A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTH SAN FRANCISCO AUTHORIZING THE EXECUTION
OF AN AGREEMENT BETWEEN THE CITY OF SOUTH SAN
FRANCISCO AND THE COUNTY OF SAN MATE0 WITH
RESPECT TO COLMA CREEK AND BADEN CREEK.
wHEREAS the County of San Nateo has confined the waters of that part of Colma
Greek lying westerly and northerly and upstream from the corporate limits of the City of
South San Francisco by the construction of a rubble lined canal and other appurtenant
structures; and
WHEREAS said structures have accelerated the rate of flow of said Colma Creek
by providing a steeper, shorter and smoother channel that is free from the tortuous
windings of the old channel; and
W~REAS said structures have increased the amount of flow of said Colma Creek
by reducing the amount of seepage from the channel; and
WHEREAS the silt carried by said waters is deposited on and over the lower
portion of the structures and on lands adjacent and downstream therefrom; and
WHEREAS the grade line of said structures is below the bed of the channel from
satd~ structures easterly or downstream; and
WHEREAS said Colma Creek has not, at the present time, a proper outlet from
said structures; and
WHEREAS the City of South San Francisco has adopted final plans for the
extension of said canal easterly, together with the plans for such other structures as
are necessary for confining the waters of said Colma Creek and Baden Creek; and
WHEREAS public interest and convenience require the construction of t he work
and improvements that are shown on the said plans; and
WHEREAS it will be mutually advantageous to said County of San Mateo and said
City of South San Francisco to Jointly assume responsibility for such money for said
project as will not be furnished by the Works Progress Administration; and
WHEREAS it is believed that the money necessary for said project in excess
of the sum of $30,000.00 can be procured from the Works Progress Administration upon the
condition that the costs of said project in an amount to exceed $30,000 shall be borne by
said County of San Mateo and said City of South San Francisco if said City of South San
Francisco shall sponsor said project; and
~GtEREAS all the ater shed of said Colma Creek and Baden Creek lies within said
County of San Mateo and approximately 90% of said water shed lies without the boundary
lines of the City of South San Francisco, and approximately ten per cent of the area
drained by such creeks lies within said City of South San Francisco; and
WHEREAS the just proportion of the cost of said project to be borne by said
County of San Mateo is not to exceed $2V,000.00 and the just proportion of said project
to be borne by said City of South San Francisco is not to exceed $3000.00;
NOW, THEREFORE, RESOLVED by the City Council of the City of South San

County of San Mateo is not to exceed $27,000.00 and the just proportion of said project
to be borne by said City of South San Francisco is not to exceed $3000.00;
NOW, Tt-JEREFORE, RESOLVED by the City Council of the City of South San
Francisco as follows:
1. That said City of South San Francisco make application to the Works
Progress Administration for such an amount of money as such Works Progress Administration
~_~_y allot for the performance of said work, and that said City of South San Francisco
shall sponsor, under the regulations provided by said Works Progress Administration,
and agree to furnish money toward the costs of said work in an amount equal to 10% of
the cost which shall not be provided for by said Works Progress Administration, but
not exceeding the sum of $3000.00; it being understood that, in no event, shall the
obligation of said City of South San Francisco, with 'respect to said work, exceed the
sum of $3000.00.
2. Sai'd City of South San Francisco shall enter into an agreement with said
County of San Mateo, in accordance with the terms of this resolution, for the purposes
of carrying out the provisions of this resolution.
3. A fund to be known as "Colma Creek Drainage Fund" is hereby created and
the sum of $3000.00 is hereby appropriated and allocated to s aid fund. Disbursements
from said sum of $3000.00 shall b e made in the manner provided by law, and disbursements
shall als° be made from any sum or sums of money which shall be transferred to said City
of South San Francisco by said County of Sari Mateo, aud placed in said fund, for demands
properly chargeable and pertaining to the work as indicated in the plans, specifications
and project application.
4. Said City of South San Francisco shall, not later than the 10th day of
each month, make demand upon said County of San Mateo for money sufficient to pay the
demands which may be anticipated on account of said work by said City of South San
Francisco for the succeeding month.
5. On completion of said work, said City of South San Francisco shall render
to said County of San Mateo a full, true and correct statement and report o£ the
expenditures made out of said "Colma Creek Drainage Fund" in connection with the
performance of said work.
6. The Mayor of said City of South San Francisco and the City Clerk are
hereby authorized and directed, on behalf of said City of South San Francisco, to
execute with s aid County of San Mateo the agreement herein authorized.

I hereby certity that the foregoing resolution was regularly introduced
and adopted by the City Council of the City of South San Francisco this 15th day of
July, 1955, by the following vote:
