HomeMy WebLinkAboutReso 811-1941300 NOTICE INVITING SELAED PROPOSALS OR BIDS FOR FURNISHING ROCK TO THE CITY OF SOUTH SAN FRANCISCO. NOTICE IS HEREBY GIVEN that sealed proposals or bids will be received by the City Council of the City of South San Francisco on Monday, the 9thd ay of June, 1941, until the hour of 8.00 o'clock ,p. ~m. for furnishing to said city of SoUth San F_rancisoo a qu. an~!.ty of rock, not less than thirty five hundred (3500) cubic yards nor more than six thousand ($000) cubic yax~s, of one of the kinds of rock hereinafter mentioned, for the construction of a base course fo~ paving on Grand Avenue in said city. The kinds of rock hereinbefore referred to are as follows: Crusher run rock' Red, Brown or gray shale. All the rock, for which a contract may be awarded by said city council, sh-ll be furnish- ed in strict accordance with the specifications for such rock adopted by the ~ity Council on the 23x~t day of May, 1941, and to the satisfaction of the city engineer of said city. The contractor shall forfeit as a penalty, to the ~ity of South San Francisco Ten Dollars ($10.00) for each laborer, workman or mechanic employed, for each calendar day, or portion thereof, such laborer, workman or mechanic is paid less than said stipulated rates for any work dor~ under said contract, by him, br by any subcontractor nnder him. And such contract shall contain a stipulation to this effect, in accordance with the provisions of Section 1775 of the Labor Code of the State of California. No bid will be accepted from a contractor who has not been licensed in accordance with the provisions of an act of the Legislature of the State of California, entitled: "An act providing for the registration of contractors, and defining the term contractor; providing the method of obtaining licenses to engage in the business of contracting, and fixing the fees for such licenses; providing the method of suspension and cancellation of such licenses; and prescribing the punishment for ~iolation of the provisions of this act." NOTICE I~ FURTHER HEREBY GIVEN that no person, firm, partnerhsip, association, or corporation, or agent thereof, doing any of the work herein provided for, as a contraotor~ or subcontractor, ,shall knowingly employ, or cause or allow to be employed thereon, any alien, except in cases of extraordinary emergency caused by fire, flood or danger tq life or property. The contractor, to whom a contract for said .work may be awarded, shall forfeit as a penalty to the City of South San Francisco, Ten ~ollars ($10.00) for each alien knowingly employed in the execution of such contract by him, or any subcontractor under him, for such calendar day, or portion thereof~ during which such alien is permitted or required to labor in Violation of the provisions of Article 4 of the Labor Cbde of t~e State of California. The contract must be entered into in compliance with an subject to the conditions imposed by Article 3 of the Labor Code of the State of California, Said contract shall con- tain a stipulation which shaI1 provide that the contractor to whom said constract is awarded shall forfeit as a penalty to said City of South San Francisco Ten Dollars ($10.00) for each laborer, workman or mechanic employed in the execution of said contract, by him, or by any subcontractor under him, upon any of the work herein mentioned, for each calendar day during which such laborer, owrkman or mechanic is required or permitted t~ labor more than eight (8) hours in vi~lation of the provisions of Article 3 of the Labor Code of the State of California. The contract to be awarded shall contain a further stipulation that the contractor, to whom such con~ tact may be awarded, s~all use or supply only such unmanufactured articles, materials, and supplies as may have be~ mined or produced in the United States and only such manufactured articles, materials and supplies that have been manufactured in the United States, substantially from all articles, materials or supplies mined, produced, or so manufactured, as the case may be, in the United States, excepting only where such articles, materials, or supplies of the class or kind to be used, or the articles, materials or supplies from which they are manufactured are not mined, produced, manufactured, as the case may be in the United States, as required by an act of the legislature of the State of California entitled: "an act to require the use of _m~_terials and supplies substantially produced in the United States, in public works and for public purposes;" Chapter 228 of the Statutes of California, 198Z. The successfUl bidder shall, within ten (10) days, after the award, enter into a contract with the City of South San Francisco for the faithful performan~ of the work to be done uhder said award. All sealed proposals or bids shall be accompanied by a check payable to the city of South San Francisco, certified by a responsible bank in the State of CalXfornia for an amount which shall not be less t~an ten (10) per cent of the aggregate of the proposal, or by a bond for the said amount and so payable, signed by the bidder and two (2) sureties who shall Justify before any officer competent to administer an oath in double said amount over aud above all statutory exemptions. If the proposal be accepted and the contract awarded aud if the bidder shall fail and neglect to execute a contract and give t~e bonds required, the sum mentioned in s aid cheek, or the principal sum of said bond, as the case m~y be, shall be liquidated damages for such failure and neglect and sl~all be forfeited to and paid into the treasury of the city of South San Francisco. The bidder to whom the contract is awarded will be required to execute ~ bond for the failthful performance of his work in an amount equal to fifty (50) percent of the amount of the undertaking with at least two (2~ responsible sureties in the fUll amount of the bid each; and will also be required before entering upon the work to furnish a good and sufficient bond, as required by an act of the Legis-lat~re of the State of California, approved May 10, 1919, entitled: "An act to secure the payment of claims of persons employed by contractors upon public works and the claims of persons who furnish materials, supplies, teams, implements or machinery used or consumed by such contractor in the performance of such works, and prescrib- ing the duties of certain public officers with respect tnereto"~ Chapter 303 of the Statutes of California, 1919. ~ Specifications and proposal sheets may be obtained at the office of the city engineer of said city of South San Francisco, City Hall, South San Francisco, California. No bid will be cons~idered, unless the~ same- is submitted on a proposal sheet obtained from said city engineer. Sealed proposals or bids will be delivered to the c~ty clerk on or before 8:00 o'cloc~ p. m. on Monday, the 9th day of June, 1941. All sealed proposals will be opened by said city council in public Session on Monday, the 9th day of June, 1941, at 8:00 o'clock p. m. at the Council Chamber of. said city council. Said City Council may select any one of tt~ different kinds of rock hereinbefore mentioned ar~imay award a contract f~rthe rock so selected.
