REDEVELOPMENT AGENCY OF THE CITY OF SOUTH SAN FRANCISCO
STATE OF CALIFORNIA
A RESOLUTION RESCINDING THE EXCLUSIVE
NEGOTIATING RIGHTS AGREEMENT WITH BAY
WRST COVR,L.T..P.
WHEREAS, pursuant to Resolution No. 3-96 dated April 3, 1996
the Redevelopment Agency of the City of South San Francisco
approved an Exclusive Negotiating Rights Agreement (ENRA) with Bay
West Cove, L.L. P. for the development of the Shearwater
Redevelopment Project; and
WHEREAS, the anticipated development would be a retail project
with a potential for a mixed use retail/office development; and
WHEREAS, the ENRA has not been executed by Bay West Cove,
L.L.P. since it was approved by the Redevelopment Agency, and since
that time Bay West Cove, L.L.P. has acquired the Shearwater
property, has had a Remedial Action Plan approved by the Regional
Water Quality Control Agency, and has submitted a new all retail
plan to the Redevelopment Agency for consideration; and
WHEREAS, conditions have changed to the extent that if a new
agreement is negotiated, it should be based on the proposed new
project. ·
NOW, THEREFORE, BE IT RESOLVED that the Redevelopment Agency
of the City of South San Francisco hereby rescinds Resolution No.
3-96 dated April 3, 1996 entitled "A Resolution Authorizing an
Exclusive Negotiating Rights Agreement with Bay West Cove, L.L.P.
For Development of the Shearwater Site."
I hereby certify that the foregoing Resolution was regularly
introduced and adopted by the Redevelopment Agency of the City of
South San Francisco at a regular meeting held on the llth
day of September , 1996 by the following vote.
AYES: Boardmembers Joseph A. Fernekes, Eugene R. Mullin, John R.
Penna, Robert Yee and Chairman Jack Drago
