CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION FINDING AND DETERMINING THAT
BECAUSE OF LOCAL CONDITIONS, THE PUBLIC
HEALTH, SAFETY, WELFARE AND NECESSITY,
REQUIRE CHANGES OR MODIFICATIONS TO CERTAIN
PROVISIONS OF THE UNIFORM BUILDING CODE AND
UNIFORM BUILDING CODE STANDARDS, 1982 EDITIONS
WHEREAS, pursuant to the provisions of Sections 50022.1 et seq., of
the Government Code, this Council proposes to adopt by reference the
Uniform Building Code, 1982 Edition (Library of Congress Catalog Number
81-86609), and the Appendix thereto, and Uniform Building Code Standards,
1982 Edition (Library of Congress Catalog No. 81-86610) and the Standards,
Principles, Tests, Methods, Publications and Secondary Codes referred to
therein or adopted by reference except for certain sections, subsections
and parts of sections;
and
WHEREAS, in connection therewith, certain changes or modifications are
proposed to be made to the subtantive provisions of said Uniform Code,
which changes or modifications are reasonable and necessary because of
local conditions; and
WHEREAS, Section 17958.7 of the California Health and Safety Code
requires, insofar as such changes or modifications relate to apartment houses,
hotels, motels, and dwellings and buildings and structures accessory thereto,
that the governing body of a city, before making any modifications or changes
to such Uniform Code, shall make an express finding that such modifications
or changes are needed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South
San Francisco as follows:

(1) In connection with the adoption of the ordinance entitled
"An Ordinance Repealing Chapter 15.08 of the South San Francisco Municipal
Code, Ordinance No's 849, 920, 939, 940 and 953, and adding Chapter 15.08
entitled "Uniform Building Code" to said Municipal Code adopting by reference
the International Conference of Building Officials' Uniform Building Code
and Uniform Building Code Standards, 1982 Editions" it is hereby expressly
found and determined that the changes or modifications to the aforesaid
Uniform Code set forth in Exhibit "1" attached hereto and by this reference
made a part hereof, insofar as the same relate to apartment houses, hotels,
motels and dwellings, and buildings and structures accessory thereto, are
reasonable and necessary because of local conditions.
(2) This resolution, which contains the modifications authorized by
Health & Safety Code Section 17958.7 and the express findings required by
said section, shall be available as a public record and a copy thereof shall
be filed with the California Department of Housing and Community Development
by the City Clerk.
I hereby certify that the foregoing Resolution was regularly introduced and

REPEALED
ChaPter 1§.08 of the South San Francisco Municipal Code and the
following ordinances are hereby repealed, except that this repeal shall not
affect or prevent the prosecution or punishment of any person for any act
committed or omitted in violation of said Chapter or of said ordinances hereby
repealed prior to the effective date of this ordinance-

(b) One copy of the Uniform Building Code and Uniform Building Code
Standards, certified to be true copies, shall be filed in the office of the
city clerk in the form and at the times prescribed by law and kept there for
public inspection during the time this chapter is in effect, except that after
adoption of the ordinance adopting-this chapter one copy may be kept in the
office of the chief building official instead of the city clerk's office.
The city clerk shall maintain a reasonable supply of copies available for
purchase by the public as required by law.

Section 206 a~Jded to read as follows-
"206 Penalties.
Any person, firm or corporation violating any of' the provisions of this
Code shall be deemed guilty, of a misdemeanor, and each such person shall be deemed
guilty of a separate offense for each and every day or portion thereof during
which any violation of any of the provisions of this code is committed, continued,
or permitted; and upon conviction of any such violation such person shall be
punished by a fine of not more than One Thousand Dollars ($1,000.00)or imprison-
merit for not more than Six (6) months or by both such fine and imprisonment."

15.08.040 Section 302(a)8 added--Application for permit.
Subsection B is added to Section 302(a) to read as follows-
"302(a) Application for Permit.
8. 'Submit a plot plan of the property containing the lot number,
block number and subdivision designation, with the grades including existing
and proposed finished grades at several points adjacent to the proposed~build-
lng location and at the property lines, said grades to be related to an estab-
lished datum such as curb or sidewalk elevations and showing the following-
location of the proposed, building with respect to property lines, location of
existing building or buildings which will remain on the property and the
location of existing and proposed drainage, utilities, fire hydrants, trees,
power poles and other facilities or fixed objects located between the property
line and the curb. Submit a soils report if so required by the Building
Official ."
15.08.050 Section 302(d) added--Approval by other departments required.
Subsection (d) is added to Section 302 to read as follows-

Before issuing any building permits, except a permit for repairs or
alterations, the Chief Building Inspector shall first submit the application
with plans and specifications to the Fire Department, Director of Community
Development, Director of Public Services, Director of Parks and Recreation,
Health Officer and Police Department as required, who shall examine the same
and endorse thereon their approval or disapproval."
15.08.060 First sentence of subsection 304(a) and subsections 304(b) and
304(-d) 2 amended.
~he first sentence of subsection 304(a) and subsections 304(b) and 304(d)2
are amended to read as follows-
"Fees.

304(a) Permit Fees.
The fee for each permit shall be as set forth in Exhibit "A"
attached hereto 'and incorporated herein by this reference.
304(b) Plan Review Fees. .;
When a plan or other data is required to be submitted by Sub-
section (b) of Section 302, a plan review fee shall be paid at the time of
submitting plans and specifications .for review. Said-plan review fee shall be
sixty-five percent (65%) of the building permit fee. Where plans are incomplete
or changed so. as to require additional plan review, an additional plan review
fee shall be charged at the rate shown on Exhibit "A" attached hereto and pre-
viously incorporated herein by reference.

304(d)2 ~Fee.
An investigation fee, in addition to the permit fee, shall be
-Collected whether or not a permit is then or subsequently issued. The' investi-
gation fee shall be equal to the amount of the permit fee required by this Code.
The minimum investigation fee shall be the same as the minimum set forth in

Exhibit "A" attached hereto and previously incorporated herein by'reference.
The payment of such investigation fee shall not exempt any person from compliance
with all other, provisions of this Code nor from any penalty prescribed .by law."
15.08.070 Fourth paragraph of Section 305(g) amended.
The fourth paragraph of Section 305(g) is amended I~o read as follows-
"To obtain a reinspection, the applicant shall file an application therefor
in writing upon a form furnished for that purpose and pay the reinspection fee
in accordance with Exhibit "A" attached hereto and incorporated herein by
reference."
15.08.080 Section 307(g) and (h) added--Certificate of occupancy.

307(h) ApProval of Other Officials Required.
In the case of a proposed occupancy and use, except for an R-3 or M
Occupancy, the Building Official before issuing a Certificate of Occupancy,-shall
first submit the application to the Fire Chief, who shall examine the same and
endorse his approval or disapproval thereof based on applicable sections of the
Uniform Fire Code and related statutes and ordinances. In such case, no Certi-
.~ficate of Occupancy shall be issued, except for an R-3 or M OccUpancy without
the approval of the Fire Chief."
15.08.090 Section 308 added--Fire and health protection.
Section 308 is added to read as follows-
"308 Fire and Health Protection.

The Chief of the Fire Department, as active head of the Bureau of Fire
Prevention and Public Safety, and the Health Officer shall have concurrent juris-
diction, with the Building Official, in the enforcement of all those provisions
of this Code relating to, or involving protection against fire, or the mainte-
nance of public, health. The Building Official, Fire Chief, and/or Health '
Officer, and/or their authorized representatives, may enter any bulding or
premises for the purpose of inspection or enforcing the provisions of this Code,
as provided in Section 202(d) of the Uniform Building Code."

15.08.100 Section 501 amended--Occupancy classified.

S~ction 501 is amended to read as follows-
"501 _Occupancy Classified.
Every building, whether existing or hereafter erected, shall be classi-
..
lied by the Building Official, according to its use or the character of its
occupancy, as a building of Groups A~ B, E, H, I, M or R as defined in Chapters
6, 7, 8, 9, 10, 11 and 12. (See Table No. 5-A).
After.consultation with the Fire Chief or his representative, anY
occupancy not mentioned 'specifically or about which there is any question shall
be classified by the Building Official and included in the group which its use
most nearly resembles, based on the existing or proposed life and fire hazard."
15.08.110 Subsection 1707(e) added--Exterior metal hardware, galvanizing
-required.
Subsection 1707(e) is added to read as follows-
"1707(e) Metal railings, cabinets, bolts, nails,..hing~s, locks and any
similar p~rts exposed to weather on buildings shall be galvanized.
Galvanizing of products fabricated from rolled', pressed and forged steel
shapes, plates, bars and strip 1/8-inch thick or thicker, .shall conform to the
specifications of ASlM Designation' A123. Except for pregalvanized standard
pipe, galvanizing of material 1/8-inch thick or thicker shall be performed. after.
.t~abricati~ into the largest practical sections. Material thinner than 1/8-inch
shall either be galvanized before fabrication in conformance with the require-
ments of-ASTM Designation- A525, Coating Designation- G_~iO or after fabrication,
in conformance with the requirements of ASTM Designation- A123, whichever
results in 'the greatest'resistance'to rust, except that the weight of zinc
coating shall average not. less than 1.2 ounces per square i~oot of actual surface
area with no individual specimen having a weight of less than 1.0 ounce.
Galvanized surfaces that are abraded or damaged at any time after the appli-
cation~ of the zinc coating shall be repaired by thoroughly wire brushing the
·
damaged areas and removing all loose and cracked coating, after which the cleaned
areas shall be. pain~ed with 2 applications of Zinc-Rich Primer without thinner.
Galvanizing is not required for stainless steel, non-t~errous metals and
similar equally corrosion resistant/'metals."

15.08.120 Section 2623 amended--Minimum slab thickness.
Section 2623 is amended to read as follows-
"2623 Minimum Slab Thickness.
(a) . The minimum thickness of concrete floor slabs supported directly
on the ground shall be not less than three and one-half inches (3-1/2").

(b). Following are the requirements for concrete slabs on ground used
.

as a finish floor or as a base for other ~ fl oor finish in habitable rooms-
1. Minimum thickness of reinforced concrete three and one-half
inches (3-1/2").
2. A waterproof mem~)rane, same being polyethylene film of 12 mil
.~. minimum thickness or alternate material approved by the Building
Official, pursuant to the provisions of this Code. Said waterproof
.~ membrane shall extend to the exterior walls or beyond the limits of
habitable rooms and be turned up to top of slab.
3. A granular material shall De placed under concrete and shall
be of proper consistency and thickness to retard capillary action and
shall be approved by the Building Official.."
15..08.130 Section 2905(g) ~dded--Grading and drainage.

Subsection (g) is added to Section 2905 to read as follows-
"g) Grading and Drainage.
· .
The concrete cover beneath the floor system of a building shall be
graded to a low point so as to provide positive drainage to the exterior. If
the exterior grade is higher'than the grade beneath the floor system, a posi-
tive'drain system shall be installed subject to approval of the Building
Official. The exterior grade around every building shall be sloped away from
the building by a minimum grade of one-half inch per foot (1/2" per 1') fora
distance of thirty inches (30"). Grading.for drainage shall be arranged so

as to drain toward the sidewalk or Street gutter, except where alternate methods
are approved by. the Building Official."
_15.08.140-'Section 2907(i) and (j) added--Footings.
Subsections (i) and (j) are added to Section 2907 to read as foll°ws·
"(i) Group R-1 and R-3 Occupancies.
A minimum of two (2) half-inch (1/2") steel reinforcing bars shall be
placed in continuous foundation of all Group R-1 and R-3 Occupancies, with one
such rod placed three inches (3") from the top of the foundation and the other
,
three inches (3") from the bottom of the footing.
(j) Concrete Coverage.
In every building or portion thereof, in order to minimize dampness, a
--concrete covering having a minimum thickness of two inches (2") shall cover all
otherwise exposed earth within the foundation walls."
15.08.150' Chapter 46 added--Moving buildings,
Chapter 46 is added to read as follows-
"Chapter 46. Moving Buildings.
46D1 Bond.
In addition to all other requirements of the Building Code relating
to the moving of buildings and structures, no permit for the moving of buildings
and structures shall be granted by the Building Official until the applicant
shall have-filed with the Building OFficial (a) a performance bond in favor
of the City, in the sum of not less than One Thousand Dollars ($1,000.00)

npr more than One Hundred Thousand Dollars ($100,000.00}, in such amount, how-
ever, as the Building Official may determine, which bond shall be conditioned to
require the applicant to strictly comply with all conditions and provisions of
this Chapter, and of any provision of the City of the South San Francisco Muni-
cipal Code relating to the moving of buildings or structures, and of any order,
rule or regulation which may be her6after passed or adopted by the Council, and
that such person will pay any and all damages which may res'ult, by reason of
the moving of the building or structure, to any fence, hedge, tree, pavement,
street, sidewalk, curb, gas pipe, water pipe, sewer pipe, electric wire or pole
supporting the same, or to any public or private property and (b) an undertaking
to indemnify, defend and hold harmless the City and its elective officers, agents
and employees against all liabilities, claims, actions, judgments, cost or any
expense which may for any reason arise out of the issuance of said permit or
moving of such buildings or'structures.
4602 Place and Manner of Removal.
In addition to all other requirements of the Building. Code, relating'to
the moving of buildings or structures, all removals made under any permit granted
for such moving shall be done over and along only the street, or streets desig-
nated in such permit, and at the times therein specified, and shall be done in a
careful manner to the satisfaction of the Building Official and the Superinten-
dent of Streets.
4603 Time Limited Durin.g Which Building To Be Left Standing On Any Block.
No person owning or having charge of the removal of any building or
structure being moved over any street, shall permit such building or structure
to be, or stand, on any street within the limits of any one block for a period
of more than twenty-four (24) hours.

4604 Prevention of.Injur_y to Street.
I~o person owning or having charge of the removal of any building or
structure being moved over any street, shall allow or cause injury to any fence,
hedge, tree, pavement, 'street, sidewalk, curb, gas pipe, ~ater pipe, sewer pipe,
electric wire or pole supporting same, or any other public or Private property
by reason of such removal."
15.08.160 Appe~ndix Section 7003 amended-'Permits required.
(a] The first sentence of Appendix Section 7003 is amended to read as follows:
"Except for the following, no person shall do any grading without first
having ·obtained a Grading Permit from the Building Official, which term when
used in this chapter shall mean the Director of Public Services:"
(b) Subsection 8 of Appendix Section 7003 is amended to read as follows-
"8. Grading for l~he purpose of agricultural irrigation or cultivation."
15.08.170 Appendix Section 7004 amended--Hazards.
Appendix Section 7004 is amended as follows-
"7004 Hazards.
(a) [to be added in front of original paragraph]
(b) The owner of any property on which an excavation or fill has been
made, shall maintain in good condition and repair all retaining'walls, cribbing,
drainage structures, planted slopes, natural water courses and surface drainage."
.15.08.180 Appendix Sections 7006(e) and (f) amende, d--Grading permit
requirements.
Subsections (e) and (f) of Appendix Section 7006 are amended to read as follows-
"(e) Soils Engineering Report.

The soil engineering report required by Subsection (c) shall include
data regarding the nature, distribution and strength of existing soils, conclu-
sions and recommendations for grading procedures and design criteria for
·

corrective measures when necessary, and 'opinions and recor~mendations covering
.adequacy of sites to be developed by the proposed grading.
S6il engineering report on engineering grading shall include results of at
least one triaxial compression test or a direct shear test, where applicable;
Sieve analysis, of coarse and fine aggregates; show the location of water tables;
~oCat~on of test bore holes and compaction tests. Where public improvements
involve streets, the soils report s~all include results of R value tests, taken
for the native material over which the improvement is to be made. R values at
both 300 psi exudation pressure and the expansive pressure .shall be included.
In eXpansive soils' such as clay, where the fill is greater than 6 feet, a
thorough analysis for slope stability of the grading shall be provided which
contains a minimum slope stability factor of safety of 1.15.
Where clay strata exist, the soil engineering report shall include the thick-
ness of clay strata, its depth belo~ surface and its effect with regard to settle-
ment of foundations of improvements and shall be supported by consolidation
test results.
The Building Official may require additional tests as required, and the costs
of these tests shall be borne by .the developer. The result of these tests will
be included in the soil engineering report.
Recommendations included in the report and approved by the Building Official
shall be incorporated in the grading plans or specifications.
(f) _Engineering Geology Report.
The engineering geology report required by Subsection (c) shall include
an adequate description of the geology of the site, conclusions and recommenda-
tions regarding the effect of geologic conditions on the proposed development,

When springs and'ground water are encountered upon excavation, the
eSgine~ring geology report shall describe, in detail, measures for the perma-
nent drainage of water from the proposed construction site.
Where borings show extensively thick soft strata or clay, a map
showing the boundaries of such strata and its thickness shall also be a part
of engineering geology report.
Recommendations included in the report and approved by the Building
Official shall be incorporated in the grading plans or specifications."
15.08.190 Subsections (h) through (k) added to Appendix 7006.
Subsections (h), (i), (j) and (k) are added to Appendix Section 7006 and
shall read as follows-
"(h) Transportation Routes.
The routes along which fill and grading material will be transported
shall be designated by the Building Official.
(i) Further Subdivision Grading.
In subdivision work where grading is completed in accordance with the'
plans and specifications, and further grading is proposed, a new grading permit

may be required and all such grading shall be in conformance with this chapter
and other related provisions of the Uniform Building. Code.
(j) Hours.

No grading or any work in connection therewith, including the import
and export of earth materials, shall be conducted between the hours of 6:00 pm
and 7-00 am of any day, nor on Saturday or ~Sunday at any time without prior
written approval of the Building Official.
(k) Grading in Public Right-or-d!ay.

No person shall do any grading in public right-of-way or a public ease-
ment. without first obtaining an encroachment permit from the Building Official
as set forth in Chapter 13.04 of the South San Francisco Municipal Code."

15.08.200 Appendix Section 7007 amended.
Appendix Section 7007 is amended to read as follows-
"7907 Fees.
(a) Plan-Checking Fee.
For excavation and fill on the same site, the 'fee shall be based on the
volume of the excavation or fill, whichever is greater. I]efore accepting a
set of plans and specifications for checking, the building official shall
collect a plan-checking fee. Separate permits and fees shall apply to retain-
ing walls or major drainage structures as indicated elsewhere in this 'code.
There shall be no separate charge for standard terrace drains and similar

facilities. The amount of the plan-checking fee for grading plans shall be.
as set forth in Exhibit "A" attached hereto and incorporated herein by this
reference.
(b) Grading Permit Fees.
A fee for each grading permit shall be paid to the building official
as set forth in Exhibit "A" attached hereto and previously incorporated herein
by reference."
15.08.210 Appendix Section 7008 amended--Public nuisances and immediate
hazardous conditions.
Appendix Section 7008'is amended to read as follows-
"7008 Public Nuisances and Immediate Hazardous Conditions.
(a) Bonds.
The owner and contractor shall conduct the grading work in such a manner
as not to create a present public nuisance or immediate public hazard and shall
file a performance bond with' the Building Official in a sum not less than $50,000 -
to assure remedial work required to abate any present public nuisance
or immediate public hazard so created, if such a bond is required by the building

official, lhe building official may reasonably reduce the amount of the per-
formance bond based on the discretionary determination as to the scope of any
anticipated remedial work, but in no Case.to a sum of less than $10,000.00.
(b) .In lieu of a bond the applicant may deposit cash or other accept-_
· .
able instrument of 'credit as security with the building official in an amount
equal to that which would be required in the bond.
(c) Insurance.
The building official may, before issuing the permit, require that
the applicant for a permit file a certificate showing that he is insured against
claims for damages for personal injury as well as claims for property damage,
including damage to the City by deposit or washing of material into City streets
or other public improvements, which may arise from or out of the performance of
the work, whether such performance be by himself, his subcontractor or any person
directly or indirectly employed by him and the amount of such insurance shall
be at least $500,000.00 and $1,000,000.00 public liability' and an additional
$500,000.00 property damage. Any such insurance shall include protection
against liability arising from completed operations provided the cause of action
therefor existed at the time of project completion. Any such insurance shall be
subject to the approval of the City Attorney as to form, amount and carrier and
shall insure the City, its officers, agents and employees against loss or lia-
bility which may arise from each occurrence' during the performance of or which
may result from any work herein required to be done."
15.08.220 Appendix Section 7016 added--Restriction of work during rainy
season.
Appendix Section 7016 is added to read as follows-
"?016 Restriction of Work During Rainy Season.
Yhe period between November 1. and May I is hereby determined to. be the

period in. which heavy rainfall normally occurs in the City of South San Fran-
· ~isco. During.this period no grading work in excess of 200 cubic yards will

be authorized on any single grading site under permit where the building
official determines that such work will endanger the public health or safety.
Previously authorized grading work which extends into the rainy season shall'
be protected by incorporating temporary erosion c°ntrol devices: 'Plans of
,
erosion control devices shall be submitted to the building official and design
approval obtained not later than October I prior to the rainy season. The
·
design of desilting basins which diScharge into City streets or natural water
courses sha'll be under the control of the building official. All temporary.
.erosion control and devices, including the desilting basi~s, shall be installed
not l'ater than November 1. '
The building official, in the performance of his duties, may add:
1. Regulations as to the use of public streets and .places in the
course of the work.
2. Requirements for safe and adequate drainage of the site.
3. A requirement that approval of the building official be secured
before any work which has been commenced may be discontinued.
4. A requirement that men and equipment be provided at the site during
storms to prevent incomplete work from endangering life or property.
5. Requirements for fencing of excavation or f~l~s which would be
hazardous without such fencings.."
15.08.230 Appendix Section 7017 added--Liability.
Appendix Section 7017 is added to read as follows-
'~?017 Liability.
The City of South San Francisco relies upon Section 17956 of the Health and
Safety Code in enacting Appendix Chapter 70', as amended, herein of the Uniform

B~ildin~g Codes 1982 edition, which provides that the City. shall not be liable
for any injury which arises out of any act or omission of the City or other
enforcement agency or a public employee or any other person under Sections
17953, 17954 or 17955 of the Health and Safety Code."
SECTION 3. SEVERABILITY.. ·

If any section, subsection, sentence, clause or phrase of this Ordinance
is for any reason held to be' invalid or unconstitutional, such decision shall
not affect the validity or constitutionality of the remaining portion of this
ordinance. The City Council hereby declares that it would have adopted this
Ordinance and each section, subsection, sentence, clause or phraSe hereof,
irrespective of the fact that any one or more sections, subsections, sentences,
clauses or phrases, be deClared invalid or unconstitutional.
SECTION 4. PUBLICATION.
Pursuant to the provisions of Government Code Section 36933, a Summary of
this 'Ordinance shall be prepared by the City Attorney. At least five (5) days
prior to the Coun'cil meeting at which this Ordinance is scheduled to be adopted,
the citY Clerk shall (1) publish the summary, and ~2) post in the City Clerk's
Office a certified copy of this Ordinance. Within fifteen (15)days after the
adoption of this Ordinance, the City Clerk.shall (1) publish the Summary, and
(2) post in the City Clerk's Office'a certified copy of the full text of this-
Ordinance along with the names of those City Council members voting for and
against this Ordinance or otherwise voting'.
