RESOLVED by the City Geuncil of the City ef ~euth San Francis ce that public interest and con- vemience require the following public improvement work to be d~ne ia said city: The construction of a 15 imch.~cene~e~$e pipe storm water wewer, from the intersection ef Laurel Avenue with Baden Avenue, in the City ef Seuth San Francisco, Southerly along th.e Easterly line of I~t Twenty-nine (29), Block Seventy-nine (79), to the Northerly line of Second Lane, thence Southerly across Second Lane te the Southerly line thereef; thence Southerly and across L~t TWelve (12), in said Bleck Seventy-nine (79) to the Northerly gutter line ef Cemmercial Avenue, all as shown upon that certain map entitled: "South San Francisco, Sawn Matee Ce. Cal. Plat No. 1', which map was filed in the office ef the County Recerder of the County ef San Matee, California, March 1, 1892, and recorded in Map Beck Ne. 2 at page 52, together with three (3) brick catch basins with cast iron frames and covers. Ail said work shall be done at the location shown upon the plans hereinafter mentioned and strictly in accordance with the plans and specifications heretofore submitted by the Works Engineer of said city for said work and hereby adopted for said work. Ail said work and the materials used in connected therewith shall be furnished under the direction and to the satisfaction of the W~ks Engineer ef said city. The rate for any enployee not listed in the above schedule shall not be less than $1.10 per hour for skilled labor, $0.95 for intermediate labor and $0.90 for unskilled. Overtime' work will be double the above rates. SUndays and holidays (except watchmen) double the above ra res. The following are to be considered holidays: Ne~ Year~ Day, Decoration Day, Independence Day, Labor Day, Admission Day, Thanksgiving Day, Christmas Day, Saturdays, and Sundays. The City Clerk is hereby directed to cause a notice inviting sealed proposals for doing said work and for the furnishing of all materials necessary therefor te be published by two (2) insertions thereof, and not less than five (5) days apart, in "The Enterprise", a newspaper of general circulatiA~ published and printed in the City of Oeuth San Francisco, which notice shall be substantially in the following fern: NOTICE INVITING SEALED PROPOSALS OR BIDS FOR THE CON- STRUCTION OF A STORM WATER SE~ER IN BLOCK 79, MAP OF SOUTH SAN FRANCISCO PLAT NO. 1, SOUTH SAN FRANCISCO, CALIFORNIA Netice is hereby given that sealed proposals or bids will be received by the City Ceuncil ef the City of South San Francisco on Monday, the 5th day of November, 1945, until the heur~ef $:00 o'clock p.m. for doing the following public improvement work in said city, to-wit.- The construction of a 15 inch concrete pipe storm water sewer, from the intersection ef Laurel Avenue with Baden Avenue, in th~ City ef Seuth San Francisco, Southerly aleng the Easterly line ef Let TWenty-nine (29), Block Seventy-nine (79), te the Northerly Line ef Second Lane; thence Southerly acress Second Lane to the Seusherly line thereof; thence Southerly and across L~t TWelve (12), in said Block Seventy-nine (79) te the Northerly gutter line ef Commercial Avenue, all as shown upon that certain map entitled: ."South San Francisco San Matee Ce. Cal. Plat No. 1", which map was filed in the office ef the County Recorder ef the Ceunty of San Mateo, California, March 1, 1892, and recorded im Map Beek Ne. 2 at page 52, together with three (3) brick catch basins with cast iron frames and covers. Ail the work ef constructing such sewer shall be done at the lecation shown upon the plans fer said work and strictly in accordance with the plans and specifications heretefore adopted fer said work. Ail such w~rk and the materials used in connection therewith shall be furnished under the direction and te the satisfaction ef the Works Engineer ef said city. The rate for any employee not listed in the above schedule shall .net be less than $1.10 per hour for skilled labor, $0.95 for intermediate labor and $0.90 for unskilled labor. Overtime work wi 11 be double the above rates. Sundays and holidays (except watchmen) double the above rates. It shall be mandat~ry upon the contractor te whom the contract .is awarded, and upon any sub- contractor under him, te pay net less than the specified rates te all laborers, mrkmen and mechanics employed by them in the execution of She contract. The contractor shall forfeit as a penalty te the City of ~euth San Franc isce Ten Dollars ($10.00) for each laborer, workman er mechanic employed, for each calendar day, or portion thereof, such laborer, work~n or mechanic is paid less than the said stipulated rates for any work done under said cantract, by him, er by any subcontractor under hiS. Amd such contract shall contain a stipulation to this effect, in accordance with the previsiens of Chapter 397 of the Statutes of Califomia, 1931. Ne bid will be accepted from any c~ntractor who has not been licensed in accordance with the previsions of an act of the Legislature ef the State of California entitled: "An act providing for the registration of contractors, snd defining the term contractor, providing the method ef ebtatning licenses to engage in the business of contracting, and fixing the fees for such lieensee; p~viding the method of suspension and cancellation of such licenses; and prescribing the punishment for violation ef the pre- visions of this act." Chapter 791 ef Statutes and Amendments ef 1929, as amended. NOTICE IS FURTHER HEREBY GIVEN that no contractor or subcontractor or agent or representative thereof shall knowingly employ or cause er allow to be enployed en the w~rk herein provided for any alien, except in cases ef extraordinary emergency caused by fire, flood, or danger or life er property. The contractor or subcontractor to when a contract for said w~rk may be awarded shall ferfeit as a penalty to the City of South San Francisco Ten Dollars ($10.00) for each alien knowingly employed in the execution of such contract, for each calendar day, or portion thereof, during which such alien is permitted or required to labor in vi olation of the provisions of Article 4 ef the Labor C~de of the State of Galtfernia. A prevision t~ this effect shall be inserted in such contract. The contract mst be entered into in c~mpliance with and subject to the conditions imposed by Article 3 of the Labor Cede of She State ef California. Such contract shall contain a stipulation te the effect that eight (8) hours shall constitute a legal day's work in the performance ef the work herein provided fer, and that no contractor er subcentracte] ~ho employs, directs, er controls the work ef any ~rkman employed on public w~rk shall require er permit such workman te l~ber mere than eight (8) hours during any ~ne calendar da.y, except in cases ef extra- erdinary emergency, caused by fire, flood er danger te life er property and shall contain the further stipulation which shall ~mvide that the contractor te whom the contract is awarded shall ferfeit as a penalty te said City of South San Francis co Ten Dellars ($10.00) for each w~rkman employed in the execution ef such contract by the con ~ractor er by any subcontractor foe each calendar day during which any workman is required or permitted to labor more than eight (8) hours in violation ef the provisions of said Article ~ 2O The contract te be awarded shall contain a further stipulation that the contractor, to when such contract may be awarded, shall use or supply only such unmanufactured materials, produced in the United States, er substantially from materials produced in the United States, excepting only where such articles, materials er supplies from which they are manufactured, are not mined, p~uced er manufactured, as the case may be, in the United States, as required by Ohap~r 4, Article 1 of the Government Cede ef the State ef California. Price, fitness and quality being equal said contractor shall, in the performance ef the contract, prefer supplies grown, manufactured, er produced in ~he State ef California, and shall next prefer supplies partially manufactured, grown er produced in this state. The successful bidder shall, within ten (~0) da~s after the award, enter into a contract wi th the City of ~euth' San Francisce for the failtful performance ef the work te be done under said award. Ail sealed proposals er bid~s shall be accompanied by a c hock payable te the Ci~ ef ~c~th Sam Francisco, certified by a responsible bank for an amount which shall not be less than ten (10) per cent ef the aggregate of the pre- posal, or by a bond for the said amount and se payalbe, signed by the bidder and two (2) sureties who shall justify before any officer competent teadminis~er~an oath in dou01e said amount over and above all statutory exemptions. If the p~posal be accepted and the contract awarded and if the bidder shall ~ail and neglect te execute a contract and give the bends required, the sum men~oned in said check, or the principal sum ef said bend, as the case may be, shall be liquidated damages for such failure and neglect and shall be forfeited to and paid into the treasury ef the City of South ~an Francisco. The bidder te when the contract is awarded will be required te execute a bend for the f~ithful performance ef his w~rk in an ameumt equal te fifty (50) per cent ef the amount ef the undertaking with at least two (2) responsible sureties in the full amount ef the bend each; and will also be required before enterim~ upon the work te furnish a geed amd sufficient bend, as required by an act ef the Legislature ef the State of Califernia, approved May 10, 1919, entitled WAn act te secure the payment ef the claims ef persons employed by oentracters upon public werks and the claims ef persons robe fUrnish materials, supplies, teams, implements er machinery used er consumed by such contractor ia the performance ef such works, and prescribing the duties ef certain public officers with respect therete", Chapter 303 ef the Statutes ef California, 1919. Plans, specifications and proposal sheets may be obtained at the office ef Charles T. Breughton, Werks E~gineer ef the City of South San Francisco, in the City Hall ef said city, in Seuth San Francisco, California. Sealed proposals er bids will be delivered te the City Clerk en er before 8~$0 e'cleck p.m., en Monday, the 5th day of November, 1945. Ail sealed proposals will be opened by said City Council in public session on Monday, the 5th day ef November, 1945, at 8:00 o'clock p.m., at the Council Chamber ef said City Council.
