RES~b~ION AUTHORIZING T~E EXECUTION OF THE CONTRACT
FGR THE RECONSTRUCTION OF A PORTION OF THE MOST EAST-
ERLY 0UTFALL SE~ER EXTENDING SOUTHERLY FROM EAST ~RAND
AVEN~E IN T~E CITY OF SOUT~ SAN FRANCISCO.
W~EREA~ the portion 'of the most easterly outfall sewer extending southerly from
east Grand Avenue in th~ City of South San Francisco was damaged and destroyed in
connection with the work of removing fertilizer, done at the instance of A. C. Free-
man, on land adjacent to the land on whic~ said outfall sewer heretofore rested, and
said A. C. Freeman has assumed liability for the damage to said sewer ar~ has agreed
to restore and replace the same;
RESOLVED by the City Council ~ maid City of .South San Francisco that said city
enter into a contract with said A. C. Freeman, who is hereinafter designated as
"contraCtor" for the reconstruction of a portion of the most easterly outfall sewer
extending southerly from East Grand Avenue in the City of South SanFrancisco.
The plans and specifications this day submitted by the Works Engineer of said
city for doing said work are hereby adopted.
All said work s~ell b · done at the location shown upon said plans and strictly
'in accordance with said pln~, and specifications. ~ All s aid work and all labor and
materials used in connection therewith snallb~ de~ and furnished under the direction
and to the satisfaction of said Works Engineer.
Said City Council hereby ascertains that tAe general prevailing rates of per
diem wages and- the general prevailing rates for legal holiday and overtime work appli
able to said work to be done are as follows:

Guards, watchmen and other co, non labor, not less than $0.90 per hour.
The rate for any employee not listed in the above schedule shall not be less and
$1~10 per hour for skilled labor, (0.98 for intermediate labor and $0.90 for unskille¢
Ovex~ime work will be double the above rates. Sundays and holidays (except
watchmen) double the abo~ rates.

The following are to be considered holidays: New Year's Day, Decoration Day,
Independence Day, Labor Day, AdmisSion Day, T~aksgiving Day, Christmas Day, Saturdays
ami SundAys.
~e contract hereby authorized shall contain the foregoing provisions with
respect to classification of labor, per diem wage rates and hourly wage rates, also
overtime work rates and holidays.
Said contractor and any subcontractor under him shall pay not less than the
speicified rates to all laborers, workmen and mechanics employed by t2em in the
execution of t~e contract. The contractor s~all forfeit as a penalty to the City of
South San F~ancisco Ten Dollars ($10.00) for each laborer, workman or mechanic emplbyed,
for each calendar day, or portion thereof, such laborer, workman or me cnanlc is paid
less than the sai~ stipulated rates for any work done under said contract, by h~m, or
by any subcontractor under him. And suelx contract s~all contain a stipulation to. this
effect, in accordance with the provisions of Chapter 397 of the Statues of California, 1931.
NOTICE .IS HEREBY GIVEN that neither the contractor nor any subcontractor or agent
or represemtative thereof shall knowingly employ or cause or allow to be employed, on
the work herein provided for, any alien, except in cases of extraordinax-y emergency
caused by fire, flood, or dange~to life or property.
The contractor or subcontractor to whom a contract for said work may be awarded
s~all forfeit as a penalty to the City of South San Francisco Ten Dollars ($10.00) for
each alien knowingly employed in the execution of such contract, for each calendar day~
or portion thereof, during which such alien is permitted or required to labor in
violation of the provisions of Article 4 of the Labor Code of the State of California.
A provision 2o. this effect st~all be inserted in such contract.
The contract must be entered into in compliance with and SUbject to the con-
ditions imposed by Article 3 of the Labor Code of the State of California.
Such contract shall contain a stipulation to the effect that eight (8) hours
shall constitute a legal day's work in the performance of the work herein provided for,
snd that no contractor or subcontractor who employs, directs, or controls the work of
any workman employed on public work shall ~equire or permit such workman to labor more
t~n eight (8) hours during any one calendar day, except in cases of extraordinary
emergency, caused by fire, flood, or danger to life or property and shall contain the
further stipulation which s~all provide that the contractor to whom the contract is
awarded shall forfeit as a penalty to said City of South San Francisco Ten Dollars
($10.00 for each Workman employed in the execution of such contract by the contractor
or by any subcontractor for such calendar day during which any workman is required or
permitted to labor more than eight (8) hours in violation of the provisions of Article 3.
The contract hereby authorized shall contain d further stipulation t~at said
contractor s~all use or supply only such unmanufactured articles, materials, and supplies
as may have been mined or produced in the United States and only such manufactured
articles, materials, and supplies as ha~e been manufactured in the United States, sub-_
stantially from all articles., material_s or supplies mined, produced, or so manufact~r
ed. as the case may be, in ~he United States, excepting only where such articles,
materials or supplies from whic~ t~ey..:are manufactured are not mined, produced or
manufactured, as the case may be, in the United States, as required by an act of the
Legislature of the State of Califow~a entitled: "An act to require the use of materials
and surplices substantially produced in the United States, in public works and for public

Said contractor will be required before entering 'upon the work to furnishd a
good and sufficient bond. as required by an act of the Legislature of the State of Calif-
ornia, approved May 10~ [919, entitled "And act to secure the payment of the claims of
persons employed by contractors upon public work's a4xl the claims of persons who fur-
nish materials, supplies, teams, implements or machinery used or consumed by such con-
tracto~ in tl~e performance of such works, and prescribing the duties of certain public
officers with respect thereto", Chapter 303 of t~e Statutes of California, 1919.
Said A. C. Freeman agrees to reimb~urse said City of South San Francisco for all
engineering ~xpenses, inspection costs and incidental expenses necessary i~ connection
with the reconstruction of said outfall sewer. Before commencing the work to be pe~-
formed under the contract hereby authorized, said A. C. Freeman snall deposit with the
City Clerk of said city the sum of Two Hundred Fifty Dollars ($250.00) to apply upon
t~e expenses provided for in this paragraph. Any portion of said sum of money, which
may be in excess of the actual aaount of SUCh costs and expenses, shall be returned
to said A. C. Freeme~ upon the completion of tDe work in such contract.
Upon the condition that said contractor shall reconstruct said outfall

the expenses provided for in this paragraph. Any portion of said sum of money, whic~
may be in excess of the actual mount of SUCh costs and expenses, shall be returned
to said A. C. Freeman upon the completion of the work in such contract.
Upon the condition that said contractor snail reconstruct said outfall sewer
in accordance with the provisions of this resolution, said City of South San Fran-
cisco will discharge and release said A. C. Freeman, from all liability for damages
sustained by~ reason of the damage to and destruction to said outfall sewer.
The ~ayor and city clerk of said City are hereby authorized and directed, in
the name of ~said city~a~ under its seal,~ to execute the contract hereby authorimed~
