HomeMy WebLinkAboutReso 843-1942RESOLUTION GRANTING PERMISSION TO CONSTRUCT SiDeWALK CURB AND GUTTER ON A PORTION OF HILLSIDE BOULEVARD. RESOLVED by the city council of the city of South San Francisco that per- mission be, and the same is hereby granted to the owners of the land fronting upon the northerly side of Hillside Boulevard between Linden Avenue and Arden Avenue, to constr~ sidewalk, curb and gutter upon said portion of Hillside Boulevard. All such sidewalk~ curb and gutter must be constructed in strict accordance wit~ the plans ~and specificat~ heretofore adopted by said city council for saidwork and now on file in the office of city clerk of said city and under the supervision and to the satisfaction of the city engineer of said city. In the contract between said owners and the contractor, who shall be empl by 'the~, said contractor shall agree as follows: Any laborer, wc~kman or me c~mnic employed at any time by the contractor or by any subcontractor under him upon the work, or upon any part thereof, cannot be required or permitted to work thereon more than eight (8) hours in ahy one calendar da except in case of extreme emergency by fire, flood, or damage to life or property, and t~e contractor ~ereby agrees to forfeit as a penalty to the city of South San Francisc under the terms of this agreement, the sum of Ten Dollars ~$10.00) for each laborer, workman, or mechanic employed in the execution of said contract, for each any every calendar day during whic~ any such mechanic, workman, or laborer is required or per- mitted to labor more than ei~t (8) hours in violation of the provisions of Article 3 of the Labor Code of t~e State of California. Said contractor s~all keep himself fully informed of all existing and future state, national and municipal laws, ordinances, rules and regulations affectin~ in any manner the work herein provided for or t~e workmen employed thereon, or in any way affecting tl~e conduct of t~e work or any authority or body, or tribunal or author~. having any Jurisdiction or any authority over said work. '330 Said contractor agrees to carry Workmen' s Compensation Insurance to fully protect the interests of said contractor and that of said owners aii:ainst any damage muir which may be brought by workmen on account of any accident upon or around the place where the work is going on. This policy s~all be in conformity with the Workmen's Compensation Insurance and Safety Act of the State of California. If t~e contractor s~all fail or neglect to effect and keep in force such insurance, the said owners may~ procure such inSUrance upon all work- men employed upon or in connection with the construction of the. work herein provided for and may deduct from the amount to become due under the terms of this contract any sum or sums of money which they may pay as p~emium for such insurance. For Sundays and holidays, (except watchmen and flag- In accordance with provisions of Section 1775.5 of the Labor Code, as amended by Chapter 9V1, Statues of 1939, and subsequent amendments thereto, and in accordance with the regulations of the California Apprenticeship Council, properly ir~lentured apprentices may be employed in the prosecution of the work. The following are to be considered holidays: New Year's Day, Decoration Day, Independ- ence Day, Labor Day, Admission Day, Thanks~ving Day, Christmas DaY, Saturdays and Sundays. Said contract snail also provide as follows: Said contractor, and every subcontractor under said contractor, agrees to pay not less than the Said specified rates to all laborers, workmen and mechanics employed in t~e execution of this agreement. Said contractor shall forfeit as a penalty to said City of South San Francisco Ten lDollars ($10.00) for each laborer, owrkman or mechanic employed for each calendar day, or portion there- of, sucl~ laborer, workman or mechanic is paid less than the said stipulated rates for any work done under this contract by said contractor, or by any subcontractor who may be engaged in said w c~k. Said contractor agrees that no person, firm, partnership, association or corporation, or agent thereof, doing any of the work herein provided for, as a contractor or subcontractor, shall knowingly employ, or cause or allow to be employed thereon any alien, except in cases of extraordinary emergency caused by fire, flood, or danger to life or property. Said contractor shall forfeit as a penalty to said City of South San Francisco Ten Dollars ($10.00) for each alien knowingly employed in the execution of such contract by him, or by any subcontractor under him for each calendar day, or portion t~ereof, during which such alien is permitted or required to labor in violation of the provisions of Article 4 of the Labor Code of the State of California. Said contractor agrees that he will use or supply only such unmanufactured articles, ma terials, and supplies as may have been mined or produced in the United States and only suc~ manufactured articles, materials, and supplies as have been manufactured in the United States, substantially from all articles, materials or supplies mined, produced, or so manufactured, as the case may be, in the United States, excepting only where such articles, materials or supplies of the kind or class or the articles, materials or supplies from whiC~ they are manufactured are not mined, produced or manufactured, as the case may be, in the United States, as required by an act of the Legislature of the State of California entitled: "An a ct to require the use of materials and supplies substantially produced in the United States, in public work '~1. for public pu~.poses"; Chapter 226 of the Statues of California, 19,53. IT IS FURTHER RESOLVED t~at, before such contractor snail be permitted to commence the performance of sucn work, 1. Such contractor snail execute to the City of South San Francisco a bond in the penal sum of not less than fifty (50) percent of the total cost of said work, as determined by the city engineer of said city; 2. Such contractor shall 'file in the office of the city clerk evidence to snow that he carries Workmen's Compensation Insurance to protect the interests of such contractor and said owners with respect to the claims of workmen who may become injured in the performance of said work. 3.
