HomeMy WebLinkAboutReso 56-1925RESOLUTION OF INTF~TION NCo d~ RESOLVED, that it is the intention of the Board of Trustees of the City of South San Francisco, State of California to order the following work to be done and im- provements to be made in the City of South San Francisco to-wit: ThatBRADE~ AV~I~UE from the northeasterly line of Chapman Avenue to the South- erly line of Randolph Avenue be improved by grading between the existing curbs of said street and by constructin~ on both sides of said street cement concrete ~utters of the dimensions and at the locations shown upon the plans and specifications hereinafter re- ferred to and by paviDg said street between the edges of said proposed gutters with a oavement consisting of a Willite Process Composition wearing surface one and one-half (l~) inches in thickness laid upon a cement concrete base four (4) inches in thickness. That four (4) inch vitrified, salt-Elazed ironstone pipelateral or side s~wers be constructed to connect with and run from the existing main sewer to the existing curbs on either side of saidBDaden ~venue, between Chapman Avenue and Raudolph ~venue to the 'number of one such lateral or side sewer for each lot or parcel of land fronting upon saidBPaden Avenue: Exceotin~ from all of the herein described work, all of said work that is al- ready done to the official lines and grades and in accordance with the said plans and specifications hereinafter referred to. All of said work done hereunder shall include any and all street intersections, terminations, and opposite terminations occurring within the limits of the work hereinbe- fore mentioned, but no work shall be construed as a doublinE at any intersection: All of said work done hereunder shall be done to the grades as shown on the plans and specifications hereinafter referred to, and shall be done and performed in ac- cordance with the plans and specifications heretofore adopted for doing said work by said · Board of Trustees and now on file in the office of the City Clerk of 'said City, which said plans and specifications are hereby expressly referred to for the full and detailed des, cription of said proposed work and improvement. AND ~,~HEiAEAS, said contemplated work and inprovement in the opinion of the Board of Trustees is of more than local or ordinar~y public benefit, said Board hereby makes the expenses of said work and improvement charseable upon a district, which said district said Boardhereby declares to be the district benefited by said work and improve- ment, and to be assessed to paw the costs and exoenses thereof, which said district is bounded and particularly described as follows, to-wi%: BEGII~I~iNG at a point on the southerly line of i{andolph ~venue where the same is intersected~ by the median line of Block "D", as said Block "D" is shown on that cer- tain ~ap entitled "Dlap of Peck's Subdivision ~o. l, South San z~rancisco, San ~ateo County, California," which A~ap was filed for record in the Office of the County hecorder of the County of San ~'iateo, California, June £4, 1907, in Book ~ of Original ~iaps at page ll, runninE thence Easterly along the said Southerly line of l{andolph ~venue to a point where the same is intersected by the median line of Block "B" of said last mentioned I~ap: thence Southwesterly along the median line of said Block "B" cron'sing Gardiner ~venue and con- tinuing Southwesterly along the median line of Block ~ of said last mentioned Man to the Northeasterly line of Chapman Avenue: thence Northwesterly along the said Northeasterly line of Chapman Avenue to a point where the same is intersected by the median line of the first herein mentioned block D:~ thence Northeasterly along the median line of s~id Block D to the point of beginning. Notice is hereby given that serial bonds to represent unpaid assessments and bear interest at the rate of seven per cent per ann~nn will be issued hereunder in the manner provided by the "Improvement Bond Act of 1915", the last installment of which bonds shall mature nine years from the second day of July next succeeding ten months from their dat e. California, Julys2?, ,19£5, To the Honorable Board of Trustees of the City of South San Francisco. Gentlemen: WHEREAS, it is deemed advisable by the Board of Trustees el' the City of South San Francisco that portions of various streets within said City be paved with Willite Process Asohaltic ~dixtures under and in accordance with Specifications adopted by the Board of Trus- tees of said City on . a copy of which specification is on file in the cfi'ice of the City Clerk of said City, and the said C,ity contemplates, the taking of separate proceedings for such improvements: and ~,HEREAS the said improvements require the laying of certain patented Willite Pro- cess Asphaltic ~gixtures; and WHEI~EAS, competitive bidding in the letting of contr$cts for the performance of said work is deemed advisable, and in order to pro~ide for such competitive bidding and at the same time secUre the adoption of patented Willite materials as the kind of materials and pavement to be used in said work; and i~'HE,KEAS. Willite Process Asphaltic Liixtures is a mixture covered by Letters Patent No. 1,190,61~, and WHEREAS, the undersigned, California Willite Company, a corporation, is the owner of the License rights of said patents in the State of Califormia: NOW THEREFORE, for the consideration hereinafter named, and in consideration of the passage by the Board of Trustees of the City of South San ~rancisco by resolution, ordinance or otherwise, of proceedings under which bids may be tarn for the laying of ~avements with said ~atented Willite materials upon various streets and highways in said City of South San Francisco, in accordance with the above referred to specifications, said CaLifornia Willite Co. hereby proposes and agrees to furnish to the 'said City of South San Francisco, or the proper officials thereof, or to any responsible contractor who may elect to bid upon and take the work and enter into the contract to pave such streets, or any of them, upon which Willite oavement may be so ordered, or to the o~nerS of lots and lands oroposed to be assessed for the improvement of any of such streets or highways in said City with said Willite materials, if they elect to do the work, themselves as provided by law. all ¥~illite materials required for such improvements which m~y be undertaken in accordance herewith by the said City om for which contracts may be let to any responsible contractor, or by the property owners. ~if they elect to do said work as orovided by law: and said Ca~ ifornia Willite Co.. proposes and agrees to furnish either to said City or to any responsible contra~ctor to whom any contract for such work ma.v be awarded, or to the property owners if they elect to do the work themselves, and enter in- to a contract with the ,said City in the manner required by its Charter and the laws of the State of California for the construction of such several improvements, or of any of them, all such Willite materials required for the same, or any of them, and also agrees to render to the said City or to any contractor or property owners all the services and advice hereinafter referred to,~ together with the right to use any and all of the patents, trade-marks or trade-names now owned, or which may be hereafter owned, or controlled by said California Willite Co., and which are or may be employed or necesa'ary in connection with the laying of any of the patented pavement here- inmfter specified. This license and agreement shal~ be open to acceptance by the said City of South San Francisco or by any responsible contractor to whom any work herein refer~ed to may be 1st, or by the property owners, if they elect to do an.¥ of the work as herein provided, at any time within the term of one year from the date hereof, and shall extend thereafter to cover the performance of any work herein referred to upon the streets or hig~;ays in the said City under the said specifications upon which a contract or contracts may be let ¥,ithin one year from date hereof, until such con- tract or contracts are con~pleted and the same be accepted by the p~oper authorities. All of the materials known as Willite will be ready for use as specified and re~]uired in, under and by said specifications and the contract, if any, for the work entered into with reference thereto, said Company also agrees with the said City or any contractor who may accept the terms hereof, or with the property owners if they elect to do said work, as follows, to-wit: The necessary mixture of Willito prepared under the patents and processes and in accor- dance with said specifications adopted by the Cit.y of South San ~rancisco shall be delivered hot in the wagon or trucks of the City or of the contractor or of said property owners, to whom the work may be let, at the mixing plant of the said Company. The Contractor admits the validiDy of the patent above listed and admits that the !Olastic Composition, Willite Process Asphaltic l,[i~tures, specified in the specii'ications and made a part hereof, is made under v, alid claims of said ?a~tent itc. 1,lO0,615. The said Company further agrees that during such time as any pavement is actually beinz laid under this agreement, that it will maintain at its own expense, two inspectors to co-opers, te ~ith the representatives in charge of said work on behalf of~ said City in order to insure that said pavement is laid in accordance with the specifications therefore. One of the said inspectors to be stationed at the mixing plant where the Willite is being prepared, and the ether'inspector to be stationed on the street where the pavement is being laid. The price at which said material and service is offered to the said City and to said con- tractor or contractors bidding on said work, or to said property owners, for the paving oi' the streets or highways in said City of South San Francisco, as hereinbefore provided, is eight m ~O/100 Dollars ($8.60) per ton of two thousand pounds, f.o.b, at the plant, of al~ Willite material fur- nished, within ten miles of the work and improvement, as aforesaid, and pa.vment to be made for the said material at the following times and in the following manner, to-wit: On the' 10th of each calendar month for Willite Process Asphaltic ~i~tures delivered during the calendar month preceding.
