HomeMy WebLinkAboutReso 665-1938 No. 665 RE~OLUTION ORDERING THE CONSTRUCTION OF SEWERS IN THE CITY PARK ADDITION IN THE CITY OF SOUTH SAN PRANCISCO RESOLVED'by the city council of the city of South San Francisco that public interest and convenience require the following public improvement work to be done in sa: city, to-wit: The construction of sanitary ~ewers in the City Park Addition. All work shal~ be done at the location shown upon the plans hereinafter menti, and strictly in accordance with the .plans and specifications, heretofore adopted for su~ work. Ail such wor~ and the materials used in connection therewith shall be furnished under the direction and to the satisfaction of the city engineer of said city. The contract must be entered into in compliance with and subject to the conditions ~mposed by Section 653c of the Penal Code of the State of California. Such contract shall con~ain a stipulation which shall provide that the contractor to whom .said contract is awarded shall forfeit as a penalty 'to said city of South ~an F~ancisco Ten Dollars ($10.00) for each Nabob- er, workman, or mechanic employed in the execution of said contract, by him, or by any sub- contractor under bfm, upon any of the work herein mentioned, for each calendsm day du~ing which such laborer, owrkman or mechanic is required or permitted to labor more than eight (8) hours in violation of the provisions of Section 653c of the Penal Code of the State of Californiae The contract to be awarded shall contain a further stipulation that the con- tractor, to whom such contract may be awarded, shall use or supply only such unmanu- factured articles., materials,a~d supplies as may have been mined or produced in the United States and only such manufactured articles, materials, and supplies-as have bee manufactured in the United States, substantially from all articles, materials or supp] mined, produced, or so _m__~nufactured, as the case may be, in United States, excepting only where such articles, materials, or supplies of the class or kind to be used, or t articles, materials or supplies from which they are manufactured are not mined, produc or manufactured, as the case may be in United States, as required by an act of the Legislature of the State of California entitled: "An act to require the use of materia and supplies substantially produced in the United..States, in public works and ~or publ purposes;" Chapter 226 of the Statutes of California, 1933. T~e successful bidder shall, within ten (10) days, after the award, enter into a contract with the ity of South San Francisco for the fai~hful performance ~f t~ work to be under said awax~. Ail sealed proposals o~ bids shall be accompanied by a check payable to the City .of South San F~anc~isgo, certified by a ~esponsible bar~ for an amount which shall not be less than ten tl0~ percent of the aggregate of the pro- pos. al, or by a bond for the said amount and so payable, signed by the bidder and two (2) Sureties who shall Justify before any officer competent to administer an oath in Aouble said amount over and above all statutory exemptions. If the proposal be accept, and the contract awarded and if the bidder shall fail and neglect to execute a contrac~ and give t~e bonds required, the sum mentioned in said check, or the principal sum of said bond, as the case may be, shall be liquidated damages for such failure and neglec~ and shall be fo~eited to and paid into. the treasury of the City of South San Francisco. The bidder to whom the contract is awarded will be required to execute a bond for the faithful performance of his work in an amount equal to fifty (~0) per cent of the amotu of the undertaking with at least two (2) responsible sureties in the full amount of th~ bond each; and will also be required before entering upon ~he work to furnish a good a~ sufficient bond, as required by an act of the Legislature of the State of Caltfornia,~ approved May 10, 1919, entitled. An act to secure the payment of the claims of perons employed by contractors upon public works and the claims of persons who furnish materials, supplies, teams, _~mplements or machinery used or consumed by such contracto~ in the perfox~nance of such works, and prescribing the duties of certain public officer~ w~ith respect thereto~, Chapter 305, of the Statutes of California, 1~1~ ~lans, specifications and proposal sheets may be obtained at the office of George A.
