HomeMy WebLinkAboutReso 767-1940266 RESOLUTION ORDERING THE PAINTING OF THE EXTERIOR OF THE CITY HALL ~ND CERTAIN ROOMS WITHIN THE CITY PLaLL IN THE CITY OF SOUTH SAN FRANCISCO. RESOLVED by the city council of the City of South San Francisco that public interest and convenience require the following public improvement work to be done in said city, to-wit: The painting of the exterior of the city hall, the conference room, chambers of the city Judge, chambers of the Justice of the peace, offices of the police department, city qlerk's office, the office of the chief engineer of the fire department and city engineer, the chamber of commerce room, and the toilets on the first and second floors ~f ~aid city hall. All work shall.be done in accOrdance with the specifications heretofore adopted for said~ork. All such work and materialw used in connection therewith shall be furnished under the direction and to the satisfaction of the building inspector of said city. The said city council hereby ascertains that the general prevailing rates of per diem wages and the general prevailing rates for legal holidays and overtime work applicable to said work to be done~ are as follows: CLASSIFICATION RATE PER HOUR. Painters $1.25 Overtime Work will be double the abOVe rate. double the above rate e Sundays and holidays (except watchmen) The following are to be considered holidays: New Year's Day, Decoration Day, In- dependence Day, Labor Day, Admission Day, Thanksgiving Day, Christmas Day, Saturdays and Sundays. The city clerk is hereby directed ~ cause a notice inviting sealed proposals for doing said work to be published by two (2) insertions therof, and not less than five (5) days apart, in "The Enterprise", a newspaper of general circulation published and pr~zuted in said City of South San Francisco, whic~ notice shall be substantially in the following form: NOTICE INVITING SEALEO PROPOSALS OR BIDS FOR THE PAINTING OF THE EXTERIOR OF THE CITY HALL AND CERTAIN ROOMS IN SAID CITY HALL. NOTICE IS HEREBY GIVEN THAT sealed proposals or bids will be received by the city council of the City of South San Francisco on Monday, the 5th day of August, 1940, until the hour of 8:00 o'clock p.m. for doing the following public work in said city, to-wit: ~he painting of ~he exterior of the city hall, the conference room, ch.ambers of the city Judge, chambers of the justice of the peace, offices of the police department~ city clerk's office, the office of the chief engineer of the fire department and city engineer, the Chamber of Comerce room, and the toilets on the first and second floors of said city hall. It shall be mandatory upon the contractor to whom the contract is awarded, and ~ryaaubcontractor under him, to pay not less than the specified rates to all laborers, work- men and mechanics employed by them in the e~ecution of the contract. The contractor shall forfeit as a penalty to the City of South San Francisco Ten Dollars ($10.00) for each laborer, workman or mechanic employed, ~for each claendar day, or portion Ohereof. such laborer, work- under the direction and to the satisfaction of the building inspector of said city. And such contract shall contain a stipulation to this effect, in accordance with the provisions of section 1778 of the Labor Code of the State of California. No bid will be accepted from a contractor who has not been licensed in accordance with the provisions of an act of the Legislature of the State of California entitled "An act providing for the registration of contractors, and defining the term contractor; providing the m~thod of obtaining licenses to engage in the business of contracting, and fixing the fees for such licenses; and prescribing the punishment for violation of the provisions of thAs act." Chapter 791 of the Statutes and Amendments of 192~, as amended. NOTICE IS FURTHEE HEREBY GIVEN that no person, firm, partnership, association, or corporation, or agent therof, doing any of thw work herein provided for, as a employed thereon, sny alien, exe~pt in cases of extraordinary emergency caused by fire, flood, or danger to life or property. The pontractor, to whom the contract for said work may be awarded, shall forfeit as a penalty to the City of South San Francisco Ten Dollars ($10.00) for each alien knowingly employed in the execution of such contrac$ by him, or any subcontractor under him, for each calendar day or portion thereof, during which such alien fs permitted or required to labor in violation of the provisions of Article 4 of the Labor Code of '~he State of California. The contract must be entered into in compliance with and subject to the con- ditions imposed by Article ~ of the Labor Code of the State of California. Said contract shall contain a stpulation which shall provide that thecontractor to whom said contract isawar~ed shall forfeit as a penalty to the said City of South San Francisco Ten Dollars ($10.00) for each laborer, workman or mechanic employed in the e~ecution of said contract, by him, or by any subcontractor under him, upon any of the work herein mentioned, for each calendar day duming which suc~ laborer, workman or mechanic is required ~ permitted to labor more than eight (8) hours in violation of the provisions of Article 3 of the Labor Code of the State m£ California. The contract to be awarded shell contain a fUrther stipulation that the contractor, to whom such contract may be awarded, shall use or supply only'such unmanufactured articles, materials and supplies as may have been mined or produced in the United States and only such manufactured articles, materials, end supplies that have boen manufactured in the United States, substantially from all articles, materials or supplies mined, produced, or so manufactured, as the case may be, in the United States, excepting only where such articles, materials, or supplies of the class or kind to be used, or the articles, materials, or supplies from which they are manufactured are not mined, produced or manufactured, as the case may be, in the United States, as required by an act of the Legislature of the State of California entitled: "An act to require the use of materials and supplies suh- stantially produced in the .United States, in public works and for public purposes'"; Chapter 226 of the Statutes of California, 1933. The successful bidder shall, within ten (10) days, after the award, enter into a contract with the City of South San F~ane&sCo for the faithful performance of the work bo be done under said award. All sealed proposals or bids shall be accompanied by a check pay~a~e to the City of South ~an Francisco, certified by a responsible bank in the state of California for an amount which sha~l not be less than ten (10) per cen of the aggregate of the proposal. If the proposal ~e aceepted and the contract awarded and if the bidde~ shall fail and neglect to execute a contract and give the bond required, thesum mentioned in said check shall be liquidated damages for such failure and neglect and shall be for- feited to and paid into the treasury of the City of South San Francisco. The bidder to whom the contract is awarded will be required to execute a bond for the faithful perforcnance of his work in an amount of the undertaking with at least two (~) responsible sureties in the full amount of the bid each; and will also be~ required, before entering upon the work, to furnish a good and sufficient bond, as required by an act of the Legislature of the State of California, approved May 10, 1919, entitled: '~An act to secure the payment of the claims of persons who furnish ~aterials, supplies, teams or implements or machinery used or consumed by such contractor in ti~e performance of such works, and prescribing the duties of certain public officers with respect thereto", Chapter 603 of the Statutes of California, 1919. Specifications £or said work may be obtained at the office of the city clerk in said city hall in said City of South San Francisco. Sealed proposals or bids will be delivered to the city c~erk on or before 8:00 o'clock p.m. on Monday, the 5th day of August, 1940. All sealed proposals are to be opened by said city council in'public session on Monday, the 5th day of August, 1940, at 8:.00 o' clock p.m. in the council chamber of said airy council.
