RESOLVED by the city council of the city of South San FX~mcisco that public interest and convenience require the following public improvement work to be d one in said city, to-wit: The construction of a tennis COUX't on the park at Orange Avenue in the City of South San F~anciscoe All work shall be done to official g~ade ~d .at the location shown upon the plans hereinafter mentioned and strictly in accordance with the plans and the pax-t- ieula~ specifications, hereto£ox~ adopted, which specifications cox~espond to the bid which may be accepted by said city council, for the particular type of. const~uct- ion included in such bid. All such work and the materials used in connection there- with shall be furnished under the direction and to the satisfaction of the city engineer of said city. . The city clerk is hereby directed'to'cause a notioc'inviting sealed'pro- posals for doing said work .an~ for the furm/shing of all materials neoess.a.x~y, there- for to be published by two (2) insertions thereof, and not les~ than five (5) days apart, in WThe Enterprise" and The South San Francisco Jourmal"~ a newspaper of general circulation published and printed in the city of South San F~ancisoo, which notice shall be substantially in the following form: NOTICE INVITING SEALED PROPOSALS OR BIDS POR THE CONSTRUCTION OF A TENNIS COURT ON THE PARK AT ORANGE AVENUE IN THE CITY OF SOUTH SAN I~RANCISCO. NOTICE IS HEREBY GIVEN that sealed proposals or bids will be received by the city council of the City of South San F~ancisco on the 20th day ef December, 19~7, until the hour of 8:00 o'clock p. m. for doing the following pt~lic work in said city, to-wit: . The construction of a tennis c~urt on the park at Orange Avenue in the City of South San Francisco, at the location shown upon the plans forming a part of the plans and specifications hereinafter mentioned. The specifications adopted by said city council for said work provided for four (4) different types of tennis coat, ts on a macadam base pavement. Ail bidders are requ,ated to bid on each type of tennis coua-t mentioned in said specifications. At the time when.the bids, hereby invited, shall be opened, said city council will decide upon the type of tennis coumt to be constructed and, if said city council shall decide to accept a bid for such type of tennis court~ a contract will be awarded accordingly therefor. Ail the work of constructing such tennis court shall be done to official grade and at the location shown upon the plans for said work and strictly in accord,nco with the plans and. the particular specifications correspond- ing to the type of tennis court which said city council shall decide to constx-uct and included in the bid which said city council may accept. Ail such work and the materials used in connection therewith shall be furnished under the direction and to the satisfaction of the city engineer of said city. The contractor shall forfeit as a penalty te the City of South San Francisco Ten Dollars ($10.00) for each laborer, workman or mechanic employed, for each calendar day,. or portion thereof, such lab'orer, workman c~ mechanic is paid less .than the said stipulated rates for any work done under said contract, by him, or by any sub-contractor under him. And such contract shall contain a stipulation to this effect, in accordance with the provisions of Chapter 397 of the Statutes of California, 1931. No bid will be accepted from a contractor who has not been licensed in accordance with the provis$.ons of an act of the LegiSlature of the State of California, entitled: eAu act providing for the registration of contractOrs, and defining the te~m contractSr; providing the method of obtaining licenses to en- gage in the business of contracting, and fixing the fees for such licenses; pro- viding the method of suspension and cancellation of such licenses; and pre- scribing the-punishment for ~iolation of the provisions of this act.e Chapter Vgl of Statutes and Amendments of 1929, as amended. NOTICE IS FURTHER HEREBY GIVEN that no person, firm, partnership, association, or corporation, or_agent thereof, doing any of the work herein provided for, as a contractor, or sub contractor, sBall knowingly'employ, or c~use or allow to be em- ployed thereon any alien, except in cases of extraordinary emergency caused by fire, flood, or danger to life or property. 'The successful bidder shall, within ten (10) days, after the a amid, enter into a contract with the City of South San Francisco for the faithful pex~orm- anco of the work tc b e done under said award, Ail sealed proposals or bids shall be accompanied by a check payable to the city of South San Francisco, certified by a responsible bank for an amount which shall not be less than ten (10) percent of the aggregate of the proposal, or by a bond for the said amount and so payable, signed by the bidder and two (2) sureties who shall Justify before any officer competent to adminis~cer an oath in double said amount over and above all statutory exemption~.' If the px~posal be accepted' and the. contract awarded and if the bidder shall fail and neglect to execute a ~ont~ac~ and give the conds requi~ed, the sum mentioned in said check, c~ the principal sum of said bond, as the case may be, shall be liquidated damages for' such failure and neglect and shall be forfeit*ed to and paid into. the treasux-y of the City .of South San l~mancisco.
