KESOLC~ION PEKMITTING THE CONSTKUCTION
SID1~AL~ ON A PORTION OF THE BAYSH(RE HIGHWAY
RESOLVED by the city councll of the City of South San Francis co that per~.ss.ion b.e., .
and the same hereby is g~anted to the owners of the la=l fronting upon. the .wes~er-,y. si~e or the Bay
Sho~e Highway between the north llne of Armou~ Avenue and the ,south line of Linden Avenue~
in said City of South 3an l~ancisco~ to construct sidewalk along said portion of said Bay
Sho~e Highway, and to the owners of tho land fronting upon the westerly side of Baysho~e
Highway between the north llne of Livz!en Avenue and the south line of Chapman Avenue,, in
said city, to construct sidewalk, curb and gutter along said last mentioned portion of Bay-
shore HighwaY. All such sidewalk, curb and gutter must be constructed in strict accordance
with the plans and specifications heretofore adopted for said work and now on file in the
office of the .city clerk of said city and under the supervision and to the satisfaction of
the city engineer of said city.
In the contract 'between said owners and the contractor, who shall be employed by them,
said contractor shall agre. e as follows:
Any laborer,workman or mecb_-~ic employed at any time by the contractor, or by any sub-
contractor under him upon the work, or upon any paint thereof, cannot be required or permit,t-
ed to work thereon more than eight (8) hours in any one calendar day, except in case of ex
ir,me emergency by fire, flood~ or danger to life or p~ope~ty, and the contractor hereby
agrees to .forfeit as a penalty to the city of South San F~anoisoo, urger the terms of this
agreement, the sum of Ten Dollars ($10.00) for each laborer workman, or mechanic employed
in the execution of said contract, for .eaqh and every calendar da~ during whioh_m,y such
mechanic, Wo~knmn or la~or6r is 'required or permitted to labor more than eight (8) hours
in violation of the p~ovisions of Article 3 of the Labor Code of the State of California.
Said contractor shall keep fully informed of all existing and future state, national
and municipal laws, ordinances__x-~les and regulations affecting in any manner the work
herein provided fo~ or the wor~_ en employed thereon, or in any way affecting the conduct
of the work or any authority or body, or tribunal or authority having any Jurisdiction
or any authority over said work.
Said contractor agrees to carry Workmen's Compensation Insurance to fully p~otect
.the interests of said contractor and that of said owners against any damage suits which
may be brought by workmen on account of any accident upon or around the place where the
work is going on. This policy s~all be in conformity with the Uorkmen's Compensation
Insurance and Safety Act of the State of California. If the contractor shall fail or
neglect to effect and keep in force such insumanoe, the said owners may procure such in-
sumance upon all workmen employed upon or in connection with the construction of the work
herein provided for and may deduct f~om the amount to ~ecome due under the tea,ms of this
contract any sum or sums of money which they ~_~y pay as pr~nium for such insurance..
Said city council hereby determines that the prevailing rates of per diem wages and
the general prevailing rates for legal holiday and overtime work applicable to said work
are as follows:

The rate for any e~ployee not listed in the above schedule s~all not be less than
$1,10 per hou~ for skilled labor, or $.80 for intermediate labor and $.75 for unskilled
labor.

ated rates for any work done under this contract by said con~racto~, or by any subcontract-
or who may be engaged in said worko
Said contractor agrees that no person, firm~ partnership, association or corporation,
or agent thereof~ doing any of the work herein provided for, as a contractor, or subcon-
tractor, shall knowingly employ, or cause or allow to be employed thereon any alien, ex-
cept in cases of extraordinary emergency caused by fire, flood or danger to life or prop-
erty.
Said contractor s~ell forfeit as a penalty to said City of South San Francisco Ten
Dollars ($10000) for each alien knowingly employed in the execution of such contract by
him, or by any subcontractor under him for each calendar day, or portion thereof, during
which such alien is permitted or required to labor in violation of the provisions · of
Article 4 of the Labor Code of the State of Caltforalao
Said contractor agrees that he will use or supply on such unmanufactured articles,
materials, and supplies as may~ have been mined or produced in the United States 'and
only such manufactured articles, materials, and supplies as have been manufactured
in the United States, substantially from all a~ticles, materials or supplies mined,
duc.d, or so manufactured, as the case may be, in the United States, excepting only
where such articles, materials or supplies of the kind or class or the articles,
materials or supplies from whic~ t~ey are manufactured are not mined, produced or manu-
factured, as the case may be, in the Unite? States. as requi~ed by an act of the Legis-
lature o~ the State Of California entitl$~. "An act to require the use of materials and
supplies substantially produced in the United States, in pUblic work and for public
purposes~; Chapter-226 of the Statutes of California, 1933e
IT IS FURTHER REBOLVED that, before such contractor shall be permitted to common
the performance of wuch work~
1.The consent of the Division of Highways~ Department of Public Works of the Sta
of California, must be obtained for said work;
2. Such contractor s~all ex, cute to the City of South San Francisco a bond in
penal sum of not less than fifty (50) percent of the total cost of said.work, as
determined by the city engineer of said city;
3. Such contractor shall file in the office of the city clerk evidence to show
that he ca~ries Workmen's 0ompensation Insurance to protect the interests of such con-
tractor and said owners with respect to t~e claims of workmen who may become injured i
the performance of said work;
4. Such contractor shall file in the office of the city clerk evidence to show
that he carries in full force a policy of insurance covering public liability and
property damage which may be occasioned in the performance of said work.
I hereby certify that the foregoing resolution was regularly introduced and
adopted by the city council of the city of South San Francis. co, this 27th day of
