HomeMy WebLinkAboutReso 1175-1947city Clerk RES0 LUTI ON #117 5 A RESOLUTION OF THE CITY COUNCIL OF ~HE CITY 0F SOUTH SAN F~ANCISC0 DECLARING ITS INTENTION TO I~P~.0~YE C0~&~ERCIAL AVENUE BETWE~ THE EASTE~LY LINE OF OAK AVENUE At~U3 £HE YVESTERLY LIY~E OF CHESTNUT AVE. t~EREAS public interest and convenience require that the work and improvements herein- after described should be done; aud :?fHEREAS, in the opinion of the City Council of the~Oity of SoUth San'Francisco, said contemplated work and improvement is, and is hereby declared to be of more than local or ordinary public benefit; and WHEREAS the. owners of the entire area of the district of land proposed to be assessed to pay the costs and expenses of the improvement work hereinafter mentioned have, by an instru- ment in writing, waived the benefit' of that certain ~a ct of the. Le.gislature of the State of California known and designated at "The Special Assessment investigation, Limitation and l~Iajority Frotest Act of 1931" and have requested that the improvement work hereinafter mentioned , should be performed and that. the costs of said improvement work be assessed upon the district hereinafter mentioned, and WHEREAS an estimate of the cOst and expense of said work has been filed with the City Clerk of said city; and N0',;'I, THEREFORE, RESOLVED by the City Oouncil of the City of South San Prancisco that it is the intention of said City Council to order the following work and improvements to be done in said city; the improvement of Commercial Avenue in said City of South San Francisco from the westerly line of Chestnut Avenue to the easterly line' of Oak Avenue by grading for pave- ment and the construction of a five-inch (5") water-bound macadam base with two and one,half (2~) inch asphaltic concr, ete wearing surface, thirty-five (35) feet in width and the construction of concrete curbs, gutters and sidewalks. .All the work herein mprovided for shall be done in accordance with the special plans, profiles and specifications for said work and at the location for said work and to the grade shown upon said plmns, which plans and specifications were adopted by said City Council on the 30th. day of December, 194~, and are now on file in the office of the City clerk Reference is here0y made to said plans and.sl~ecffications for the description of said work and for the location and. the extent of the work to be done thereunder and for the greades to which said work shall be done, ar~ for a particular description of the boundaries of the district herein mentioned. Said City Council does hereby determine and declare that said proposed work ~nd improve- ment is of more thqn local- or ordinary public Beiaefit and will affect and benefit the land and district hereinafter described, which said district is he~eby declared to- be the district benefited by said work and improvements, and that, therefore, the entire costs and expense of said work and improvement shall be and hereby are made chargeable against and shall be ~assessed upon said ]and and district, except as hereinafter expressly provided, which district is within the City of South San Francisco, County of Sam Nateo, State of California, mud particularly described as follows, to wit: Commencing at a point which bears north V4° 27' west 80 feet from the most westerly corner of Lot 20 Block 79 as delineated on that certain map entitled; "South San Francisco San ~,'lateo Co. Cal. Plat ~io. l" recorded ~arch l, 1892, at page 52 in Book 2~of i~,aps, San i~;ateo County Records; thence, from said point of ~=mencement, along the northwesterly boundary of Ohestnut Ave. as delineated on the above mentioned map of South San Frarcisco, north 15° 33' east 45 feetl thence leaving said boundary and running north 74° 27' west 100 feet, north 15° 33' east 45 feet, north 74° 2V* west 60 feet north 15° 33i east l0 feet, north V4° 27'west 37.90 feet; and north 36° 45~ west 344.20 feet to a point in the southeasterly boundary of Oak Ave:.-.ue; thence along said boundary south 53° 15' west 210 feet; thence leaving said boundary south 36° ~5' east 140 feet, south 53o 15' west 148.84 feet, south 36° 45' east 180.49 feet, and south 68° 20' east 365.20 feet to a point in the northwesterly_boundary of Chestnut Avenue; thence along said boundary north 43° 33' east 15~.ll feet and north 15° 33' east 72.69 feet to the point of commencement. Notice is hereby given that Serial Oonds to represent unpaid assessments and. to bear interest at the rate of five (5] per cent per annum, will be issued hereunder in the manner provided by Division l0 of the Streets and Highways Cods, the Improvement Bond Act of 1915, and the ~ st installment of such bonds shall mature four (4) years from the 2nd day of July next succeeding ten (10) months from their date. "The Enterprise" a newspaper o* general circulation, printed and published in said City of South Ss~ Francisco, is hereby desi~ated as the newspaper in which this resolution of intention shall be published, and the City Clerk is hereby directed to cause this resolution of intention to be published by two (2) insertions in the manner and form required by law. s~id ~ity Clerk is also directed to mail a notice of the adoption of this resolution of intention, postage prepaid, to all persons owning resl property which is proposed to be assessed to pay any part of the costs of said work, whod names and addressed appear on the last equalized assessment roll of said city or known to said City.Clerk. The Superintendent of Streets shall cause ~6o be conspicuously posted alo.ng the line of said contemplated work or ~!morov.ements, not more than three hundred (~00~ feet mn distance apart, but not less tha~ three ~) mn all, and long all the open streets w~hin said district, at not more than three hundred (~00) feet~in distance apart on each of said streets~ notices of the passage of this resolution of intention, in the manner and fore required by Improve-'~ ment Act of 1911". ~ Notice is hereby given that on ~¥~ionday, the 3rd day of February, 1947, at the hour of 8 5'clock p.m., in the Council Chamber Lin the~City'~Hall of the City of South San Francisco, any and all persons having a~y objections to the proposed work snd improvements may appear before said City Council and show cause why said propSsed work and improve~nents should not be ca~,ied out in accordance with this resolution. Except as hereinbefore provided, all of the hereinbefore mentioned work shall be C ~ done t?ursuant to an act of the Legislature of the ~tate of ali~.orr~a, designated as "i~r~prove- ment ~ct of 1911".
