HomeMy WebLinkAboutReso 1107-19468O 1107 OF SUCH WHEREAS the City Council of the City of South San Francisco did, on the 30th day of March, lC%S, pass its Resolution of intention No. e8% for the improvement of c'ertain streets in said resolution of intention mentioned and described, under and pursuant to the provisions of the "Improvement Act of 1911"~ ar~! tbs amaendments thereto, reference to said resolution of intention being hereby expressly made for a descripti.'-~n of said work and the district in said re r~oluti on of intention described, and for further particulars; and WHeReAS the contract for said work an~ improvements was duly awarded to Edward Keebl~ and thereafter was duly completed to the satisfaction of the Superintendent of Streets of said city, wh{~reupon a diagram and assessment were duly made; and WP1EREAS, after due notice of tim filing of said assessment was siren, as provided by law, and said assessment was~ on the 18ti~ day of October, lg%$, confirmed 'by the City Council of said City of South San ~'ranc~ sec and a warrant thereupon was attaci~.ed thereto by said Superintendent of Streets and thereafter said diagram, assessment and warrant were duly recorded by said Superintendent of Streets and then delivered to the contractor in the time, form and manner required by said act; and said warrant having been duly returned to said Su~'~er- intendent of Streets with tb.e written statement showing that no payments have been received upon said assessment, which statement was signed by said contractor and was thereupon duly filed by said Superintendent of Str~:ets with the record of said warrant ~d assessment, and Wi~EREAS, on the 2Stk day of November, 1948, said ~uperm~_vendent of Streets of said city filed with the clerk of said City 0ounoil a complete list of all assessments ~paid under said assessment upon the respective assessment or {!ia(?~ n~fbers thereon, whereupon said City Clerk duly save notice of the fili~ of said list, havinf} fi~.ed Nonday, the 7th day of Jan- uaPy, t~%8~ at the hour of 8:00 o~clock p.m., as ~he 'time Wen interested persons may apFear before sa~d City Soleil and show cause why bonds should not 'be issued upon the security of ti~e unpaid assessment shown upon said list, said time bein~Z that of a regular meetin~Z of ~,~co¢~eenev, C~_ty Clerk of said City Council; and it app~arinS from the affidavit of Daniel said City, which a~(~_mdavmt is now on ~'ile in the office of the emty Clerk, that said notice was posted as required by law; and it likewise appearing f~m the affidavit of }.{yra Spangler, which affidavit is now on file in the office of the Ci't.y Clerk~ that said notice was published as required by law; and ~4~, mail a copy of ~iIERIgAS said City Clerk did, on the 28th day of November, 1.e ~ said notice %o t.h~e owners of all. lots listed on said assessment, as known to said City Clerk, as appears ~'rom thc affidavit of said Daniel idcSweeney, on file herein; a-ad ?~i~xi~AS said Edward Keeble of said City Clerk, as.si.sued and transferred said warrant to Stone P Younc~berg; and Wi~EAS no person kas at any ti~.e made any objection against the issuance of bonds, it is hereby determined that the assessments unpaid and the aggregate amount of the same are as follows: DIAGRAM AND ASoESo~...E::~ .qNusER ',~ 28 0. An even annual proportion of each assessment shall be payable in each year precedinf] tho date of maturity of each of the several series of bonds, and such proportion of each assessment comins due in any year, to- t:ether with the annual interest thereon shall in turn be payable in installments the same as the general municipal taxes of said City of ooutn San Francisco on real property are payable, az~ si~all become delinquent at the smme time and in the same proportionate amounts and bear the same proportionate penalties for delinquency.
