OF AGRE~IENT WITH COUNTY OF SAN

WHEREAS it will b e mutually advantageous to the City of South
San Francisco and the County of San Mateo to co-operate in the perfo~m~ance of
the work of straightening and confirdn~he portion of Colma Creek and the
portion of Baden Creek shown upon the plans adopted for said work by the City
Cottucil of the City of South San Francisco on the 6th day of May, 193§, and
a foEn of agreement for that p~ose has been executed on behalf of said
Cotunty of San Mateo.
RESOLVED by the City Council of the City of South San Fran-
cisco that said City of South San F~ancisco enter into said agreement.
The Mayor of said City and the City Clerk a~e hereby author-
ized and directed in the name of said City of South San F~ancisco, aud under
its corporate seal, to execute said agreement.

I hereby certify that the foregoing resolut~ion was regularly
introduced and adopted by the City Cottucil of the City of South San Francisco,

CITY OF SOUTH SAN FRANCISCO with COUN~Y OF SAN MATE0
THIS AG~EE. MENT, made this 24th day of February, 1936, between the City
of South San Francisco, a municipal corporation in the County of San Mateo, State of
California, the pa~ty of the first part, and said County of San Mateo, the party of the
second part, WITNESSETH:
WHEREAS the City Council of the City of South San Francisco has adopted
plans £~or confining the waters of Colma Creek and Baden Creek, in said City of South
San Francisco, and otherwise relocating and improving the channels thereof; and
WHEREAS public interest and convenience requL~e the construction of the
work and improvements that are shown on the said plans; and
WHEREAS it will be mutually advantageous to said County of San Mateo
and said City of South San Francisco to Jointly assume responsibility for such money
for said project as will not be furnished by the Works Progress Administration; and
WHEREAS said City of South San Francisco has sponsored said project, and,
upon application of said City of South San Francisco, the Works Progress Administration
has alloted, for the performance of said work, money in approximately the sum of Ninety-
eight Thousand ($98,000.00) Dollars; and
WHEREAS all the water shed of said Colma Creek and Baden Creek lies within
said County of San Mateo and approximately 90% of said water shed lies without the bound-
ary lines of the City of ~South San ~Francisco, and approximately ten per cent of the
area drained by such creeks lies within said City of South San Francisco ;and
WHEREAS the Just proportion of the cost of said project to be borne by
said County of Sau Mateo is not to exceed Twenty-seven Thousand ($27,000.00) Dollars
and the Just proportion oft he cost of said project to be borne by the City of South
San F~ancisco is the cost of the engineering services heretofore incurred and here-
after to be incurred, in connection with said work;
NOW, THEREFORE, said parties, in consideration of their mutual covenants
herein contained, hereby agree as follows:
1. Said party of the first part shall, as sponsor, under the regulations
provided by said Works Progress Administration, furnish a civil engineer to supervise
the construction of said work and pay all engineering costs in connection therewith,
including all costs and expenses of said project heretofore incurred;
2. Said pa~ty of the second pa~t agrees t~ pay all other construction
costs of said project in excess of the ~nount of money alloted to said project by said
Works Progress Administration, but not exceeding the sum of Twenty-seven Thousand
( $27,000.00 ) Dollars;
3. The money in said "Colma Creek Drainage Fund" heretof~e created
by said pa~-~y of the second part, shallbe paid to persons furnishing labor and
materials for said project upon claims p~esented by such persons and upon the
approval of the same by the County Engineer and the Board of Supervisors of said
County of San Mateo, as required in the progress of said project;
4. It is furhher agrees by and between the parties hereto as follows:
(1) The sequence of said work shall b e under the direction of the County
Engineer of said County of San Mateo;
(2) Wherever possible, said County of San Mateo may furnish for use upon
said project any equipment now owned or hereafter to be acquired by said County
of San Mateo, and said County of San Mateo shall b e credited upon said sum of
Twenty-seven ThoUsand Dollars ($27,000e00) for the reasonable value of the use
of such equipment·
(~) ~he furnishing of all equipment and t~he rates of compensation for the
same, and the duration of the use of such equipment and the operating personnel
thereof shall be under the direction of said County Engineer;
(4) The purchase of all materials necessary for said project, not furnis~d
by the Works Progress Administration, shall first be approved by said County
Engi ne e r;
(B) The requ~itioning and re-assigning of Works Progress Administration
relief workers shall be approved by the County Engineer, before the same shall
be made;
(8) Copies of all reports made to the Works Progress Administration and
to the Treasury Depa?tment of the United States shall be furnished to said
County Engineer, and said County Engineer shall, at all times, have acess
to all books and records kept and made in connection with said project;
(7) All skilled labor, ~he Superintendent of said work, end all fore-
men shall be employed by the City Council of the said City of South San
Francisco, but shallbe paid for by said party of the second part.
IN WITNESS WHEREOF, said party of t he first part has caused its cor-
porate seal to b e affixed by its City Clerk, first thereunto duly aUthorized,
and said party of t he second part has caused its name to ~e subscribed by the
Chairman of the Board of Supervisors of t he County of San Mateo and the seal
of said Board of Supervisors of the County of San Mateo to be affixed hereto
by the Clerk of said Board, first thereunto duly authorized, all as of the
day and year first above written.
