HomeMy WebLinkAboutReso 173-1984 RESOLUTION NO. 173.-84 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLULTION AUTHORIZING THE APPLICATION FOR AN AMENDMENT TO THE GRANT AGREEMENT BETWEEN THE CITY OF SOUTH SAN FRANCISCO AND THE UNITED STATES OF AMERICA ACTING THROUGH'THE FAA WHEREAS, the Aviation Safety and Noise Abatement Act of 1979 (commencing with 49 U.S.C. Section 2101) hereinafter the "Act" provides for federal funding of eighty percent (80%) of local projects to carry out Noise Compati- bility Programs that are in accord with the Act; and WHEREAS, the City of South San Francisco (hereinafter "City") has previously entered a Grant Agreement between said City and the United States of America (acting through the Federal Aviation Administration, hereinafter called the "FAA"), which Agreement is entitled "Department of Transporation Federal Aviation Admin- istration Grant Agreement" and bears Project No. 3-06-0221-N1 and Contract NO. DTFA08-83-C-30070 (hereinafter the "Agreement"; and WHEREAS, at the time the Agreement was entered between the City and the FAA there was a federal requirement that the City secure noise easements from potential recipients of funding in favor of the City and County of San Francisco as operator of San Francisco International Airport; and WHEREAS, the foregoing federal requirement to secure easements in favor of the City and County of San Francisco has now been deleted; and WHEREAS, some local residents otherwise eligible to participate in the Noise Insulation Program may find it in their interest to personally fund or find other sources of income for the twenty percent (20%) local share of insulating struc- tures on their property, rather than granting San Francisco the aforementioned easement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that' 1. The City Council finds that the Program's success will be insured to a greater degree by providing more flexibility in the Program, and one way of providing increased flexibility in the Program is to eliminate the requirement that all participants grant a Noise Easement in favor of the City and County San Francisco. 2. Based upon the foregoing, the Mayor is authorized to make application for an amendment to the Agreement, which amendment would eliminate the require- ment for the City to obtain the aforementioned easements in favor of the City and County of San Francisco; and the Mayor is authorized to sign all documents necessary for completion of said application and acceptance of an amendment to the Grant Agreement reflecting said change. 3. The authority granted the City Manager and the City Attorney by Resolu- tion No. 89-83 is hereby amended to include reference to the amendment of the Grant Agreement referred to in this Resolution and is otherwise reaffirmed. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a~reqular meeting held on the 24th day of October , 1984, by the following vote: AYES: Councilmembers Mark N.
