HomeMy WebLinkAboutReso 1095-1946 RESOLUTION OF INTENTION No. 1095 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DECLARING ITS INTENTION TO IMPROVE STREETS AND OTHER AREAS IN THE SUB- DIVISION IN SAID CITY. OF SOUTH SAN FRANCISCO KNOWN AS RANCHO BURI-BURL WHEREAS public interest and convenience require that the work and improvements hereinafter de- scribed should be done; and WHEREAS, in the opinion of the City CoUncil of the City of South San Francisco, said contemplated work and improvement is, and is hereby declared to be of more than local or ordinary public benefit; and WHEREAS Burl Burl Homes, Inc., a corporation, as the owners of all that certain tract of land deline- ated upon that certain map entitled: "Rancho Buri-Buri South San Fran- cisco, California," which map was filed in the office of the County Recorder of the County of San Ma- tee, California, March 22, 1946, and recorded in Book 25 of Maps at pages 28, 29 and 30, has filed with the City Clerk of said city an in- strument in writing reading as fei lows: "WAIVER OF PROVISIONS OF SPE- CIAL ASSESSMENT INVESTIGA- TION, LIMITATION AND MAJOR- ITY PROTEST ACT. Burl Burl Homes, Inc., a corpora- tion organized and existing under the laws of the State of California, as owner of all that certain tract or parcel of land delineated upon that certain map entitled: "Rancho Burl Burl South San Francisco, Califor- nia,'' which map was filed in the office of the County Recorder of the County of San Mateo. California, March 22, 1946, and recorded in Book 25 of Maps at pages 28, 29 and 30, hereby waives the benefit of that certain act of the Legisla- ture of the State of California known and designated as the "Spe- cial Assessment Investigation, Limi- tation and Majority Protest Act of 1931," with~ respect to all the im- provements hereinafter mentioned. The construction of a sanitary sewer in and through a strip of land along the following described center line: Beginning at a point which bearsI North 39 degrees 59 minutes 30t seconds West 41.91 feet and South:I 49 degrees 36 minutes West 32.95i feet from the most easterly corner of Lot "A," as said lot is designated I on that certain map hereinbefore~ mentioned; running thence from said point of beginning North 57 de- grees 41 minutes East 248.00 feet to a point in Old Mission Road; thence North 22 degrees 10 minutes 30 seconds West within the bound- aries of said road, 291.30 feet to a point in the intersection thereof with Chestnut Avenue, as said road and avenue now exist in said City of South San Francisco; thence North 43 degrees 31 minutes 30 seconds East and 15 feet north- westerly from the center line of said Chestnut Avenue 486.20 feet to a point which is 21 feet north- easterly from the center line of a 50 foot drainage canal right of way, owned by the City of San Francisco; thence South 59 degrees 46 minutes 30 seconds East and parallel with the center line of said right of way 2183.00 feet, more or less, to the northwesterly line of Orange Ave- nue, as said Orange Avenue now ex- ists in the City of South San Fran- cisco. All avenues and drives, lot and block numbers 'and the areas des- ignated P.U.E. are shown upon the map hereinbefore referred to. Said lanes and Chico Court are also shown upon said map. All the work herein provided for shall be done in accordance with the special plans, profiles and speci- fications for said work, and at the location and to the grades shown upon said plans, which plans, pro- files and specifications are entitled: "Plans and specifications for the construction of improvements in the tract of land shown on Map of Rancho Buri Buri, South San Fran- cisco, California," which plans, pro- files and specifications were here- tofore adopted by said City Council on the 23rd day of April, 1946, and are now on file in the office of the City Clerk. Reference is hereby made to said plans, profiles and specifications for a full description of said work and for the location and the extent of the work to be done hereunder and for the grades to which said work is to be done, and for a particular description of the boundaries of the district herein mentioned. Said City Council does hereby de- termine and declare that said pro- posed work and improvement is of more than local or ordinary public benefit and will affect and benefit the lands and district hereinafter described, which said district is hereby declared to be the district benefited by said work and improve- ments and that, therefore, the en- tire cost and expense of said work and improvement shall be and hereby are made chargeable against and shall be assessed upon said lands and district, except as here- inafter expressly provided, which district is within the City of South San Francisco, County of San Mateo, State of California. and particularly described as follows, to-wit: The exterior boundary of all that certain tract of land delineated up- on that certain map entitled: "Rancho Buri-Buri South San Fran- cisco, California," which map was filed in the office of the County Re- corder of the County of San Mateo, California, March 22, 1946, and re- corded in Book 25 of Maps at pages 28, 29 and 30, saving, excepting and excluding from said district all pub- lic streets, avenues and alleys, lanes, courts and places included and con- rained. Notice is hereby given that serial bonds to represent unpaid assess- ments, and to bear interest at the rate of five (5) per cent per annum, will be issued hereunder in the man- ncr provided by Division 10 of the Streets and Highways Code, the Im- .provement Bond Act of 1915, and the last installment of such bonds shall mature fourteen (14) years from the second day of July next succeeding ten (10) months from their date. The South San Francisco Journal, a newspaper of general circulation, printed and published in said City of South San Francisco. is hereby designated as the newspaper in which this resolution of intention shall be published, and the City Clerk is hereby directed to cause this resolution of intention to be published by two (2) insertions in the manner and form required by law. Said City Clerk is also directed to mail a notice of the adoption of said resolution of intention, postage pre- l~aid, to all persons owning real pro- perry which is proposed to be ass- essed to pay any part of the cost of said work, whose names and ad- dresses appear on the last equalized assessment roll, or as known to said City Clerk. The Superintendent of Streets shall cause to be conspicuously posted along the line of said con- templated work or improvements, at not more than three hundred (300) feet in distance apart, but not less than three (3) in all, and along all the open streets within said district at not more than three hundred (300) feet in distance apart on each said street, notices of the passage of this resolution of inten- tion, in the manner and form re- quired by the "Improvement Act of 1911." Notice is hereby given that on Tuesday, the 14th day of May, 1946, at the hour of 8 o'clock p. m., in the Council Chamber of said City Council of the City of South San Francisco, any and all persons hav- ing any objections to the proposed work and improvements may appear before said City Council and show cause why said proposed work and improvements should not be carried out in accordance with this resolu- tion. Except as hereinbefore provided, all of the herein proposed work shall be done pursuant to an act of the Legislature of the State of Califor- nia designated as "Improvement Act of 1911."
