THIS AGREE~:ENT,made this 17th day of August,194,, between the City of South San Francisco,
a municipal corporation,5ounty of San ~ateo,~tate of CaliFornia, the first ?arty, and South'
ban Francisco Scavenger Company, a copartnership~ of the City of South San Francisco,County of
San "~ateo,State of California,the second party,~;ITNE~%ii;
%:hat said parties, for and in consideration of the kutual covenants herein contained,do agree
as follows;
Said first party hereby grants to said second party the exclusive right to deposit upon
the garbage dump,now co~trolled by said fitw of South San Francisco, garbage originating within
said City of S~uth San ~rancisco,and witnin~Visitation, Brisbane,Lomita Park and ~.'~illbr~e,in said
County of San ateo,but not elsewhere,during the'period of five (5) ~'ears from the 18th of kay,
194~,and to charge all persons,firms,and corporations,who may de[~ire to deposit garbage.upon
said garbage dump~ the following prices;
10c per can of twenty-five (qS) gallons and 50c per truck load, not exceeding three (3)
~cubic pards.
For garbage originating outside the C~.t~ o~ South San Francisco the above mentioned prices
shall not apply, but second parties may fix its own prices for the garbage referred to this
p ar asr aph.
in consideration of the covenants and agreements u~::on the part of said first party herein
contained, said second party, agrees as follows;
1. %o keep some responsible person in charge of said ~larbage dump at all times when the
enclosure, in which said dump is located, is open.
~. To maintain said garbage dump in a good and workmanli,~e manner and to cause all fires,
irrespective of the cause of the same, to be extinguished not later than the time of sunset
each day.
3. ~o maintaih a barbed wire gate ,of substantial structure,, across the road on which the
entrance to said garbage dump is located, and to keep such gate securely closed and locked at all
times wLen said garbage dump shall not be omen for use;
4. ~'o keep said garbage dump open at all ti~es between the hour of 9~ 00. ~'ctOck A.M. and
the hour .of 5;00 o'clock p.m.,of each day excepting Sundays and on Sundays to keep said dum~
open from the hour of 8;00 o'clock a.m. to the hour of 11;00 o'clock a.m.
5. To hold s~id City of bouth San ~rancisco free and harmless from every kind of liability
which may arise or occur in connection with the use of said garbage dump by any :~erson, persons,
firm or corporation.
6. Said South San Francisco Scavenger Company shall not permit any person, firm or
corooration to deposit on said dump any garbag~ not originating: within said City of South San
Fr.ancis¢o, or said ~:~risbane, Visitation,Lomita ~ark and i[illbra$.
it is further understood and agreed b~ said parties as follows;-
During the hours when said dump may be open~ ss herein provided, said. City of South San ?::
Francisco may deposit on said dump,hedge,:garden~&nd.ihorticnltur&t.t~immings and refuse
originating by reason of the activities of said city,as a municipal corporation,free of charge.
~ring the hours when said dump may be open, as herein provided, any resident or property
owner in said city may deposit on said dump, hedge, garden and horticultural trimmings and waste
materials resulting: from the construction of buildin~:s within said city,free of charge.
It is further agreed by an5 between t!e parties hereto tLat said City of South San Francis(
shall cause a s~pply of water to be conducted to said ~arbage dump,through a pipe having s.n
internal diameter not less than one and one-half inches (1½~ nor greator than two 9~) inches,bu~
sufficient for the purpose of extinguishing any fires whick may exist in or upon said ~:srbage
dump.
Ih ~[ITNELg WiELEOF said first party has executed this agreement by its Mayor and City Clert
first thereunto duly authorized bI a resolution of the city council of said city,and said second
party has executed this agreement,all as of the day and year first above written.
