign~ written authorization' from an employee, an employee's representative' ~hall have - access to the employee's 'personnel file. E. Union Business Time: General Union business shall not be conducted ~uring employees' working hours.. The Union may request permission to:-conduct general Union business during employees' working hours for specific purposes and specific times. Such requests must be presented to the Department head{s) affected and may be -- approved by such Department head{s}, when such activity does mt interfere witl~-. departmental operations. -3- Section 4. Bulletin Boards · ~ The City will furnish adequate space on bulletin boards in the employee~ -- places for the exclusive use of, the Union. The Union shall not. post discreditable nature to the City or its employees or which could be ot~fens~.¥~ to members of the general public or other visitors to the City t~ac~lil=~es..~ shall be responsible for maintaining the bulletin boards in an orderly shall promptly remove outdated materials° ARTICLE 3. NON DISCRIMINATION In receiving the rights afforded by this Melnorandum of tindorstanding. ~ per,on shall in any way be favored or discriminated against to the e×l~(=~:~t prl~hib~te~ by law because of political or religious opinions or affiliations; or ~ec. ause (>~ m~¢iat or national origin; or because of age or sex or sexual preference or physical~ ~dicap; or because of the extent to which a person chooses' to engage or t~: mot-eng~g~ ~n Union activitieS, · ARTICLE 4. WAGES AND COMPENSATION · Section 1. Wages Wages shall be as set forth in Appendix A. Section 2~--.payment_ of Compensation Each employee shall be compensated on a bi-weekly basis. Payment~ ~ill ~mormall'y be made on the Thursday immediately followin§ th.e conclusion ora City' payroll period. A City. payroll period begins on the Friday which is the i~irst day 'of a (~ity~ l~ayperiod and ends on the Thursday which is the last 'day of"a City payperio~! and constants (,f fourteen (14) calendar days. Employees who are on continuous paid regu)ar s~,rvq-ce for a partial payperiod shall receive pro-rated~ compensation for the payperi~)d t)~at the employee was on continuous paid regular service, A~ £~nployee. on- contin~)us paid regular Service.Shall be an':employee who is on a .full-time .regular empl~yment status with' the City in a classification covered by this Memorandum of Under~tandi~ng. Continuous paid regular service excludes all unpaid leaves of absence.et~ an e~nployee and excludes the period of time the employee is not in a i~ull-time regular e~plo.~F~ent status wi th the. Ci ry. Section 3, Retirement Benefits -- A. Retirement Plan: Retirement benefits for employees Shall be those, mstab- ' lished by the Public Employees' Retirement System (PERS) for Miscellaneous ~loyees 2% at Age 60 Plan. B. City Contribution: The City shall pay the rate prescribed by the ~blic Employees-' Retirement System for employer contributions 'to PERS in accordan:m with the rules and regulations governing such employer contributions.~ C. Employees' Contri,botion to Retirement System: Except as oth'e~ise ~rovided in Subsection "D" below, the ~ity shall pay on behalf of each employee seve~ pmrcent (7%) of the rate prescribed by PERS for each employee's contribution to, ~E~, in accordance with the rules and regulations governing such contributions. )~. remainder. of the rate prescribed by PERS for each employee's contribution shall be d~¢ted from the employee's pay by the City and forwarded to PERS in accordance with the, ~ules and regulations governing such contributions. ,. Effective Date of Conversion- a. Dislability' Retirement: The conversion of. the Ci~'s payment of' seven percent (7%) of an eligible employee's PERS contribution to the e~ployee's base hourly wage rate for an industrial or non-industrial disability ~tirement shall become effective as determined by the first-occurring event as 1. The first day' of the payperiod immediately fmlllowing 'the date upon which the employee applied for a '~lisability retirement and~ '2. The first day of the payperiod immediately f~lllowing the date upon which the employee's disability ~as (lete~rmined to"be permanent and stationary, or 3. Insurance Benefits Full' time regular employees shall be eligible to receive insurance bene.f, its currently provided by the City through contracts with insurance carriers or. self- insurance programs as follows: A. Health Insurance 1 Available Plans' Subject to the terms and conditions of the (~ity's~ contracts with health insurance carriers, eligible employees, shall be pe~$tted to select health insurance coverage for themselves and their eligible depen~)ents; from one of the following plans- KAISER FOUNDATION HEALTH PLAN - "S" COVERAGE BAY PACIFIC HEALTH CARE PLAN BLUE SHIELD OF CALIFORNIA HEALTH PLAN · 2. Payment Of Premium Costs- The City shall pay the premi .urn eligible employees and .their dependents to the insurance carrier' for the plan- selected by each employee in accordance with the requirements prescribed by' the contract with each carrier for payment of such premiums. 3. Effective Dates of Coverage- The effective date of coverage, insurance shall be the first of the month following the month of enrollment of the employee and .the employee's dependent(s). Coverag-e shall terminate on the )ast (lay of the month in which an employee separates from emplo,~ent. Dependent coverage shall terminate on the date prescribed ·by each health ins~rance carrier's ¢.~ntract for discontinuance of dependents no longer eligible fo)', coverage., 4. B. Life and Accidental Death and Dismmnbem~ent Insurance: Subject' to~ tI~e terms and conditions of the City's contract with Standard Insur'---ance Company-of P~mtland, Oregon eligible employees shall be provided the following life and a c~dental (leath and dismemberment insurance- TERM LIFE INSURANCE WITH A FACE VALUE OF $10,000.·00 ACCIDENTAL DEATH AND DISMEMBERMENT INSURANCE IN THE AMOUNT OF $10.000.00 The City shall pay the premium costs for eligible employees to Stanc~ard Insurance Company of Portland, Oregon in accordance with the requirements prescribed )my the contract with the carrier for the payment of such premiums. Coverage shall, become effective on the first of the month following enrollment and shall terminate upon the day an employee separates from City employment. C. Vision Insurance: Subject to the terms and conditions of the City's Vision -- Insurance Plan, eligible employees.and their dependent{s) shall be provide~ the.. loll'owing vision insurance' · -6- VISION SERVICE PLAN - PLAN "B" - $10.00 DEDUCTIBLE The'Vision Insurance Plan'shall be provided to employees ~it~ no prem.imm costs to the employees or their eligible dependent{s). Coverage shall become effective on the first of the month following enrollment and shall terminate on the last ¢,f the month in which an employee separates from City employment.. D. ARTICLE 5, HOURS OF WORK, WORK SCHEDULES · A. Workday:I Eight (8) consecutive hours of work shall constitute a regular worI~ shift except that they may be interrupted by'a lunch break. All employees shall be scheduled to work On a regular work shift; and each work shift~ shall ha~e a. regular starting and quitting time. B. Workweek: The workweek shall consist of five days'. C. Work Schedule: Work schedules showing the employee's shifts, ~rkdays and hours shall be posted on the employee bu.lletin boards at all times. '-7- ' D.
