HomeMy WebLinkAboutReso 830-1941818 #830 RESOLUTION CALLING FOR BIDS FOR THE CONSTRUCTION OF ASPHALTIC CONCRETE PAVEM~'~ ON EAST GRAND AVEN¥~Eo RE~OLVED by the city council of the City of South San Fraucisco that public interest and convenienoe require that the following street work be done in said City of South San Francisco: the construction of an asphaltic concrete pavement on the existing rock base on the portion of East Grand Avenue, in Said city, extending easterly from the east- erly boundary line of Industrial Way for a distance of forty-eight hundred smd seventy-seven (4877) feet and at a location shown upon the plans hereinafter mentioned. Said city council hereby adopts the plans and specifications s~bmitted by the city engineer of said city for said street improvement work. All such work shall be performed and all materials used therein snall be furnished in strict accordance with the plans and specifications, and under the supervision and to the satisfaction of. said city engineer. NOTICE IS FURT][ER i~EREBY GIVEN that no person, firm, partnersaip, assocation, or corporation, or agent thereof, doing any of t~e work herein provided for, as a contractor, or subcontractor, shall knowingly employ, or cause or allow to be employed thereon, any alien, except in cases of extraordiD~ry emergency caused by fire, flood or danger to life or property. The contractor, to whom a contract for said work may be awarded, shall forfeit as a penalty to the City. of South San Francisco. Ten Dollars (~i~10.00) for each alien knowingly employed in the execution of such contract by him, or any sub- contractor under him, for such calendar day, or portion thereof, during which such alien is permitted or required to labor in violation of the provisions of Arti~le 4 of the Labor Code of the State of California. The contract must be entered into in compliance with and subject to the con- ~i tions imvosed by Article 3 of the Labor Code of the State of California. The successful bidder s~all, within ten (10) days, after the award, enter into a contract with tl~e city of South ~s.n Francisco for t~e faithful perfom~ance of th~ work to be done under said award. All sealed proposals or bids sluall be accompani~ by a c.i~eck payable to tt~e City of South San Franciso, certified by a responsible bank in the State of California for an amount which s~Rll not be less than ten percent of the agzregate of the proposal or by a bond for the said amount and so payable, signed by the bidder and two (2~ sureties who shall justify before any officer competent to administer au oath. in double said amount over an above all statutory exemptions. If the proposal be accepted and the contract awarded and if the bidder shall fail and neglect to execute a contract and give the bonds require~ the sum mentioned in said c~eck, or the principal sum of said bond, as the case ma~ be, shall be liquidated damages for such failure and neglect and shall be for- feited to and paid into the treasury of the city of South San Francisco. The bidder to whom the contract is awarded will be required to execute a bond for the faithful performance of his work in an amount equal to fifty (50) percent of ti amount of the undertaking with at least two (2) responsible ~ru-eties in the full amount of the bid each; and will also be required 'before entering upon the work 32O to furnish a good and sufficient bond, as required by an act of the legislature of the State of California, approved ~,'lay 10, 1919, entitled: "an act to secure the pa[~uent of the clai~ns of persons employed by contractors upon public works and the claims of persons who furnish materials,[ supplies, teams, implements or machinery used or consumed by such contractor in the performance of such works, and prescribing the duties of certain public officers with respect thereto", Chapter 303 of the Statutes of California, 1919.
