Ail said work shall be done at the location shown upon the plans h~reinafter mentioned and strictly in accordance with the plans and specifications heretofore sub- mitted by the Superintendent of Streets of said city and hereby adopted for said work· Ail said work and the materials used in connection therewith shall be furnished under the direction and to the satisfaction of the Superintendent of Streets of said city. All t~e work of constructing such fence shall be done at the location shown upon the plans for said work and strictly in accordance with the plans and specifications heretofore adopted for said work. For the duration of the wars in which the United States of America is now engaged, payment for overtime work shall be made in accordance with the executive order of the Presi- dent of the United States of ~merica, dated September 10, 1942, if such payment for overtime is legally subject to and legally controlled by said order. No bid will be accepted from any contractor w~o has not been licensed in accordance with the provisions of Division III, Chapter 9 of tae Business and Professions Code of the State of California. A provision 'to this effect shall be inserted in such contract· The contract must be entered into in compliance with an¢~ subject to the conditions imposed by Division Ii, Part V,Chapter 1, Article 3 of the Labor ~ '~ ~oae of the State of Califor~ia. The contract to be awarded shall contain a further stipulation that the con- tractor, to whom such contract may be awarded, s~mll use or su-pply only such unmanu- factured materials, produced in the bnited States, or substantially from materials, pro- duced in tim United States, excepting only where such articles, ma.~ermal~ or su~:plies from which t±~ey are manufactured are not mined, produced or manufactured, as the case may be, in the United States, in accordance with the provisions of Title 1, Division 5, CTapter 4, Article 1 of the Government Code of the State of California. Price, fitnsss and quality being equal, the successful bidder shall, in the performance of his contract, prefer supplies grown, manufactured or produced in the State of California, and shall next prefer supplies partially manufactured, grown or produced in this State, as required b]~ Title 1, Division 5, Article ~ of tl'~e Government Code of the State of California. The successful bidder s~mll, within ten (10) days after the award, enter into a contract with the City of South San Francisco for t~e faithful performance of the work to be done under sa. id award. All sealed proposals or bids shall be accompanied by a check payable to the City of South San Francisco, certified by a responsible bank for an amount which shall not be less than ten (10) per cent of the agflregate of the proposal, or by a bond for said amount and so payable, signed by the bidder and two (~) sureties who shall justify before any officer competent to administer an oath in double said ~uount over and above all statutory exemptions. If the proposal be accepted and the contract a~arded and if the bidder shall fail and neglect to e:~ecute a contract and give the bonds required, the sum mentioned in said check, or the principal of said bond, as the case may be, shall be liquidated damages for such fai lure . ., and neglect and slmll be forfeited to and paid into the treasury of the City of South San Francisco. The bidder to whom the contract is awarded will be required to execute a'bond for the faithful per- formance of his work in an amount equal to fifty (50) per cent of the amount of the under- taking with at least two (2) responsible sureties in the full amount of the bond each; and will also be required before entering upon the work to furnish a good and sufficient bond, as required by Title l, Division 5, Chapter 3 of the Government Code of the State of California. Plans, specifications and proposal sheets may be obtained at the office of Henry Schweining, Superintendent of Streets of said City of South San Francisco, in the City Hall of said city, in South San Francisco, California. Sealed proposals or bids will be delivered to the City Clerk on or before 8:00 o'clock P.m. on Monday, the 18th day of ~arch, 1948. All sealed proposals will be opened by said City Council, in public session, on ?,,Ionday, the 18tl~ day of ~[arch, 1948, at 8:00 p. m., at the Council Chamber of said City Council. Said City Council hereby reserves the '~~ in its discretion, to reject any and all bids and to award a contract for all said work or for any portion or portions thereof.
