HomeMy WebLinkAboutReso 421-1932392 A RESOLUTION OF THE CITY COUNCIL OF THE CITY 0~' SOUTH SAN FRANCIYC0 DECLARING THE POLICY OF SAID CITY AS TO SALT MARSH TIDE AND SUBMERGE LANDS OWNED BY THE CITY 01~ SOUTH SAN FRANCISCO. WHEREAS; by an act of the Legislature of the ~tate of California entitled "An act granting to the city of South San Francisco the salt marsh, tide and sub- merged lands of the State of California, including the right to wharf out therefrom to the City of South San Francisco and regulating the management, use and control there- of," approved April 10, 1925. Statutes and Amendments to the Codes of California, 1925. there ~as granted to the City of South ~an Francisco, a municipal corporation of the State of California, all the right, title and interest of the State of Calif- ornia, held by virtue of its sovereignty, in and lo all the salt marsh, tide and sub- merged lands whether filled or unfilled, within the boundaries of said city then ex- isting, and situate below the line of mean high ~ide of the Pacific Ocean. or of any harbor, estuary, bay or inlet within said boundaries, to be forever held by said city. and by its successors~ in trust for the uses and purposes, and upon the express conditions following, towit; That said lands shall be used by said city and its successors, solely for the establishment, improvement and conduct of a harbor, and for the construction, maintenance and operation thereon of wharves, docks, piers. slips, quays, and other utilities, structures'and appliances, necessary or convenient for the promotion and accommodation of commerce and navigation; and WHEREAB it is one' of the purposes of said act to promote and accommodate commerce and navigation: and WHEREAS all the rights of said city with respect to the land referred to in said act are derived through said act; ~ RESOLYED by. the City Council of the City of South San Francisco that said City of South ~an Francisco hereby recognizes that that certain Ship canal now existing in tide lots 31 and 32 in Sec. 15, T, 3 South R. 5 West. M. D.B. & M. and in tide lots 20. 21, 22, 2Z, 24,~;~25and 26. in Sec. 14, T. 3 South, R. 5 West, ~. D. B. & M., San Mateo County, California, is navigable water and that said ship canal has been used for the purposes of commerce and navigation continuously since its establishment in 1917, a date more than seven (?) years prior to the passage of the above entitled act, and here- by declares that it is the policy of said City of South San Francisco to protect the navigable waters serving the industries of said city and to foster and encourage commer- cial and industrial development in said city, and that said city will not obstruct-, or permit the obstruction of the entrance 1~ said ship canal by reason of any rights which said city may havein or to any land referred to inthe above entitled act. .,-,-,-,-,-,-,-,-,-,-,-,- .I hereby certify that the foregoing resolution was regularly introduced and adopt- ed by the City Council of the City of South San Francisco, this 19th day of December, 19ZY, by the following vote: Ayes, Councilmen ¥.
