HomeMy WebLinkAboutReso 546-1936RESOLUTION ?ROVIDING FOR A~ND~iENT OF LEASE BET~VEEN CITY OF SOL~I~H SAN FRANCISCO AND G. H. THO~SON ~VHEREAS the City of South San Francisco, as lessor, and G. H. Thomson, as lessee did, on the 18th day of April, 1932, enter into a lease, bearing that date, wherein said City of South San Francisco let and demised unto said G. H. Thomson certain ~ belonging to said City of South San Francisco, for the purpose of erecting, maintaining and operating an electric sign thereon; and V~REAS said G. H. Thomson has assigned said lease to South San F~ancisco Sign Co.; and Wt~EREAS said City of South San Fraucisco and said South San Francisco Sign Co. desire to change certain of the terms of said lease; NOW TP~EREFORE, resolved by the City Council of the City of South San Francisco that paragraphs I and 5 of said lease be amended as follows: Paragraph 1 of said lease shall be smended so that said paragraph 1, as amended, shall read as follows: 1. That said premises hereby leased are to be used and occupied by said lessee for the purpose of erecting, maintaining and operating an electric sign, and sign of painted letters thereon, and for no other purpose, except such purposes as are incident to the erection, maintenance and operation of said sign. The word "sigh" as used herein, shall include the structure to be erected by said lessee for the purposes of displaying illumin- ated and painted letters and other illuminated and painted characters, as well as all equipment used on connection therewith. Paragraph 5 of said lease shall, as amended, read as follows: 5. On any sign constructed and operated on said land, under the provisions of this lease, on which advertising matter may be displayed by said lessee in characters illuminated with the aid of electricity alone, or in combination with any gaseous or solid material, there shallbe displayed in letters illuminated by electricity, during one-seventh (l/V) of the dark portion of each night throughout one hundred and eighty- two days (l$2),consecutive, or otherwise, of each year during whiah said sign may be operated, the expression "South San F~ancisco", and some otl~er brief expression de- signed to advertise South San Francisco, which expression shall be selected by the lessor, in one or two lines of letters extending for the greater part of the length of the sign. The Name "South San Francisco" shallb e displayed in a single illuminated flash and such other brief expression, herein provided for, shall be displayed in an- other illuminated flash. The letters or characters to be displayed shall be equal in size to the illuminated letters which shall be use~. for other advertising purposes on such sign at night and the illumination of such letters shall be equal in intensity to the illumination of such other letters. This lease shall become void in the event of the failure of said lessee to strictly comply with the provisions of this paragraph, except as t~ereinafter expressly provided. A new paragraph shall be added to said lease which shall read as follows: Said lessor shall not let any advertising privilege upon said sign for any commodity of the class or character of any commodity for which said lessee may at any time be in the process of displaying advertising. The Mayor of said city and the City Clerk are hereby authorized and directed, in the name of said City of South '~an Frm~cisco and under its corporate seal, to execute an agreement for the purpose of amending said lease in accordance with the provisions of this resolution. --O-O-O-O-O-O-O-O-- I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco this 6th day of May, 1908, by the following vote: Ayes, Councilmen V.
