HomeMy WebLinkAboutReso 276-1929RESOLUTIO~ OP no, 67, A RESOLUTION OP TEE CITY 00UNCIL OP THE CIT~ OP SOUTH SAN PRANCISCO DECLARING ITS INTENTION TO IMPROVE THIRD STREET FROM THE NORTHEASTERLY LINE OF E~ C~INO~ REAL TO THE SOUTH- IESTERLY RIGHT OP WAY LINE OF THE ~RI<~T STREET RAILWAY COMPANY. W~EREAS public interest and convenience require that the work and im- provement hereinafter described should be done; and WHEREAS, in the opinion of the City Council of the City of South San FranciscO, said contemplated work and improvement is, and is hereby declared tb be of more than local or ordinary public benefit; NOW, THEREFORE, resolved by the City Council of the City of South San Francisco that it is the intention of said City Council to order the follow- lng work ~nd.improvement to be done in said City, to-wit: That Third Street from the northeasterly line of E1 Camino Real to the southwesterly right of way line of the Market Street Railway Company, including all street intersections,he,improved as follows, Se-wit: Ia) That the existing concrete curb on both sides of said street be · taken out and removed and that a'hydraulic cement concrete combined curb and gutter of the form, sizes, dimensions and in the p~rticular locations, as A1 is more fully shovm on the plans, profiles and detailed drawings hereinafter referred to, be constructed on each side of said street between said limits; lb)Also that the areas on each side of said street between said limits and between the edge of the existing oiled .macadam pavement and the herein pro- posed gutters be graded and that there be constructed on such graded areas a waterbound rock n~cadam pavement six inches in thickness; that the existing oiled macadam p~vement between said ~reas and within said limits be scarified, re-shaped and re-rolled in ~ccordance with the cross-section therefor and also that the whole roadway area between the proposed gutters, including both the re-shaped and re-rolled existing pavement and the herein proposed waterbound rock macadam pavement, be improved by constructing on such roadway area an asphaltic concrete wearing surface three (Z) inches in thickness, all to be in accordance with the plans, profiles, detailed drawings and specifications hereinafter particularly referred to. "260 lc) Also that each of the emisting lateral or side sewers, which extend from the main sewer in said street to the present curb, be extended to the edge of the ex- isting sidewalks nearest to the property line; said sewer extensions shall be four ~4) inches in diameter and of salt glazed vitrified, ironstone pipe; the locations of such laterals are shown on the said'plans hereinafter referred to; (d) Also that 59 feet of 12 inch diameter cement concrete pipe storm water sewer, with two red burnt brick catch-basins capped with cast iron frames and gratings, be constructed at the lower end .of Third Street Just southwesterly from the southwester- ly right of way line of the Market Street Railway Company, at the particular locations and of the forms, dimensions and at the dept as all are more fully shown on-the plans hereinafter referred to; (e) Also that a cement concrete sidewalk of the form, size, dimensions and in the particular location as all are more fully shown on the plans hereinafter referred to, be constructed on both sides of said Third Street, extending on the northwesterly side l? feet and A inches southwesterly from the southwesterly line of the Market Street Railway Company's ~ight of way and on the southeasterly side a distance of ~2 feet ~ inches southwesterly from said right of way line, also that the sidewalks, now existing on the portion of said Third Street last hereinbefore mentioned, be taken out and removed. All work herein provided for sh~ll be done in accordance with the special plans, profiles and specifications for waid work, which plans, profiles and specifications are entitled,"Plans, profiles, detailed drawings and specifications for the con- struction of improver~ent work upon Third Street from the northeasterly line of E1 Camino Real to the southwesterly right of way line of the Market Street Railway Co-~ mpany, in the City of South San Francisco, County of San Mateo, State of California," which plans, profiles, detailed drawings and specifications were heretofore adopted by said City Council on the 23rd day of October, 1929, and are now on file in the office of the City Clerk; Reference is hereby n~de to said plans, profiles and specifications for the description of the grade at which the work is to be done and for a full description of said work and for the locations and extent of the work to be done hereunder and for a particular description of the boundaries of the district herein mentioned. And said City Council does hereby determine and declare that said proposed work and improvement is of more th~u local or ordinary public benefit and will affect and benefit the lands and district hereinafter described, which said district is here- by declared to be the'district benefitted by said work and improvement, and that there- fore the entire costs and expenses of said work and improvement shall be and are here- by made chargeable against sand shall be assessed upon said lands and district, ex- cept as hereinafter expressly provided, which district is within said City of South San ~rancisco, County of San Mateo, State of C~lifornia, and particularly bounded and described as follows, to-wit: Beginning at a point of intersection of the westerly line of the old Mission Road and the southwesterly line of the Market Street Railway Company's right of way; run- ning thence southeasterly along said southwesterly right of way line to its inter- section with the southeasterly line of that certain subdivision shown on that certain map entitled "Town of Baden" Part of Burl Buri Rancho, west of Railroad filed for record Nov. ~0, 1891, in Volume "E" of Maps a t page 62, S~n Mateo County Records; thence southwesterly along said southeasterly subidivion line to the northeasterly line of the E1 Camino Real; thence norhtwesterly along the said northeasterly line of E1 Camino Real to a poin where said E1 Camino Real intersects the northeasterly line of Mission Road, thence continuing northwesterly along the said northeasterly line of Mission Road to the point of beginning. Saving and excepting and excluding from said district all public streets, avenues, and alleys, lanes, courts and places included and contained. Notice is hereby given that s~id City of South S~ ~rancisco will pay out of its general fund one-half ~½) of the amount of the contract price for doing said work in excess of Four Thousand Nine Hundred and Seventy Dollars i$A,970.00~. Notice is hereby given that serial bonds to represent unpaid assessments and bear interest at the rate of seven (?1 per cent per annum will be issued hereunder in the manner specified in the "Improvement Bond Act of 191~" and the amendments~thereto, the last installment of which bonds shall mature nine (9) years from the End day of July next succeeding ten IlO) months from their date. ~ "The Enterprise and the South San Francisco Journal", a newspaper of general circulation, printed and published in said City of South S~u Francisco, is hereby designated as the newspaper in which this resolution of intention shall be published, and the City Clerk is Sereby directed to cause this resolution of intention to be published by two ~2) insertions in the manner and form required by law. Notice is hereby given that on Monday, the 18th day of November, 19£9, at the hour of ?:30 o'clock p. m. in the Chamber of the City Council of the City of South San Francisco, any and all persons having any objections to the proposed work and improv_ement may appear before said City Council and show casue why said proposed improvement should not be car-~ied out in accordance with this resolution. 2'6 Except as hereinbefore provided,~ all of the herein proposed~ wore sh~ll be done in p~rsuance of an act of the ~egislature of the State of Cal- ifornia, diesignated as the Improvement Act of 1911," approved April ?, 1911, and the amendments thereto. -,-,-,-,-,--,-,-,-,.,-,.,- I hereby certify that the foregoing resolution was rega~,arly in- troduced and adopted by the City Cpuncil of the City of South San Francisco, this 25rd day of 0ctober,1929, by the following vote: Ayes, Councilmen, A.
