RESOLVED by the City Council of the City of South San ~'rancisco that p~blic interest
and convenience require theft said city should purchase four .thouSand fA,O00~ cubic yards 'of ~
crusher run r~ok for the construction of a base course for paving on Grand Avenue in said city.
Said city council hereby adopts the specifications for such crusher run rock, heretofore sub-
mitred by the city engineer. Ail suCh crusher run rock shall be in strict accordance with the
provisions of said plans and s;oecifications.

Eight (8) hours shall constitute a day's work.
Work performed on Saturdays shall be paid for at double the rates for regular time
hereinbefore set forth.
The rate for any employee not listed in the above schedule shall not be less than
$1.10 per hour for skilled labor, $0.8§ for intermediate labor and $0.?§ for unskilled.

said City of South San Francisco, which notice shall be substantially in the following form:

NOTICE I'S HEREBY GIVEN that sealed proposals or bids will be received by the City Counci',
of the City of South San l~rancisco on Monday, the %~,th day of Ya~V, 1941, until the hour of 8:00
o'clock p.m. for furnishing to said City of South San Francisco four thousand (4,000) cubic yard
of crusher run rock, Said crusher run rock shall be deliw~zs~dto said city on Cr~d Argue, in
satd~city, at places to be designated by the city engineer of said city.
All such crusher run rock shall be i%xrnished in strict accordance with the ~peclfication
for such crusher run rock adopted by the city council on the 2§th day of April, 1941, and to the
satisfaction of the city engineer of said city.
Said city council has ascertained that the general prevailing rates of per diem wages

It shall be mandat~ry upon the contractor to whom the contract is awarded, anti. upon a~LV
subcontractor under him, to pay n~ less than the specified r~tes to all laborers, workmen ana-
mechanics employed by them in the execution of the contract. The contractor shall forfeit as
a penalty to the City of South San Francisco Ten Dollars ~$10.001 for each laborer, workman or
mechan~S emplo~ed, for each calendar day, or portion thereof, such laborer, workman or mechanic

is paid less than said stipulated rates for any work done under said contract, by him, or by any
subcontractor under him. And such contract shall contain a stipulation to this effect, in
accordance with the provisions of ~ection 1775 of the ~abbr Oode of the ~tate of California.
1Vo bid will be accepted from a contractor who has not been licensed in accordance with
the provisions of an act of the LegislatUre of the State of California, entitled: "An act provid~
for the registration of contractors, and defining ~he term contractor; providing the method of
obtaining licenses to engage in the business of contracting, and fixing the fees for such license
providing th% method of suspension and cancellation of such licenses; and prescribing the punish-
ment for violation of the provisions of this act." Chapter 791 of ~tatutes and Amendments ~
as amended.
NOTICE IB FURTH~ HEREBY CIVEN that no person, firm, partnership, association, or corpor~
ion, or agent thereof, doing any of the work herein provided for, as a contractor, or subcontrac~
shall knowingly emplpy, or cause or allow to be employed thereon, any alien, except in cases of
extraordinary emergency c~used by fire, flood or danger to life or property.
The contractor, to Whom a contract for seid work may be awarded, shall forfeit as a pena~
to the City of Bouth San Francisco, Ten Dollars~$~.00) for each alien knowingly employed in the
execution of such contract by him, or any subcontractor under him, for such c~endar day, or pot1
thereof, during which such alien is permitted orn~quired to labor in violation of the provisions
of Article A of the Labor Code of the Brats of California.
The contract ~must be entered into in compliance with and subject to the conditions impos~
by Article ~ of the Labor Code of the Btate of California. Baid contract shall contain a stipul~
ion which shall provide that the contractor to whom said contract is awarded shall forfeit as a
penalty to said Cit~'~ of Bouth Ban Francisco Ten Dollars ¢$10.00) for each laborer, workman or
mechanic employed in the execution of said contract, by him, or by any subcontractor under him~
upon shy of the work herein mentioned, for each calendar day during which such l~orer, workma~
mechanic is required or permitted to labor more than eight ~8) hours in violation of the provisi¢
of Article ~ of the Labor Code of the ~tate //f California.
The contract to be awarded shall contain a further stipulation that the contractor, to w~
such contract may be awarded, shall use or supply only smch unmanufactured articles, materials,
and supplies as may have been mined or produced in the~'~nited States and only such manufactured
les, materials and supplies that have been manufactured in the United ~tates, substantially from
all articles, materials.or supplies ~lned, produced, or so manufactured, as the case may be, in
the United States, excepting only where such articles, materials, or sup~lies of the class or kir
to be used, or the articles, materials or supplies from which they are manufactured are not minei
produced, m~nufactured, ~s the case may be in the United States, as required by an act of the
legislature of the Btate of Californi~ entiled: "An act to require the use of materials and supp~
substantially produced in the United ~tates, in public works and for public plzrposes; "Chapter
of the Statutes of California, 19B~.
The successful bidder shall, within ten (lO~ days, after the award, enter into a contra~$
with the City of Bouth ~an Francisco for the faithful performance of the work tobl~e~idone under
said award. All sealed proposals or bids shall be accompanied by a check payable to the City of
~outh 8an~Francisco, certified b~ a responsible bank in the ~tate of California for an amount wh~
shall not be less~than rem ~lOI percent of the aggregate of th,e£proposal, or by a bond for the
said amount and so payable, signed by the bidder and two (2~ sureties who shall Justify before ar~
officer competent to administer an oath in double said amount over and ab0ee all statutory exemp~
If the proposal be accepted and th~ contract awarded and if the bidder shall fail and neglect ~to
scuts a contract and gi~e the bonds required, the sum mentioned in said check, or the principal
of said bond, as the case may be, shall be liquidated damages for such failure and neglect ~nd
be forfeited to and paid into the treasury of the City of Bouth ~a,. Francisco. The bidder to wh~
the contract is awarded will be reouired to execute a bond for the faithful performance of his we
in an amount equal to fifty (B0) percent of the amount of the undertaking with at least two
responsible sureties in the full amount of the bid each; and will also be recuired before enteri~
upon the work to furnish a good and sufficient bond, as reouired b~? an act of the Legislature of
the State of California, approved May lC, 1919, entitled; "An Act t° secure the payment of the
claims of persons employed by contractors upon public works and the claims of persons who furnish
materials, supplies, teams, implements or machinery used or consumed b2 such contractor in the
performance of such works, and nrescribing the duties of certain oublic officers with respect
thereto", Chapter~0~ of the Statutes of California, 1919.

All sealed prorosals will be opened by said city council in public session on Monday, the
12t, h day of May, 19~l, at 8:00 o'clock p.m. at the council chamber of said city council.
Said city council reserves the right to reject any and all bids.
