HomeMy WebLinkAboutReso 1181-1947RESOLUTION NO. 1181' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRAN~SC0 DEELARING ITS INTENTION TO IMPROVE SECOND LANE BETWEEN THE WESTERLY LINE OF ORANGE AVENUE AND THE EASTERLY LINE OF EUCALYPTUS AVENUE WHEREAS public interest and convenience require that the work and improvement.hereinafter described should be done; and WHEREAS, in the opinion of the City Council of the City of South San Francisco, said contemplated work and improvement is, and is hereby declared to be of more than local Qr ordinary public benefit; and WHEREAS the owners of more than eighty-five (85) per cent~of the district of land proposed to be assessed to pay the costs and expenses of the improvement work hereinafter mentioned have, by an instrument in writing, waived the benefit of that certain act of the Legislature of the State of California known and designated as "The Special Assessment~Investigation, Limitation and Majority Protest Act of 1931," and have requested that the improvement work hereinafter mentioned should be performed and that costs of said improvement work be assessed upon the district hereinafter mentioned. In said instrument in writing, it is provided as follows: "We, the owners of the lots or parcels of land situate in the City of South San Frencisco, County of San Mateo, State of California, and designated opposite our respective names, and located in Block numbered Eighty-two ~82) as shown upon that certain map entitled: "SOUTH SAN FRANCISCO, SAN MATE0 CO. CAL. PLAT NO. 1", which map was filed in the office of the County Recorder of San Mateo County, State of California, and recorded in Map Book 2 at page 52, hereby request the City Council of said city to commence proceedings under that certain street and improvement act known as the "Improvement Act of 1911" and the act known as the "Improvement Bond Act of 1915", for the improvement of the portion of Second Lane, in said City of South San PYancisco, extending from the westerly lineof Orange Avenue to the easterly line of Eucalyptus Avenue by grading for pavement and the construction of a cement concrete pavement five (5) inches thick and the construction of two (2) sewer clean-outs, six (6) inches in diameter with cast-iron covers, in accordance with the plans and specifications for said work now on file in the office of the City Clerk of said city. "We, and each of us, hereby weive the benefit of that certain act of the Legislature of the State of California known and designated as 'The Special Assessment, Investigation, Limitation and Majority Protest Act of 1931', with respect to the improvement of said portion of Second Lane." "We request that the costs of said improvements be assessed upon the land described in said block numbered eighty-two (82), as the district to be benefited by such improvement"; and WHEREAS an estimate of the cost and expense of said work ha~ been filed with the City Clerk of said city: NOW, THEREFORE, resolved by the City Council of the City of South San Francisco thet it is the intention of sa~id City Council to order the following work and improvements to be done in said city: The improvement of the portion of Second Lane in said City of South Sen Francisco extending from the westerly line of Orange Avenue to the easterly line of Eucalyptus Avenue by grading for pavement and the construction of a cement concrete pavement five (5) inches, thick and the construc~t- ion of two (2) sewer clean-outs, six (6) inches in diameter with cast-iron covers, in accordance with the plans and specifications for said work now on file in the office of the City Clerk of said city. All the work herein provided for shall be done in accordance with the special plans, profiles an~ specifications for said work, and at the location for said work and to the grade shown upon said plans, which plans and specifications were adopted by said City Council on the 12th day of November, 1946, and are now on file in the office of the City Clerk. Reference is hereby made to said plans and specifications for the description of said work and for the location and the extent of the work to be done thereunder and for the grades to which said work shall be done, and for a particular description of the bodndartes of the district herein mentioned. Said City Council does hereby determine and declare that said proposed work end improve- ment is of more than local or ordinary public benefit and Will affect and benefit the lands and district hereinafter described, which said district is hereby declared to be the district benefited by said work and improvements, and that, therefore, the entire costs and expense of said work and i~provement shall be and hereby are made Chargeable against and shall be assessed upon said lands and district, except as hereinafter expressly provided, which district is within the City of South San Francisco, County of San Mateo, State of California, and particularly described as follows, to wit: Block numbered eightj-two (82) as shown upon that certain map entitled: "South San Francisco, San Mateo Co. Cal. Plat No. l", which map was filed in the office of the County Recorder of the County of San Mateo, State of California, ~arch l, 1892, and recorded in Map Book No. 2 at page 52; saving excepting and excluding f~'.om said district all the public streets, avenues and alleys, lanes, courts and places included and contained. Notice is hereby given that Serial ~onds to represent unpaid assessments aud to bear interest at the rate of five (5) per cent per annum, will be issued hereunder in the manner provided by Division l0 of the Streets and Highways Code, the Improvement Bond Act of l~lS, and the last install- ment of such bonds shall mature four (~) years from the 2nd day of July next succeedlng~ten (10) months from their date. "The Enterpriss", a newspaper of general circulation, printed and published in said City of South San Francisco, is hereby designated as the newspaper in which this resolution of intention shall be published, and the City Clerk ic hereby directed to cause this resolution of intention to be published by two (2) insertions in the manner and form required by law. Said City Clerk is also directed to mail a notice of the adoption of this resolution of intention, postage prepaid, to all persons owning real property which is proposed to be assessed to pay any part of the costs of said work, whose names and addresses appear on thc !~ct equalized assessment roll of said city or as known to said City Clerk. The Superintendent of Streets shall cause to be conspicuoUsly pos'tedlalong the line of said contemplated w~rk or improvements, not more than three hundred (300) feet in distance apart, but not less than three (3) in all, and along all the open streets within said district, at not more than three hundred (300) feet in distance apart on each of said streets' notice~ of the passage of this resolution of in~ention, in the manner and form required by the "Improvement Act of 1911". Notice is hereby given that Monday, the 17th day of February, 1947, at the hour of 8 o'clock p.m., in the Council Chamber in the City Hall of the City of South San Francisco, any and all persons having any objections to the proposed work and improvements may appear before said City Council and show cause why said proposed work ~nd improvements should not be carried out in accordance with this resolution. Except as hereinbefore provided, all of the hereinbefore mentioned work shall be done pursuant to an act of the Legislature of tb.e State of Cslifornia, designated as "Improvement Act of 1911." I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco this 2~th day of January, 194V by the follow- ing vote: Ayes, Councilmen: G.
