HomeMy WebLinkAboutReso 900-1943HESOLUTION ACCEPTING DEED FROM UNION IRON WO~KS DRY- DOCK COMPANY RESOLVED by the City Council Of the City of Sout~ .Sau~ Francisco that said city hereby accepts that certain deed, dated the 18th day of May, 1943, wherein Union Ir~n Works Drydock Company, a corporation, conveys to the City of South San F~ancisco, aides, that certain tract or parcel of land situate in the City of South San Francisco, County of San Mateo, State of California, and described as follows, to-wit: Beginning at a point in the Northwesterly line of Grand Avenue East (formerly Swift Avenue) in the City of Soutt~ San Francisco at the point of intersection of the Southeasterly line of Industrial Way, said p~int being 40 feet distant Southeasterly measured at right angles from the Southeasterly line of the Southern Pacific Company's railroad right of way. Thence from said point of beginning, parallel with and distant 40 feet measured Southeasterly at right angles from the^said Southeasterly line of said Southern Pacific Company's railroad right of way, N. 37v 32' 40" E 1895.44 feet to a point; thence on the arc of a curve to the left, a radial line through t~e last mentioned point bears S 52° 271 20" E, witl~ a radius of 980.86 feet, an arc length of 128.34 feet (the chord of said curve bears S 33° 82' 87" W a distance of 128.25 feet) to a point of reverse curve; thence on the arc of a curve to the right with a radius of 980.86 feet, an arc distance of 125.34 feet to a point, a radial line through ~the last mentioned point bears N 52° 27' 20" W, said last mentioned point also is distant 86 feet measured ~soUtneasterly at rignh angles from the Southeasterly line of said Southern Pacific Company's railroad right of way; thence S 37o 32' 40" W parallel with and distant 56 feet measured Southeasterly at right angles from said line of said right of way, a distance of 935.00 feet to a point; thence S 36° 80' 18" W 324.57 feet to a point; thence S 29° 12' 06" W 33.96 feet to a point; thence on the arc of a curve to the right, tangent to the last mentioned course with a radius of 17.56 feet, an arc distant of 36.~7 feet to a point in the Northwesterly line of Grand Avenue East (formerly Swift Avenye); thence S 89° 82' 30" W a distant of 68.99 feet to the point of beginning. Containing 0.§72 acres. Said deed is hereby delivered to said city and accepted by said City upon the loll owing express conditions: 1. In the event that work of construction of a permanent three (3) lane pavement with a pedestrian walkway on the easterly side of Industrial Way, in said City, shall not be commenced within six (8) months following t~e date of the adoption of this resolution, and carried to its completion within such period of time as may be reasonable, the title conveyed to said city by said deed st~all c ease. 2. Said City of South San Francisco shall construct, or cause to be constructed, a pedestrian walkway on the easterly side of said Industrial ~¥ay, and, at the expense of said City, will at all times maintain such walkway in a reasonably good state of repair. 3~ Said City of South San Francisco will, at its owne expense, relocate t~e existing fence of the Bethlehem Steel Company, erected upon the easterly line of said Industrial Way, said fence being on tt~e westerly boundary line of tt~e land hereinbefore described, and will maintain said fence in such manner and condition t~at the property of Bethelehem Steel ~ompany will be inaccessible to the public during such period of time as may be necessary to construct the pave- ment hereinbefore referred to~ 4. No land now owned by either of the i~nediate predecessors of said Union Iron Works and Drydock Company in interest shall ever be assessed for the cost of constructing or reconstructing, or maintaining or repAring any street or highway constructed upon the land hereinbefore described, except by taxation generally ~tnroughout said City of South San Franc i~s co. The City Clerk is hereby directed to certify to a copy of this resolution and' cause a deed and such copy of this resolution to be recorded in the office of the County Recorde~ of the County of San Mateo, State of California. I hereby certify that the foregoing resolution was regularly introduced and adopted F by the city council of the city of south San rancmsco this 7th day of June, 1943, by the following vote: Ayes, Councilmen Noes, Councilmen Absent, Councilmen SE~,L V.
