· ATEI~ LICENSEE AG~EMENT
WHEREAS the City o~ South San Francisco contemplates the installation of a
system of electroliers under the act of the Legislature of the State of California,
known as the "Imporvement Act of igll", as amended, and desires to provide for the
use therein of eleetrclier standards, Westinghouse Special California Duplex de-
sign, cable potheads and isolating transformers and, whereas, said electrolier
standards, cable potheads and isolating transformers are copyrighted and patented
articles and manufactured under United States patents held by, or controlled by
Westinghouse Electric & Manufacturing Company;
NOW THEREFORE, in consideration of the specification by the City Council
of said City of such cepyrighted and patented articles in the plans and specifications
for such system of electroliers, this Company grants unto said city the right to
install, use and maintain said copyrighted ~nd pstented articles upon public
streets of s~id city and in connection with its said lighting system;
And this Company further agrees~ar~ promises th~.'t, in connection therewith, it
will sell to said city or to the contractor to whom the contract fOr the installation
of s~id system is awarded or to the property owners, in the event of their electing
to take the contract for the installation of said system pursuant to the provisions
of said improvement act, the required number of Such electrolier standards

~,~t the usual customary market price prev~ing in the City and County of San Francisco,

The present market ~.rice is as follews:

each, freimht allowed to South San Francisco, C~lifornta.

The only chr~uge which N~y be made therein will be made on account of change
in the open ~arket price to the n~anufacturer of unpatented N.aterial entering
into the quoted article, or r~ade on account of change of cost of freight
between Sou_th Sa.n Francisco ~nd the place of m~nufacture, ~nd such changes will
be proportionate to, ~nd not unduly increased above the change in the cost
of ~nufacture c~used thereby. In ~ny event, no change in price will be
n~.ade v]ithin si~ months from date.
