CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION DESIGNATING THE DIRECTOR OF PUBLIC SERVICES
AS A RIGHT-OF-WAY AGENT TO NEGOTIATE WITH PROPERTY OWNERS
TO ACQUIRE STREET RIGHTS-OF-WAY AND TO EXECUTE A RIGHT-OF-
WAY CERTIFICATION
WHEREAS, the City intends to widen Produce Avenue between Colma Creek and
Terminal Court as a part of the Gateway Assessment District Improvement Work
(Project No. ST-82-2); and
WHEREAS, it is necessary to acquire additional rights-of-way for the purpose
of said street widening; and
WHEREAS, the construction costs of said street widening project are esti-
mated to be approximately TWO HUNDRED THOUSAND DOLLARS ($200,000.00), ninety
percent (90%) of which will be federally funded; and
WHEREAS, in order to receive said federal funding, it is necessary that the
City, in acquiring rights-of-way for the widening project,
comply with the Uniform Relocation Assistance and Real Property Acquisition
Policies Act of 1970 and provide the federal government with a "Right-of-Way
Certification"; and
WHEREAS, the Director of Public Services is the appropriate staff member
of the City to negotiate with property owners to acquire street rights-of-way
and to execute the Right-of-Way Certification mentioned above;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South
San Francisco that:
1. The Director of Public Services is hereby designated as the City's agent
to negotiate with property owners to acquire street rights-of-way for the purpose
of widening Produce Avenue and to execute the Right-of-Way Certification re-
quired by the federal government.
2. Any and all agreements to purchase said rights-of-way must be approved
by the City Council and executed by the Mayor or City Manager as the Council may
direct.
3. The Director of Public Services shall execute the Right-of-Way Certifica-
tion only after all required rights-of-way for construction of the Produce
Avenue widening project have been acquired.
I hereby certify that the foregoing Resolution was regularly introduced and
adopted by the City Council of the City of South San Francisco at a regular
meeting held on the 22nd day of August , 19 84 , by the following vote:
