HomeMy WebLinkAboutReso 820-1941808 ~820 RESOLUTION CALLING FOR BIDS FOR CRUSHER RUN ROCK TO BE USED AS A BASE COURSE FOR PAVING GRAND AVENUE IN THE CITY OF SOUTH SAN FRANCISCO. RESOLVED by the City Council of the City of South San F~ancisco that public interest and convenience require that said city should purchase a quantity of c~usher run rock, not less than twenty-five hundred (2800) cubic yards nor more than five thousand (5000) cubic yards for the construction of a base course for paving on Grand Avenue in said city. Said City Council hereby adopts the specifications submitted by the city. engineer of said city for crusher run rock. All such work shallb e in strict accorda~uce with the provisions of said specifications. The rate for any employee not listed in the above schedule shall not be less than $1.10 per hour for skilled labor, $0.85 for intermediate labor and $0.175 for unskilled labor. The following are to be considered holidays: New Year's Day, Decoration Day, Independence Day, Labor Day, Admission Day, Thanksgiving Day, Christmas Day, Saturdays and Sundays. The contractor s~all forfeit as a penalty to the city of South San Francisco Ten Dollars ~$10.00) for each laborer, workman or ~echanic employed, for each calendar day, or portion thereof, such laborer, workman or mechanic is paid less than said stipulated rates for any work done under said contract, by him, or by any subcontractor under hime And such contract snall contain a stipulation to this effect~ in accordance with the provisions of Section 1VTB of the Labo~ Code of the State of California. No bid will be accepted from a contractor who has not been licensed in accordance width t~e provisions of an act of the Legislature of the State of California, entttled:"n act providing for the registraction~of contractors, .and defining tne term contractor; providing the method of obtaining licenses to engate in the business of contracting, and fixing the fees for SUCh licenses; providing the method of suspension and cancellation of such licenses; and pre- scribin~ the punishment fo~ violation of the provisions of this act." NOTICE IS FURHTER HEREBY GIVEN That no person, firm, partnership, association, or corporation, or agent thereof, doing any of the work herein provided for, as a contractor, or sub-contractor, sf~zll knowLugly employ, or cause or allow to be employed thereon, any alien, except in cases of extra- ordinary emergency caused by fire, flood or danger to life or property. The contractor, to whom a contract for said work may b e awarded, shall forfeit as a penalty to the City of South San Francisco, Ten Dollars (~10.00) for each alien knowingly employed in the execution of such contract by him, or any subcontractor under him, for such calendar day, or portion thereof, during which such alien is permitted or required to labor in violation of the provisions of Article 4 of the Labor Code of the State of California. The contract mus be entered .into in compliance with and subject to the conditions imposed by Article 3 of the Labor Code of the State of alifornia. Said contract shall contain a stipulation which shall provide that the contractor to whom said contract is awarded shall forfeit 'as a penalty to said City of South San Francisco Ten Dollars ($10.00) for each laborer, workman or mechanic employed in the execution of said contract, by him, or bay any subcontractor under' him, upon any of the work herein mentioned, for each calendar day during which such laborer, workman or mechanic is required or permitted to labor more than eight (8) hours in violation of t~ provisions of Article 3 of the labor code of the State of California. The contract to be awarded shall contain a further stipulation that the contractor, to whom such contract may be awarded, shall use or supply only such~unmanufactu~_ed arti~cles, materials, and supplies as may have been mined or produced in the United States and only such manufactured articles, materials and supplies that have bem manufactured in the United States, substantially from all articles, materials or supplies mined, produced, or so manufactured, as the case may be, in the United States, excepting only where such articles, materials, or supplies of the class or kind to be used, or the articles, materials or supplies, from which they are manufactured are not mined, produced, manufactured, as the case may be in the United States, as requ~ed by an act of the legislature of the State o~ California entitled;" An act to require the use of materials and supplies substantially produced in the United States, in public works and for public purposes;" Chapter 226 of the Statutes of ~alifornia, 1933. The successful bidder shall, within ten (10) days, after the award, enter into a contract with the City of South San Francisco for the faithful performance of the work to be done under said award. All sealed proposals or bids shall be accomparAed by a check payable to the City of South San Francisco for an amount which s~all not be less than ten (10) percent of the a~remate o~ tb~ ~~ ~ any subcontractor under him. The contract to be awarded shall contain a f~mrther stipulation that the contractor, to whom such contract may be awarded, shall use or supply only such unmanufactured articles, materials, and supplies as may have been mined or produced in the United States and only such manufactured articles, materials and supplies that have bem manufactured in the United States, substantially from all articles, materials or supplies mined, produced, or so manufactured, as the case may be, in the United States, excepting only where such articles, materials, or supplies of the class or kind to be used, or the articles, materials or suppliesj from which they are manufactured are not mined, produced, manufactured, as the case may be in the United States, as requ~ed by an act of the legislature of the State of California entitled;" An act to require the use of materials and supplies substantially produced in the United States, in public works and for public purpose: Chapter 228 of the Statutes of ~alifornia, The successful bidder shall, within ten (10) days, after the award, enter into a contract wit~ the City of South San Francisco for the faithful performance of the work to be done under said award. All sealed proposals or bids shall be accomparAed by a check payable to the City of South San Francisco for an amount which s~all not be less than ten (10) percent of the aggregate of the proposal, or by a bond for the said amount and so payable, signed by t~e bidder and two (2) sureties who shall justify before any officer competent to administer an oath in doubl~ said amount over and above all statutory exemptions~ If the proposal be accepted and the contract awarded and if the bidder s~all fail and neglect to execute a contract and give the bonds required, the sum mentioned in said check, or the principal sum of said bond, as the case may be, shall be liquidated damages for such failure and neglect amd shall be forfeited to and paid into the treasury of the City of South San Francisco. The bidder to whom the contract is awarded will be required to execute a bond for the faithful performance of his work in an amount equal to fifty (§0) percent of the amount of the undertaking with at least two (2) responsible sureties in the z~ull amount of the bid each; and will also be required before entering upon the work to furnish a good and sufficient bond. as required by an act of the Legislature of the State of California, approved May ~0, 1919, entitled: "an act to secure the payment of the claims of persons employed by contractors upon public works and the claims of persons who furnish materials, supplies, teams, implements or machinery used or consumed b~ such con- tractor in the perfox~nance of such works, and prescribing the duties of certain public officers with respect thereto", Chapter 80Z of the Statutes of California, 1919. Specifications and proposal sheets may be obtained at the office of the city engineer of said city of South San Francisco~ City Hall~ South San Francisco, California. No bid will be considered, unless the same is submitted on a proposal 310 sheet obtained from said city engineer. Sealed proposals or bids willb e delivered to the city clerk on or before 8:00 o'clock p. m. on Monday th~ llth day of August, 1941. All sealed proposals will be opened by said city council in public session on Monday, the llth day of August, 1941, at 8:00 o'clock p. m. at the council chamber of said city council.~ Said city council reserves the right to reject any and all bids.
