Baker, the undersigned, hereby represent to the city council of the City of South San Francisco that I am unable to perform the work provided for in my contract with said city, dated June 16. 1941, wherein I agreed to furnish to said city certain gray shale rock for the construction of a base course for paving on Grand Avenue in said city, by reason of the fact that the rock required to be used in said contract~is too hard to be crushed by the roller now used by me, and, for this reason, I amk to be relieved from my obligation to perform the work provided for in said contract. BAKER OF HIS OBLIGATION UNDER CONTRACT WITH CITY OF SOUTH SAN FRANCISCO, DATED JUNE 16,1941 WHEREASthe City of South San Francisco did, on the 9th day of june, 1941, award' a contract to J.g. Baker for furnishing gray shale rock for the construction of a base course.for paving on Grand Avenue in said city, and thereafter a ~ontract for said work, bearing date June 16,1~41, was executed by said J.S. Baker and said City of South San Francisco; and WHEREASsaid J.g. Baker represents to the city council of said City of South San Francisco that he is unable to perform said contract and asks to be relieved of Grand Avenue in said city, by reason of the fact t~at the rock required to be used in said contract~is too hard to be crushed by the roller now used by me, and, for this reason, I ask to be relieved from my obligation to perform the work provided for in said contract. Baker be, and he hereby is relieved of his obligation to perform said contract. The mayor of said city and the city clerk are hereby authorized to execute an agree- merit, in the name of said City of ~outh San Francisco and under its seal, for the purpose of terminating-said contract. The city clerk is hereby directed to notify the surety on the bonds of said J.S. Baker, which bonds were given in connection with said contract first above ment- ioned, of the termination of said contract. -0-0-0-0-0 I hereby ~certify that the foregoing resolution was regularly introduced and adopted by the city council of the City of South San Francisco, this 30th day of July, l'~41, by the following vote: Ayes, coUncilmen V.
