HomeMy WebLinkAboutReso 1166-1946RESOLUTION NO. 1166 Declaring Intention to Improve Commercial Avenue between the Easterly line of Oak Avenue and the Westerly Line of Chestnut Avenue WHEREAS public interest and convenience require that the work and improvements herein- after describe6 should be done; and WHEREAS, in the opinion of the City Council of the City of South San Francisco, said contemplated work and improvement is, and is hereby declared to be of more than local or ordinalv public benefit; and WHEREAS the owners of the entire area of the district of land proposed to be assessed to pay the costs and expenses of the improvement work hereinafter mentioned have, by an instrument in writing, waived the benefit of that certain act of the Legislature of the State of California known and designated as "The special Assessment Investigation, Limitation and ~aJority Protest Act.of 1931", and have requested that the improvement work hereinafter mentioned should be performed and that the costs of said improvement work be assessed upom the district hereinafter mentioned; and WHEREAS an estimate of the cost and expense of said work has been filed with the City Clerk of said city; and NOW, THEREFORE, RESOLVED by the City Council of the City of South San Franc~co that it is the intention of said City Council to order the following work.and improvements to be done in said city; the improvement of Con~ercial Avenue in said City of ~outh ~an Francisco from the westerly ~ line of Chestnut Avenue to the easterly line of Oak Avenue by grading for pavement and ~the construction of a five-inch (5") water-bound macadam base with two and one-tialf (2~) inch asphaltic concrete wearing sL~face, thirty-five (35) feet in width and the construction of concrete curbs, gutters and sidewalks. All the work herein provided for shall be done in accordance with the special plans, profiles and specifications for said work and at the location for said work and to the grade shown upon said plans, which plans and specifications were adopted by said City Council on the 30th day of December, 1946, and are now on file in the office of the City Clerk. Reference is hereby made to said plans and specifications for the description of said work and for the location and the extent of the work to be done ttm~eunder and for the grades to which said work shall be done, and for a particular description of the boundaries of the district herein merit ioned. Said City Council does hereby determine and declare that said proposed work and improvement is of more than local or ordinary public benefit and will affect and benefit the lands and district hereinafter described, which said district is hereby declared to be the district benefited by said work and improvements, and that, therefore, the entire costs and expense of said work and improvement shall be ~nd hereby are ma6e chargeable against and shall b e assessed upon said lands and district, except as hereinafter expressly~ provided, which district is within the City of South San Francisco, County of San Mateo, State of California, end particularly described as follows, to wit: Commencing at a point which bears north 74° 27' west 80 feet from the most westerly corner of Lot 20 Block 79 as delineated on that certaim map entitled "South San Francisco San Mateo Co. Cal. Plat No. 1" recorded March l, 1892 at page 52 in Book of Maps, San Mateo County Records; thence, from said point of commencement, along the northwesterly boundary of Chestnut Avenue, as delineated on the above mentioned map of South San Francisco, north 15° 33' east 4~ feet; thence ~.aving said boundary and running north ~4° 27' west 100 feet, north 15° 33' east 45 feet~ north ~4o 2~' west 60 feet north 15° 33' east l0 feet, north 74° 27' west 37.90 feet, and north 360 4~. west 344.20 fee~ to a point in the southeasterly boundary of Oak Avenue; thence along said boundary^south 53° 15' west 210 feet, th~ence leaving said boundary south 36°A45' east 140 feet, south 53v 15' west 148.84 feet, south 36v 45' east 180.49 feet, ~a~.d south 68~ 20' east 365.20 feet to a point in the north westerly_boundary of Chestnut Avenue, thence along said boundary north 43° 33' east 154.11 feet and north 15v 33' east 72.69 feet to the point of commencement. Notice is hereby given that serial bonds to represent unpaid assessments and to bear interest at the rate of five (5) per cent per annum, will be issued hereunder in'the manner provided by Division l0 of the Streets a~d Highways Code, the Improvement Bond Act of 1915, and the last installment of such bonds shall mature four.(4) years from the 2nd day of July next succeeding ten (10) months from their date. "The Enterprise", a newspaper of general circulation, printed and published in said City of South San Francisco, is hereby designated as the newspaper in which this resolution of intention shall be published, and the City Clerk is hereby' directed to cause this resolution of intention to be published by two (2) insertions in the manner and form required by law. Said City Clerk is also directed to mail a notice of the adoption of this resolution of intention, postage prepaid, to all persons owning real proper~ty which is proposed to be assessed to pay any part of the costs of said work, whose names and addresses appear on the last equalized assessment roll of said city or as known to said City Clerk. The Superintendent of Streets ahall cause to be conspicuously posted along the line of said contemplated work or improvements, not more than three hundred (S00) feet in distance apart, but not less than three (3) in all, and along all the open streets within said district, at not 'more than three hundred (300) feet in distance apart on each of said streets, notices of the passage of this resolution of intention, in the ~_nner and form required by "The Lmprovement Act.of 1911". Notice is hereby given that on Monday, the 20th day of January, 194V, at the hour of 8 o'clock p.m., in the Ceouncil Chamber in the City Hall of the City of South San Francisco, any and all persons having any objections to the proposed work and improvements may appear before said City Council and show cause why said proposed work and improvements should not be carried out in accordance with this resolution. Except as hereinbefore provided, all of the hereinbefore work shall be done pursuant to an act of Legislature of the State of California, designated as "Improvement Act of 1911".
