RESOLVED by the city council of the city of South San Francisco that public interest and convenience require the following improvement work to be done in said city, to-wit: The excavation of channels for Colma Creek between Linden Avenue aud Orange Avenue. All said work shall be done at the location shown upon the plans hereinafter men- tioned and strictly in accordance with the plaus and specifications for said work, now on file in the office of the city clerk, and hereby adopted as tl~e plans and specifications for said work. All suc~ work and the materials to be used in connection therewith shall be furnished under the direction a~ 'to the satisfaction of the works engineer of said city Said city council hereby detemines that the general prevailing rates of per diem wages and tee general prevailing rates for legal holiday and over-time work applicable to said work to be done are as follows: CLASSIFiCATI ON RATE PER HOUR ENGINEERS Le Tourneau Pulls (up to 14 yds.) Le Tourneau Pull (over 14 yds.) Tractors Operators of Power Shovels and/or other equipment with shovel controls up to i yd. Same as last above, over i yd. 'Apprentices (oilers, firemen, watchmen) ~1o 6~5 1.75 1°625 1.75 2.00 1.20 Laborers Grading Laborers, slopers 0.93V5 The rate for any employee not listed in the above schedule shall not be less than ~l.l~ per hour for skilled labor, ~0.8~ for intermediate labor and e0.V$ for unskilled. Overtime work will be one and one-half times the above rates. (except watcl~en and flag-men) double the above rates. Sundays and Holidays The following are to be considered holidays: New Years Day, Decoration Day, oatu~d~¥s Independence Day, Labor Day, Admission Day, Thanksgiving Day, Christmas Davy, ~" and Sundays. The City Clerk is hereby directed to cause a notice inviting sealed proposals for do~no said work and for zurnisning all materials necessary therefor to be published by two (2) insertions thereof in the "South San zrancmsco Journal" a ne~,~sps.per of ;~eneral circu- lation published and printed in said city of South San Prancisco, which notice shall be substantially in the following form: Notice is hereby given that sealed imoposals or bids will be received by the City Council of the City of South San Francisco on ~londay, the !4th day of ~mtil the hour of eight o'clock p. m. for the doing of the following public work of said city, to-wit: The excavation of channels for Col~$a Creek between Linden Avenue and Orange Avenue F · in the City of South San rancmsco. The following are to be considered holidays: New Years Day, 0ecoration Day, In- dependence Day, Labor Day, Admission Day, Ths~.l~s.3iving Day, 3hristr:as Day, Saturdays and Sundays. 356 It shall be mandatory upon the contractor to whom the contract is awarded, and any sub-contractor ~mc!er time, to pay not less than the specified rates to all laborers work~.en, and. mechanics employed by them in the execution of ti'~e contract~ The contractor shall forfeit as penalty to the Sity of South San Francisco Ten Dollars :..~10o00 for each laborer, workman or mechanic employed, for each calendar day, or portion thereof, such laborer, workman or meci~.anic is paid less than said stipulated rates for any work done under said contraot, by him, or by any sub-contractor urn. der him. And such contract shall contain a stipulation to this effect, in accordance with the provisions of section of theIabor code of the State of California. The successful bidder sha~l, within ten (10) days after the award, enter into a contract with the City of South San Francisco for the faithful pez~fformance of the work to be done under said award. Ail sealed proposals or bids shall ]':e accompanied by a check payable to the City of South San Francisco, certified by a responsible barfl~ in the State of California for an amount wb_ich shall not be less than 9eh (!0) per cent of the aggregate of t~e proposal, or by a corporate surety bond for said amount 'and so payable, signed by the bidder smd two ~2) sureties who shall justify before an officer competent to administer an otah in double said amount over and above all statutory exemptions. If the proposal be accepted and t~xe contract awarded and if the bidder shall fail or neglect to execute a contract"and give the bonds required, the sum mentioned in said check, or the principal sum of said bond, as the case may be, shall be liquidated damages for such failure and neglect and shall be forfeited to and paid into the treasury of the City of South San Francisco. The bidder to whom the contract is a':~rrded shall be required to execute a bond for the faithful performance of his work in an amount equal to fifty (50) per cent of the amount of the undertaking with atleast two (2) responsible sureties in the full amount of the bid each; and will also be required, before entering upon the work. to furnish a good and suffic;ent bond, as requirsd by an act of the legislature of the ~tate of Ca!ifomia, approved :'.'(ay 10, 1919, entitledf "An act to secure the I~auent of the claimsof persons employed by contractors upon public works and the claims of persons who furnish materials supplies, teams, implements, or machinery used or consumed by such contractor in the performance of such work arzt 'prescribing the duties of certain public officers with respect thereto", Chapter 30O of the~ Statutes of California, 1919. All bonds herein provided for must be furnished by s mue surety corporation author- ~ ' · ized to transact business in the State of almfornma. Specifications and proposal sheets may be obtained at the office of the city engineer of the City of South San Francisco, in the City Hall of said city, or at the office of R. A. Klassen~ Stafford Building, Redwood Oity, California. No bid will be considered, unless submitted on a proposal sheet obtain as herein provided. Sealed proposals or bids will be delivered to the City Clerk on or before eight o'clock p. m. on~,.~,~onday~ , the 14th day of September, 1942. All sealed proposals will be opened by said city council in public session on ~,,~onday, the 14th day of September, 194~, at eight o'clock p. m. in the council ',~mmber of said city council.
