RESOLUTION ORDERING THE WORK.
No. 57
RESOLVED tha.t, whereas the Board of Trustees of the City of South San ~rancisco did,
on the 2nd day of August, 1926, pass its Resolution of Intention No, §? to order the herein-
after described work to be done and improvement to be made in said City, which Resolution of
Intention was duly and regularly published as required by law, as appears from the affidavit
of H. E. Raynoldz'. now on file in the office of the City Clerk of said City~ and
W~LF~.REAS notice~ of the paszage of said Re~,olut.ion of Intention No. 57 headed "Notice
of improvement" were duly and leg~ly po~.ted along the 2ins of said contemplated work or im-
provement and in front of all the property liable to be as~ esz, ed therefor, and along all the
open streets within the district hereinafter described, in form aud manner as requ~ired by law,
a~ appears from the affidavit of George A. E~ee~e, ~uperintendent of Streets of said City, v~ho
after the completion of the posting of said notices filed his affidavit in the office~.of the
City Clerk, making oath that the posting of said notices was completed on the 16th day of
August, 19E6; and
WHEREAS at no time has any person delivered to the City Clerk of said City or to said
Board of Trustees a written protest against such work, or any part thereof, or against the
e~.~tent of the district hereinafter described, or against both said work and said district;
THEREFO?~E be it re~'olved that public interez, t and convenience require the work herein-
after described, and the Board of Trustees of the City of South San Francisco hereby orders
the following work to be done in said City, to-wit:
Section 1. That Elm Avenue from the northerly line of MiSler Avenue to a line drawn
parallel with and distant one hundred eighty (180) feet northerly from the northerly ~ine of
Miller Avenue be improved by grading the same for the full width aud length thereof, between
~sid liner, end also be constructing cement concrete curb~ and gutter~? and cement concreae
sidewalks on each side of said avenue and al[o by constructing in the roadway thereof between
~aid Eutter~, for the full length thereof, an a~phaltic conzrete pavement one and one-half
(1 1/~) inches in thick-ness laid on a cement concrete base four (z~) inches in thickness.
That Tamarack Avenue, from the westerly line of S~ruce Avenue to the ea~terly line of
Elm Avenue, be improved by gradin~ the s~e for the full width and length thereof, between
said lines and by paving the same with a cement concrete pavement five (~) inches~-in thickness,
Having an integral cement concrete curb along the northerly edge of said p~ve~ent and a Red-
wood header board, two 12) inches in thickness by six (6) inches in width along the southerly
edge of said pavement for the fudl length thereof.
All work herein provided for shall be done in accordance with the special plan~', pro. les
and specifications for said work and to the official grades shown upon said plans, profiles
and specificiationr, which plans, profiSes and specifications are entitled, "Plans, profiles
and specifications for the construction of improvement work upon a portion of Elm Avenue and
upon Ta~narack Avenue in the City of South S~n Fraucisco, County of San Mateo, State of Calif-
ornia'', which plaus, profiles and specifications were heretofore adopted bY said Board of
True-tees on the 2nd day of August, ~926, and are now on rise .in the office of the City Clerk,
to which plans, profiles and specifications reference iz~ hereby ~ade for a full description
of said work and for the locction and extent of the work to be done hereunder and for a
particular description of the boundaries of the district herein mentioned. There is excepted,
however, ~rom the above mentioned wGrk any and all such work as has been already done to
official grade.
A~d said Board of Trustees does hereby deter~,~ine and declare that said proposed work
and improvement isof more then local or ordinary public benefit and will affect and benefit
the land~ and district hereinafter described, which said district is hereby de~c~ared to be
the di~trict benefitted by said wc~k and improvement and that therefore the entire cost~~ and
e~.~enses of said work, and improvement sha~l be aud are hereby made chargeable against and
shaS1 be assessed upon said lands and district, except as hereinafter expressly provided which
district is within said City of South Sm~ Francisco, County of S~n Mateo, ~tate of California,
and particularly bounded and described as follows, to-wit:
Beginning at a point on the northerly line of Miller Avenue where the sams is inter-
~"ected by a line which is parallel with and distant £25 feet at right angles westerly, from the
westerly ~ine of E~m Avenue; thence northerly along ssi~ line which is paral2el and distan~
225 feet westerly at right ang2es from the westerly line of Elm Avenue to its intersection with
a line which is parallel with and distant ~00 feet northerly at right augles with the northerly
line of Miller Avenue~ thence easterly par~ lel with the northerly line of Miller Avenue snd
keeping a distance of ~00 feet northerly at right angles therefrom to 1he westerly line of
Apruce Avenue: thence southerly along the westerly line of ~pruce Avenue ~o the northerly line
of Miller Avenue~ thence westerly along the northerly line of ~il2er Avenue to the point of
beginning.
Saving, ezcepting, and excluding from said district all public streets, ~venues and
alleys, lanes, courts and places included and contained.
Notice ishereby given that serial bonds to represent unpaid assessments and bear
interest at the rate of seven ~) per cent per annun v~ill be issued hereunder in the manner
specified in the "Improvement Bond Act of 1915" and the amend~nents thereto, the last inzt~llment
of which bonds shall mature nine (9) year~~ from the End day of July next succeeding ten Il0)
months from their date.
Except as hereinbefore provided all the.herein proposed work sh~ll be done in pursuance
of an act of the Legislature of the State of'~California designated ~s the "Improvement Act of
1911", approved April ?, 1911, and the amentme~ts thereto.
The City Clerk is hereby directed to post a notice of said work, together with plans
and specifications therefor, conspicuously for five ~) days on or near the Council Chamber
door inviting sealed proposals for doing the work ordered. He is 'also directed to publish a
notice inviting such proposals and referring to the specifications posted or on file by two
12) -~nsertions in "The Enterprise", a weekly newspaper .published and circulated in said City
of Sou~h Sen ~rancisco and hereby designated for that purpose.
