RESOLVED by the city council of the city of South San Francisco that public interest and convenience require the following public Imoroveraent work to be done in said city, to-wit: The construction of sanitary sewer and manholes at the places shown on the plans adopted by the city council of the City of South San Francisco on the 14th day of March, 1944, ~or the improvement of ~,~ayf~ir Village in said city, as said specifications were heretofore amended, for the improvements in and adjacent to the land shown upon the above mentioned plans f~omthe southerly line of South Canal Street approximately ~SV feet westerly from the westerly line of South ~,~agnolia Avenue, northerly 140 feet to the proposed manhole in North Canal~ Street; thence easterly ~n North Cana~l Street to the proposed manhole in the intersection of North Canal Street and South Spruce Avenue; thence northerly in South Spruce Avenue to an' existing manhole 560 ueet from the last mentioned proposed manhole. All work shall be done at the location shown upon the plans hereinafter men- tioned and strictly in accordance with the plans and specifications heretofore adopt ed for such work. All such work and the materials used in connection therewith shal be furnished under the direction and to the satisfaction of the works engineer of ss city. Said city council hereby ascertains that the general prevailing rates of per diem wages and the general prevailin~ rates for legal holiday and overtime work applicable to said work to be done are as follows: PER HOURLY CLASSIFICATION DIEN WAGE WA~E RATES Bricklayers - 6 hour day Hodca~riers - 6 hour day Trenching machine operator Pipelayer Laborers, skilled Laborers, common Truck drivers $11.00 $ 1.SV 9.00 1.50 13.00 1.~ 10.00 1.25 8.S0 1.10 7.60 0.95 8.00 1.00 Guards, watchmen and other common labor, not less than $0.90 per hour. The rate for any employee not listed in the above schedule shall not be less than ~$1.10 per hour for skilled labor, ~.95 for intermediate labor and $0.90 for unskilled. Overtime work will be double the above rates. Sundays and holidays (except watchmen) double the above rates-. The following are to b e considered holidays: New Years's Day, Decoration Day, Independence Day~ Labor 'Day, Adm~ission Day, Thanksgiving Day, Christmas Day, Saturdays and Sundays. The City clerk is hereby directed to cause a notice inviting sealed pro- posals for doin~ said work and for the furnishing of all materials necessary therefo to be published by two (2) insertions thereof, and not less than five (5) days apart "The Enterprise", a newspaper oF general dirculation published and printed in the of South San Francisco, which notice shall be substantially in the .following form: NOTICE INVITING SEALED PROPOSALS OR BIDS FOR THE CONSTRUCTION OF A SE~TER IN NAYFAI]i VILLA2E IN THE CITY OF SOUTH SAN FRANCISCO. Notice is hereby given that sealed proposals or bids will b e received by the 410 city council of the City of South San Francisco on Monday, the 3rd day of April, 1944, until the hour of 8:00 o'clock p. m. for doing the following public work in said ~ity, to-wit: The construction of sanitary sewers and manholes at the places shwon on the plans adopted by the city council of the city of South San Francisco on the 14th day of ~arch, 1944, for the improvement of ~ayfair Villag~ in said city, as~ said specifications were heretofore amend- ed, for the improvements in and adjacent to the land Shown uoon the above mentioned plans, from the southerly line of South Canal Street approximately 287 feet westerly from the west- erly line of South ~agnolia Avenue, northerly 140 feet to the proposed manhole in North Canal Street; thence easterly in North Canal Street to the proposed manhole in the intersection of North Canal Street and South Spruce Avenue; thence nor~cherly in South Spruce Avenue to an exist- ing manhole 560 feet from the last mentioned proposed manhole. All the work of constructing such sewer shall be done at the location shown upon the clans for said work and strictly in accordance with the plans ar_d specifications heretofore adopted for said work. Sll such work and the materials used in connection therewith shall b e fu~nish- ed under the direction and to the satisfaction of the works ~ngineer of said city. It shall be mandatory upon the contractor to whom the contract is awarded, and u:-~on any subcontractor Luuder him, to pay ncr less than ';t~e specified rates to all laborers, workmen and mechanics employed by them in the execution of the contract. The contractor shall for- feit as a penalty to the C!tT~ of South San Francisco Ten Dollars (~$10.00 for each laborer, workman or mechanic employed, for each calendar day, or portion thereof, such laborer, workman or mebhanic is paid less thand the said stipulated rates for any'work done trader said contract, by him, or by any subcontractor under hime. And such contr~.ct shall contain a stipulation to this effect, in accordance with the.provisions of Chapter ~97 of the Statutes of California, 19~1, No bid will be accepted from a contractor who has not been licensed in accordance with the provisions of an act of the Legislature of the State of California entitled: "An act pro- viding for the rsg_~,stration of contractors, and definin¢~ the te~ contractor; providing the method of obtaining licenses to engage in the business of constructing, and fixing the fees for such licenses; providing the method of susoension and cancellation of such licenses; and prescribing the punishment for violation of the provisions of this act." Chapter 791 of Statutes and ~endments of 1929, as amended. NOTICE IS ?D~RTHER HEREBY GIVEN that no contractor or sub-contractor or agent o~ represent- ati~ze thereof shall knowingly employ or cause or allow to be employed on the work herein pro- vided for any alien, except in cases of extraordinary emergency caused by fire, flood, or danger to life or property. The contractor or subcontractor tho whom a contract for said work may be awarded shall for- feit as a penalty to the City of South San Francisco Ten Dollars (~10.00) for each alien know- ingly employed in the execution of such contract~ for each calendar day, or portion thereof, during w~ich such alien is permitted Or requ'ired to labor in violation of the provisions of Article 4' of the Labor Code of the State of ~alifornla. A provision to this effect shall b e inserted 'in such contract. A provision to this effect shallb e inserted ~in such contract. The co~tract must be entered into in compl~iance with apd subject to the conditions imposed by Article ~ of the Labor Code of the State Of California. ~ Such contract shall contain a stipulation to the effect that eight ~8) hours s~all con- stitute' a legal day"s work in the performance of the work herein provided for, and that no contractor or subcontractor who employs, directs, or controls the work of any workman em- ployed on public work shall require or permit s~.~ch workman to labor more than ei?~t (8) hours' during any one calendar day, except in cases of extraordinary emergency, caused by fire, flood or dam~e to life or property and shall contain the further 'stipulation which shall provide that the contractor to whom the contract is s~srded shall forfeit as a penalty to said city of South San Franci'sco Ten Dollars (~10.00) for each workman employed in the execution of such contract by the contractor or by any subcontractor for such calendar day duringo which any workman is required or permitted to labor more than eight (8) hours in violation of' the provision of said Article ~. The contract to be awrded shall contain a further stipulation~ that the contractor, to whom s~ch contract may be awarded, shall use or supply only such unmanufactured articles, mater- ials,' and supplies as may have been mined or produced in the United States and only such manufactured articles, materials, and supplies as have been manufactured in the United States, substantially from all articles, materials or supplies mined, proS.uced, or so man~Lfactured, as the case may b e, in the United Btates, excepting only where such articles, materials or supplies of the class or kind to be osed, or the articles, materials or supplies from which they are manufactured are not mined, produced or manufactured, as the case my b e, in the United States, as required by an act of the Legislature of the State of California entitled: 41 · "An act to require the use of materials and supplies substantially produced in the United States, in public works and for public purposes"; Chapter 228 of the Statutes of california, 193Z. The successful bidder shall, within ten (10) days after the award, enter into a contract with the ~ity of South san Francisco for the faithf~l performance of the work to be done under said award. All sealed proposals or bids shall b e accompanied by a check payable to the City of South San Frsncisco certified by a responsible bank for an amount which shall not be less than ten (10) Der cent of the aggregate of the proposal, or by a bond for the said amount ~-~nd 3o payable, siTned by the bidder and two (2) sureties who shall justify before any officer competent to administer an oath in double said amount over and above all statutory exemptions. If the proposal b accepted and the contract awarded and if the bidder shall fail and neglect to execute a contract and ~ive the bonds required, the sum mentioned in said check, or the prin- cipal sum of said bond, as the case may be, shall be liquidated d~a~Tes for such f~il~ and neglect and shall be forfeited to and paid into the treasury of the C~ty of South San Francisco. The bidder to whom the contract is awarded will be required to execut a bond for the fait~l performance of his work in an amount equal to fifty ($0) per cent of the amount of the undertakir~E with at least two ~2) responsible sureties in th full amount of the bond each; and will also be required before enterir~Z upon the work to furnish a ~ood and sufficient bond, as required by an act of the Legislature of the State of Cali~o~nia~ approved ~ay 10, 1919, entitled "An act to secure the payment of claims of persons employed by contractors upon public works and the claims of persons who furnish materials, supplies, teams, implements or machinery used or consumed by such contractor in the performance of such works, and prescribing the duties of cer- tain~oublic officers with resoect~ thereto", Chapter 30~ of the Statues of Cmlifornia, 1919. Plans, specifications and proposal sheets may b e obtained at the office of R.A. Klassen, ~orks Engineer of said City of South San ?rancisco, in the City Hall of said City, in South San Francisco, C~lifornia. Sealed proposals or bid~ will be delivered to the city clerk on or before 8:00 o'clock p. m. on Monday, the Jrd day of April, 194~. All sealed proposals will be opened by said city council in public session on Monday, the 8rd day of April, 1944, at 8:00 o'clock p. m. at the council chamber of said city council.
