HomeMy WebLinkAboutReso 1189-1947RESOLUTION N0. 1189 A RESOLUTION OF THE CiTY COUNCIL OF THE CITY OF SOUTH SAN FRA~CI~C0 DE~,.LARING ITS INTENTION TO I~,~P~i0VE COi~ERCIkL AVENUE BETWEEN THE EASTERLY LINE OF OAK AVE?iIUE AND THE WESTEi:~LY LINE OF C~ESTNUT AVENUE WH~EAS public interest and convenience require that the work and improvements herein- after described should be done; and WHEREAS, in the opirflon of the City Council of the City of South ~an Francisco, s aid contemplated work and improvement island is hereby declared to be of more than local or ordinary public benefit; and ?~HEREAS the o~'mers of the entire area of the district of land proposed to be assessed to pay the costs and expenses of the improvement work hereinafter mentioned have, by an instrument in writing, waived the benefit of that certain act of the Legislature of the State of California known and designated as "The ~pecial Assessment Investi£~ation, Limitation and ~.[ajority rrotest Act of 1951", and have requested that the improvement work hereinafter mentioned should be per- formed and that the costs of said improvement work be assessed upon the district hereinafter mentioned; and ?~EREAE an estimate of the cost and expense of said work has been filed with the City Clerk of said city; and NOJ, THE~FORE, RESOLVED by the City Oouncil of the 0ity of South San Francisco that it is the intention of said City Council to order the foil. owing work and improvements to be done in said city; the improvement of Con~nercial Avenue in said City of South ~an Francisco from the westerly line of Chestnut Avenue to the easterly line of Oak Avenue 'Dy grading for pavement and the construction of a five-inch (~") water-bound macadam base with two and one-half (~) inch asphaltic concrete wearing surface, thirty-five (~8) feet in width and the construction of concrete curbs, gutters and sidewalks. All the work herein provided for shall be done in accordance with the special plans, profiles and specifications for said work and at the location for said work and to the grade shown upon said plans, which plans and specifications were adopted by said City Council on the Z0th day of ~ecem0er, 19~8, and are now on file in the office of the City Clerk. Reference is hereby made to said plans and specifications for the description of said work and for the location and the extent of the work to be done thereunder and for the zrades 'to ~nich said work shall be done, and for a particular description of the boundaries of the district herein mentioned. Said City Council does hereby determine and declare that said proposed work and improve- ment is of more than local or ordinary public benefit and will affect and benefit the lands and district hereinafter described, which said district is hereby declared to 'ce the district benefited by said work and improvements, an~. that, therefore, the entire cost and expense of said work and improvement shall be and hereby are made chargeable against and shall be assessed upon.~said lands and district, except as hereinafter expressly provided, which district is within the ~ity of South San Francisco, County of Osn ~ateo, State of Californi&; and particularly described as follows$ to wit: Commencing at a point which bears north 74° 2V' west 80 feet from the most westerly corner of Lot 20 Clock 79 as delineated on that certain map entitled: "South San Francisco, oan ~ateo Co. Cal. Plat ~o. l" recorded ~larch l, 1892 at page 52 in Book 2 of maps, San ~'~ateo County Records; thence, from said point of commencement, along the northwesterly boundary of Chestnut Avenue, as delineated on the above mentioned map of ~outh oSSn Francisco, north 15° 33' east 45 feet; thence leaving said boundary and running north 74 2V, west 100 feet, n~th ! 0 ! 0 l~° ~ east ~$ feet, north ~ ~ west ~0 feet north l~ ~ east 10' feet, n~rth ~o ~ west ~7.90 feet, and north Z8° ~$' west Z~.~0 feet to a point in the southeasterly boundary of Uak Avenue; thence along said boundary south ~o l~' west ~10 feet, thence leaving said boundary south ~8© ~8' east l~0 feet, south 8zo 15' west 1~8.8~ feet, south ~o ~8. east 180.~? feet and south 88© ~0' east Zd~.~0 feet to a point in the northwesterly boundar~ of Uhestnut Avenue; thence along said boundary north ~$o $$, east l~.ll feet and north l0° OS, east 7B.89 feet to the pqint of commencement. l~lotice is hereb? given that Oerial Oonds to represent unpaid assessments and to bear interest at the rate of five (5) per cent per annum, will be issued hereun~er in the manner provided by Oivision l0 of the Streets and ~iighways Code, the ~mprovement Oond Act of 1915, and the last installment of such bonds shall mature four (4) years from the 2nd day of Ouly next succeeding ten (10) months from their date. The Superintendent of Streets shall cause to be conspicuously posted along the line of said contemplate~i work or improvements, not more that three hundred ~300) feet in distance apart, but not less than three (3) in all, and along all the open streets within said district, at not more than three hundred (Z00) feet in distance apart on each of said streets, notices of the passage of this resolution of intention, in the manner and form required by the "Improvement act of 1911". No~ice is hereby ~ven that on ~tonday, the 3rd day of ~arch, 1947, at the hour of 8 o'clock p.m., in the Council Chamber in the City Hall of the ©ity of South San Francisco, any and all persons having any Objections to the proposed work and improvements may appear before said City Council and show cause why said proposed work and improvements should not be carried out in accordance with this resolution~'~ ..... Except as hereinbefore provided, all of the hereinbefore mentioned work shall be done pursuant to an act of the ~egislature of the State of California, desi~!~nated as "Improvement Act 142 i hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City~of ~outh San Francisco this lO~h day of February, 1947, by the following vote: Ayes, Councilmen.: G..
