KNOW ALL MEN BY THESE PRESENTS: That California Water Service Company, a corporati on, for and in consider- ation of the transfer by the City of South San ~raucisco, a municipal corporation in the County of Ssn ~ateo, State of CaliforniA, of all the right, title and interest of said municipal corporation in and to all pipes connecting the hydrants, now owned by said municipal corporatic~ and located at the places hereinafter mentioned, with the water mains to which said hydrants are respectively connected, does hereby release and forever discharge said City of South San ~raucisco from the payment to said California Water Service Company of the sum of Twenty-six and twenty-five and SE/100 Dollars The hydrants owned by said municipal corporation and the pipes connecting the same with Water mains of said California Water Service Company are located at the places in said City of South San ~rancisco designated as follows: Railroad Avenue between. W~ERF.~S said party of the first part is the successor in int- erest of said Pacific Water Comp_~_ny as to the sum of $2625.88 the same being the unpaid portion of the cost of labor and material for connecting the above and other hydrants in the City of South San Francisco; and WHEREAS said party of the first part and said party of the second part desire to adjust said indebtedness in the manner hereinafter provided amd such adjustment will be beneficial to said party of the first part and will render unnecessary any further expenditure of funds by said party of the first part to discharge said indebtedness and, in the opinion of said party of the first part, the value of the property which said party of the first part has proposed and now proposes to transfer to said party of the second part, under the terms of this agreem~t is not greater than aaid sum of Twenty-six Hundred and TWenty-five and 88/100 Dollars ($2625.88}; NOW~ THEREEORE, this agreement witnesseth as follows: 1. Said party of the first part, in consideration of the prom- ises and covenants and agreements on the part of said party of the second part herein contained, promises and agrees to and with said party of the second part that said party of the first part will transfer and convey to said party of the second part all the right, title and interest of said party of the first part in and to all pipes connecting the hydrm~ts, owned by said party of the first part and located at the places hereinbefore men- tioned, with the water mains to which said hydrants are respectively connected. 2. It is further agreed by and between the par~ies hereto ~hat this agreemen~ shall not be construed as providing for the trensfer of any interest of said party of the first part in or to any one of said hydrants and that all said hydrants now are and shall hereafter continue to be the property of said party of the first part. IN WITNESS WHEREOF said party of the first part has caused its corporate n~ne to be hereunto subscribed by the l~esident'of the City Council of said City ~f South San Francisco and its corporate seal to be hereunto affixed by its City Clerk, first thereunto duly authorized by a resolution adopted by the City CounCil of the said City, and said party ef the second pert has caused its corporate name to be signed hereto and its corporate seal to be affixed by its proper officers, first thereunto duly authorized, all as of the day and year first above written.
